The NYTimes Wouldn't Do Something This Dirty To Osama Bin Laden

If you ever wanted to know who the New York Times thinks is the enemy, look no further than their hit job on John McCain today. They wouldn't do something this dirty to Osama Bin Laden.

To bring you up to speed, the New York Times ran this article on John McCain alleging that he had an inappropriate relationship spent too much time at the same public events as a female lobbyist. I'd note, of course, that they've never run even more serious and better sourced allegations about John Edwards's extra-marital relationship.

When I say "better sourced" on the Edwards matter, I should say "not sourced" on the McCain story. As Jim Gergahty notes,

All we get is "according to two former McCain associates," presumably that reference to one Senate, one campaign. Are these sources some folks he fired who might have an axe to grind? Or are these people who have no reason to lie, or to paint a more salacious picture than warranted?

We get one named source.

My friend Greg Mueller, with CRC Public Relations in D.C. understands the way the game is played and what the New York Times has actually done. If you don't want to browse through the depths of seediness with a story the New York Times is now refusing to publicly defend, just read this from Greg:

"I think this story backfires because, put simply, this is a bad gossip column. There is no evidence of anything in it.

"It was a poor and revealing attempt by the New York Times to try and smear McCain at a time when he is starting to define Obama as an inexperienced liberal, so the New York Times takes up for Obama's defense. If anything, this helps energize conservatives to come to McCain's aide in beating back attacks by The New York Times and other liberal media outlets.

"Rather than coming from MoveOn.org or some other Soros bankrolled liberal group, The New York Times has launched the first real negative attack of the general election phase of the campaign. Certainly, the Times cannot complain about a negative general election campaign in upcoming articles and editorials since they have fired the first shot."

So, if McCain can be accused of an affair just because he spent a lot of time with a lobbyist...hasn't he been shagging Tim Russert for 8 years? Not to mention damn near every journalist within 800 miles of D.C.?

then it was going to be the New Republic. It also appears Politico and Newsweek were pushing to publish it too.

If the above is true, you have to wonder if there's more meat to the story.

then the NY Times would have had more substantial evidence. Rumor has it that they had compiled this story back late last year but did not run it b/c they didn't have any hard evidence to back up the insinuations. Then they get wind that TNR is going to run their own threadbare story anyway and so, rather than get scooped, they run one of the weakest, least subsantive hit jobs I have ever seen. Two anonymous aides? That's it? That's their evidence?

I have to admit that I always laughed off the idea of the "liberal media." I used to think it was a valuable talking point that helped out Republicans politically, but was grossly overstated. No more. To see the TNR and NY Times run with an empty hit job, and to see an MSNBC host, Olbermann, basically drooling with delight as he runs with it, my mind has been changed. There is a liberal media, one dedicated to destroying conservatives and Republicans.

If the above is true (that there was an inter-media battle to publish it first) it actually indicates that there might be LESS meat to the story. I mean, if the New Republic, L.A. Times, Newsweek, or God forbid a blog might jump the gun and publish it, the pressure is on the NYT to get it out there first regardless of whether it's fully fleshed out or not.

Maybe there's more to it, but as of this moment the New York Times has embarrassed itself pretty thoroughly. And if it rushed to get that honor so that other media outlets couldn't that's simply all the more damning.

McCain is going to need a loyal and loud base to rally around him and call out this blatant hit piece, although his media base is the one throwing out the accusations, so that might kind of awkward. So it's up to the independants, moderates and Republicans convinced of his electablity to set the record straight. Good luck with that.

Is that it's hard to point your finger without sounding like one as well.

Yes, in the 1990's, Republicans *DID* pull out the "Family Values" values club to beat Clinton over the head with it... which got us Flynt and Livingston (which, I gotta admit, *WAS* funny) and all sorts of wonderful political theater when it comes to "Family Values".

But now it's 10 years later. Practically a lifetime!

And it's hard to see the NYT get so incensed about this without thinking "Didn't they think that Clinton's thing with that Monica chick was no biggie?"

And, as a matter of fact, *MY* problem with what Clinton did was not that he did it (though I appreciate that people think that I should care that he did it) but that he did it with *THE HELP*. "Dude!", I yelled at my so-called Feminist friends who were defending him, "DON'T (redacted) THE HELP!!! Find a Senator's third or fourth trophy wife! Find a lobbyist! THAT'S WHAT THEY'RE FOR!!! Find somebody, anybody, where there isn't a power dynamic!"

Well, these friends of mine called me a neanderthal (among other things).

So I see the NYT getting all incensed about this and I think "Dude. You saw no big deal with Clinton (redacted) the help but you think that this is a huge scandal? I don't think pointing at the Republicans and screeching 'HYPOCRITE!' will result in the message you want received being received."

But, again, I'm the kinda guy who gets called a neanderthal for his views so you probably should take that into consideration too.

