Tech at Night: Obama and FCC power grabs in Cybersecurity and Spectrum; FCC spying

Wow: For a year FCC was tracking the movements of its speed testers without telling them! Privacy! Transparency!

Meanwhile the administration continues to try to do things on its own, without bothering to check that part of the Constitution that says how a bill becomes a law. Remember, the Lieberman-Collins Cybersecurity Act failed in the Senate. It has no business becoming an executive order. It also turns out that they are also looking to grab power when it comes to spectrum, which isn’t great news given the FCC’s obstruction and opposition to the use of efficient market allocation.

Look, 11,000 pages of regulations have been added under Barack Obama. Consider that the Federal Register only needed 71,000 pages total in 1975. These regulations are being added without transparency, as well.

This is too much, and he wants to grow government further with an executive order on Cybersecurity, which is rightly opposed by a group of Senators in the Wall Street Journal. Enough is enough.

Some have said that the Obama administration is saving up disastrous regulation for the second term, but the FCC is wasting no time. Not content to obstruct wireless innovation with painfully limiting spectrum policy, FCC is now duplicating FTC efforts and playing speed advertising nanny.

Duplicative regulation protects nobody. It’s adversarial.

Darrell Issa’s House Energy and Commerce is going to have a special hearing with all five members of the FCC, including newly confirmed members Jessica Rosenworcel and Ajit Pai. The FCC is expected to be questioned about issues ranging from wired phone competition to spectrum. WCITLeaks having some success, possibly, as WCIT itself starts talking about openness. When even pro-Internet-regulation folks oppose UN or ITU regulation of the Internet, it needs sunshine for public evaluation. Tech at Night: Obama’s FCC transparency failure, video regulatory failure, Google censorship

Instead of the transparent Obama administration we were promised, from the Obama FCC, what we have here is failure to communicate. We need to continue to cut the FCC out of the loop, the old regulations are harmful when it comes to retransmission consent and the whole cable company/local broadcaster nexus. Clear it out, deregulate, restore the free market, and the public will benefit.
