ImageHow are we today? It's shaping up to be a beautiful day here on the East Coast: sunny, mild, bit of a breeze. We are being teased with a cheerful June morning that seductively whispers to you about how you actually want to call in sick and head for the beach/mountains/park (even we VRWC Death Beasts like the park; the entire torturing of small woodland creatures thing, you understand). All in all, a lovely day to be alive.

And, oh, yes: Patrick Fitzgerald isn't indicting Karl Rove.

Oh, I'm sorry: you hadn't read about that, yet? My bad.

Yup, Fitzmas is a bust, numerous amounts of fevered speculation are now officially tripe and Tom Maguire is going to have less work to do: No Indictment of Rove in CIA-Leak Case.

Prosecutor Patrick Fitzgerald has informed top White House adviser Karl Rove that Rove will not face indictment in the CIA-leak investigation, National Review Online has learned. The word came yesterday, when Fitzgerald told Rove lawyer Robert Luskin that he, Fitzgerald, did not plan to seek charges against Rove. This morning, Luskin released a brief statement:

On June 12, 2006, Special Counsel Patrick Fitzgerald formally advised us that he does not anticipate seeking charges against Karl Rove.


In deference to the pending case, we will not make any further public statements about the subject matter of the investigation. We believe that the Special Counsel’s decision should put an end to the baseless speculation about Mr. Rove’s conduct.

Rove appeared five times before a grand jury investigating the CIA-leak case; the most recent was in April. Before appearing before the grand jury, Rove was interviewed by FBI agents assigned to the investigation. Fitzgerald’s inquiry, it appears, focused most intensely on the first two sessions — the FBI interview and the first grand-jury testimony.

My only regret - actually, I have two; the first involves the lack of a webcam of various 'Plamegate'-obsessed bloggers filmed at the moment that they hear this news - anyway, the second regret is that they didn't do this last Friday. It'd have been the bloody trifecta.

Anyway, enjoy your morning, oh ye lurkers. And through your bitter tears please take some comfort from this hoary platitude: it's not us, it's you.

on FOX & FRIENDS this morning, told me as I was stepping out of the shower.  I laughed solidly for what had to be almost ten minutes.

They had put so much stock into this, with their Truthout lies embraced by Chris Matthews.  

Even in defeat -- and that's what this is -- the WashPost drools over how tough the indictment-that-will-never-be would have been for an Administration "already on the political ropes."

It's over.  It has proven to be nothing.  The entire Joe Wilson Scandal™ has proven to be a running joke.

I can't wait for the obligatory Joe Wilson op/ed on the matter.  Then comes the book deals and the movies starring brad and angie.

Is that crickets that I hear? After all this, and not a word?

Things must be pretty bad in LibLand if they can't win even in the courts.

How much bandwidth has America wasted, how many trees have died, how many hours of ad time sold just to allow the MSM/DNC to make up bs and spam it wall-to-wall to hide the act that Joe Wilson lied?

Wilson, an out of work husband to a non-secret, politically active leftist emplyee of the CIA got her hubbie a consulting gig. It did not even rise to the importance of a secrecy agreement. It was so unimportant he was not even required to submit a written report.

It was a fluff piece. A piece of pity work provided from friends of his wife to let him try and build a consulting practice. And Wilson decided to lie about it and was used by the anti-American twits in CIA who think they, not elected leaders, should be in charge.

The core of the Plame-Wilson scandal is bureaucrats who think they know better. The core of the Plame-Wilson is that the MSM has become a useless, irresponsible echo chamber for one political party. Just like so much of the MSM today, their reportage is a pitiful scam: Rathergate, the lies about Katrina, the attacks on Tom Delay, the reasons for this war, the meltdown over the VP's hunting accident, the phony indictment of the Marine hero, and on and on and on and on.

Will the MSM finally, at long last, get some professional backbone? Will they finally have some sense, if not of decency, then of shame?

Time will tell.

Luskin was speaking only in the future tense - "does not anticipate seeking charges" - but doesn't address whether Rove has already been indicted!

His movie was not about global warming, it was about algore. He actually retold the story of his son's car accident, his sister's death, and claimed that Katrina was caused by global warming.