Lie about the Conservative, so that when the facts about the lefty appear, no one will pay attention.
The rumors of Obama horsing around on Michelle have been all over the place for many months.
Now those Obama stories will have specific names and dates, but people will either roll their eyes about it, or make the false conclusion it is no worse than McCain.
The lack of journalistic integrity at the NYT is well established, and they will not change.

TNR is writing a story on backroom fighting at the NYTimes.

One example (of NYT scramble) was the hold (wait, delay) on this McCain Story.

"Bonus TNR Angle on the McCain Story: The McCain campaign is apparently blaming TNR for forcing the Times' hand on this story. We can't yet confirm that. But we can say this: TNR correspondent Gabe Sherman is working on a piece about the Times' foot-dragging on the McCain story, and the back-and-forth within the paper about whether to publish it. Gabe's story will be online tomorrow."

This basically works like CBS's excuse - well, we thought we smelled smoke and to keep from getting scooped we printed the article anyway but it looks like it may not have been such a good idea.

The funny thing is that these most liberal folks at all these media outlets constantly toss aside their high morality and principled views to deliver very capitalist driven mud-slinging that will supposedly increase their ratings (or readership). I told the Washingon Post four years ago where to stick their liberal views. It got to the point where there just wasn't any use reading the newspaper. There was no news in it - only liberal propaganda. But just like other stupid companies and investors, these high and mighty Media groups go for short term bursts of readership rather than developing long time relationships with their customers. The end result, they are shooting themselves in the foot.

A talking, but empty, head on Tv said that the story must have validity otherwise it would have been published closer to election day. Let others figure out the logic but even before hearing that particular drivel the thought that the media is already lining up an October Surprise, this being only the first smear, had occurred.

Not Obama, who's a collectivist nothing, but the media will be McCain's toughest opponent.

Here's the deal. Given the knowledge of sex scandals that have came out in the past couple of years, I wouldn't be shocked if McCain had some sort of relationship with this woman. It wouldn't be a story really. His flat denial is the issue.

If they have enough to prove he did it after the denial...then McCain's credibility is done.

I really hope McCain files suit. That would show he is serious about not being caught.

I'm not suggesting he bring a suit. I'm just saying it borders libel. A newspaper can not publish character dammaging pieces unless you can prove it is true. If he lost the election, he could show that damage was caused by this piece.

Now they do have some protection since he is public offical and generally the law give wiggle room in those cases but it still is extremely unethical, if not slanderous. This is something you would fail a journalism course for in college.

That is what worries me. If he is telling the truth he has a slam dunk to take down the Times. So the question begged is why wouldn't he sue them?

The NY Times did not really accuse McCain of anything. It just implied it.

Hence why I said it borders libel. They walked a very fine line. I still think a case could be made if they decided to take action but I think the court of public opinion matters more to McCain now.

Public figures -- and John McCain is definitely a public figure -- do not have recourse against character defamation. They have recourse against libel and as long as the NY Times did not "say" he had an affair, and they only "imply" that, then the NY Times can argue that they did not libel McCain.

As I understand it, is much much much different.

It's easier for anyone, even public figures, to sue successfully for libel.

As such, the media there has discovered circumlocution.

You cannot say "the Member of Parliament looked drunk" without being sued for libel and likely losing even if the Prime Minister *WAS* drunk... so the media says "the Member of Parliament seemed unwell."

And everyone of the readers knows that "unwell" means "drunk" but, in a court of law, "unwell" still means "unwell".

This resulted in a case a few years back where a MP held a press conference to talk about how he wasn't unwell, he was sick and talked about going to his doctor for a perscription and that's why he seemed unwell when he was merely sick.

It used to be much easier for public figures to sue for libel, but in recent years British law has moved closer to U.S. law in this area. There is now a qualified privilege for "responsible journalism" on matters of public interest, so that statements that turn out to be false are protected if the journalist acted according to standards of professional responsibility.

There's absolutely no basis for a lawsuit here. Since McCain is a public figure, he can win a suit for libel only if proves that the NYT made a false allegation with 'malice,' which means that the defendant *knew* the statement was false or made the statement with reckless disregard for the truth. This is an almost impossible standard to prove, which is why there are almost no successful suits for libel by a public figure. The NYT has not even directly claimed that McCain had an affair. There's nothing in the article that even comes close to the libel standard. And they should know. It was the Sup. Ct. case of New York Times v. Sullivan that established this extremely generous standard for the media.

I think, more over, what I am getting at is the ethical standard here. If I wrote a piece like this in one of my journalism classes in college, I'm pretty sure my professor would have made an example of me and given me an "F"

One reason to give this story an F is its use of anonymous sources when there's no good reason for it. Journalism ethics professors generally frown on anonymous sources. A justifiable reasons might be exposing a serious scandal or threat to national security. Using an anonymous source for innuendo about a romantic relationship doesn't count.

This seems like a set-up of another kind. The press is putting out a story to see if the person will deny it before they drop the hammer. Now that Mac has denied it, if they have more and release it then he is doomed.

I mean...can we admit we've had a few Republicans acting badly sexually? It wouldn't be new for a Republican leaders to be exposed of moral failings. What is wrong here is the cover up and denial attempt.

I am all for McCain as the nominee. I have problems with him but he is electable. Or he was.

If he had an affair, I can overlook that because I don't care what he does in his personal life. BUT, if he tried to cover it up then his image is destroyed. If he gets caught here he will lose the election. We can't have that.

There are people out there who believe it that could be swayed. Independents and moderates that McCain appeals to, like him because he is honest and authentic. If he loses them, when the base is already tepid about him...his candidacy is done.

He has to fight back and fight hard. He can be the victim of a smear who is fighting the good fight. It is a great narrative. He could even say that Hanoi didn't stop him and their communist progeny at the Times won't either.

In this world, the pregnant description of a pretty lady lobbyist having access to an officeholder, the insinuation that her access might be better than others, the insinuation that the reason for that better access might be her better assets; get the drift? Nobody has outright said anything untrue, they've just laid out the possibility for people to run with - and run they will.

How many libel suits have actually resulted in the plaintiff winning rather than in the media saying "Dude, it was an honest mistake, plus The First Amendment" and the judge/jury siding with the media (provided they print a retraction)?

I'm under the impression that it is *EXCEPTIONALLY* hard to win a libel suit under the best of circumstances.

Also, McCain's situation doesn't strike me as the best of circumstances.

Under prevailing law, it is virtually impossible for a "public figure" such as McCain to win a libel suit, and certainly not in this case.

I'm not going to write the legal treatise here, just trust me, there is no way he could win such a suit even if every single sentence in the Times article is false. So just stop all the lawsuit talk now, it is irrelevant to the issue, and cannot be used by McCain.

We all knew this--and more--was coming. Let's see what power the MSM has left. We jumped for John because he was electable and the war on terror.
We forgot that the MSM still sets the agenda for what is news in this country--they don't control the news as well as they did but, they still set the agenda.
And they will pull out all the stops to elect Obama--white, liberal guilt is a force more powerful than death.
It will be 1) hope, 2) hope, 3) change, 4) new direction, 5) change, 6) economy.

As much as I like and respect Fred Thompson, let's face it and admit he did not do well in this season's Republican primary. Why should we expect he would do better in the general election?

Again, I am a former FredHead but, face facts, Fred Thompson earned fewer votes than Mike Huckabee, Mitt Romney or Rudy Guiliani. Unfortunately, he is not our strongest candidate.

Ok, so the news media pick the GOP candidate, then turn on him--but many Republicans, instead of realizing they've been duped and picking a better candidate, rally around the candidate that the media gave them. Brilliant! It makes perfect sense!

Why do we suppose the media favored McCain over the other GOP candidates? Why do we suppose they gave him such good coverage? Because McCain was the least objectionable to them.

Memo to GOP for next time: Next election, don't vote for the media's favorite Republican candidate. Just don't do it.

Well, I'm a little suspicious of McCain's line that he "doesn't recall" any conservations with staffers about concerns over Ms. Iseman. That's the same thing he says about the acconts of two conservative Republican lawyers who heard him say he wouldn't nominate a judge like Alito because he thought Alito wore his conservatism on his sleeve. Someone is lying here--or someone is struggling with Alzheimer's. Two former McCain aides independently confirmed the account of aides confronting him about concerns regarding Ms. Iseman, and it's true that Ms Iseman suddenly stopped appearing at McCain meetins and on flights with him. Come on, folks.

Also, much of the information in the NYT article is not in dispute. For example, there's no dispute that McCain lobbied the FCC to expedite Paxson's request for a TV license--after he'd received over $20K in donations from Paxson executives and lobbyists and a time when Paxson's CEO was giving money to McCain's campaign.

as a staunch conservative who has not supported him strongly, I will be voting for John McCain in the election, just because of the NYTimes, and I think it will draw some indies to the GOP camp as well over this. Of course what do you expect from the paper where people write stories out of the blue with no sources.

Once in a while they will dig up someone from nowhere, say a Professor Snert from Anthropology A&M, to refute a story they can't abide.

At least one other blogger has attempted to explain this, but it doesn't seem to have sunk in. So...

Under the case of NY Times v. Sullivan, public officials do not have a cause of action for libel (i.e. defamation of character which has been published in some form), unless they can prove "malice". That is to say, the person who has been defamed has the burden of proving that the news organization knew the information to be false, or acted with reckless disregard as to whether it was true. As others have noted, this is a nearly impossible standard to meet.