It was a slick movie, but was a sales pitch clinton could have made in his sleep. For alggore, it was a atruggle.

But it was evident that Mr. Fitzgerald's decision followed an exhaustive inquiry into Mr. Rove's activities that had brought the political strategist dangerously close to possible charges. In October, when Mr. Libby was indicted, people close to Mr. Rove had suggested that his involvement in the case would soon be over; speculation about Mr. Rove's legal situation flared again in April when he made his fifth appearance before the grand jury.

A series of meetings between Mr. Luskin and Mr. Fitzgerald and his team proved pivotal in dissuading the prosecutor from bringing charges. On one occasion Mr. Luskin himself became a witness in the case, giving sworn testimony that was beneficial to Mr. Rove.

He was "dangerously close" to being in trouble, so therefore guilty, kind of like how "almost" getting a victory in CA-50 is really a victory.

And the second paragraph will lead the moonbats to say that Rove's lawyer snookered the now-dufus Fitzgerald into backing off.

Howard, if they've taken you out of your straitjacket for your morning coffee read this, God punishes for sin, the courts punish for crime.  And my bet is you might be in for more trouble with the Big Guy then Rove.  Unless He makes excuses for insanity.

      If you want a snapshot  of liberal depravity this is it.  The man is exonerated of any crime related to a case where there was no crime and it's a "bad day for America".  A good day for America would have been if justice was turned on it's head and Rove railroaded and destroyed.  It's an alternate, negative image, world and liberals are alternate beings, perhaps human, perhaps not.

We're so fortunate to have Dean's view that leaking the name of a CIA operative is a "real sin."  Perhaps its discussed more in his favorite book of the New Testament, "The Allegory of Job."

As the day goes on, I will be checking the various political sites for reactions to the non-indictment of Karl Rove.

I always had the intuition that Fitzgerald had nothing on him of substance, and I wonder now if Dims are going to be out there screeching about " how much money we've wasted on this investigation," like they did after Starr's look into Monicagate.

And there you have it, the "rogue" FBI in 1993 tried to knock down the WTC using some innocent bystander because they couldnt park a truck themselves.  Hmmmmmmmm, I'm convinced.

Now, the White House needs to seize the huge opportunity that this latest news cycle has afforded them and make some real inroads politically.

In other news, after this great past week, the Intrade contracts for the GOP holding the Senate and the House have increased by substantial numbers.

GOP holding the Senate was down to around a 75% chance, and is now up to 82%.

GOP holding the House was sinking in the low 40's but now has rocketed up to 53!

For the first time in many months, I actually feel hopeful about the '06 elections.

Right now the MSM is still saying what Rove could have been charged with, and that Scooter Libby already has been indicted.  Probably the story of the non-indictment will go away quickly, to be replaced with "with Rove not under direct scrutiny, the focus will fall squarely on Libby, with questions being asked of others in Vice President Dick Cheney's office."

Wilson has apparently issued a statement from his lawyer (from RawStory)



"We have become aware of the communication between Mr. Fitzgerald and Mr. Luskin concerning Karl. Rove's status in the criminal investigation. We have no first-hand knowledge of the reason for the communication or what further developments in the criminal investigation it may signal. While it appears that Mr. Rove will not be called to answer in criminal court for his participation in the wrongful disclosure of Valerie Wilson's classified employment status at the CIA in retaliation against Joe Wilson for questioning the rationale for war in Iraq, that obviously does not end the matter. The day still may come when Mr. Rove and others are called to account in a court of law for their attacks on the Wilsons."

So, the short answer is, alas, probably not.  But the comedic thing is reading all the posts of the tin-foil hat brigade who've now got a new target.  Problem for them is, the Wilson's got no case (otherwise, Fitzgerald would have tried to indict for exposing her).

They just keep digging deeper and deeper into their little fantasy world.

Stands for 'driving' not 'drunk'. The 'Under the Influence' part is what includes alcohol and drugs both perscription and 'recreational'. There is no legal charge of 'drunk driving'; that's just what the newspapers report for us non-lawyer types.
