First Medical Professional Lawsuits Are Filed

You know, there should be a running diary of all the lawsuits that are going to be filed as a result of the recent medical monstrocity that was passed. This won’t be it but – please make sure it gets on the list. The Association of American Physicians and Surgeons (AAPS) announced yesterday they have filed. Here’s their press release.

“The Association of American Physicians and Surgeons (AAPS) became the first medical society to sue to overturn the newly enacted health care bill, the Patient Protection and Affordable Care Act (PPACA). AAPS sued Friday in the U.S. District Court for the District of Columbia (AAPS v. Sebelius et al.).

“If the PPACA goes unchallenged, then it spells the end of freedom in medicine as we know it,” observed Jane Orient, M.D., the Executive Director of AAPS. “Courts should not allow this massive intrusion into the practice of medicine and the rights of patients.”

“There will be a dire shortage of physicians if the PPACA becomes effective and is not overturned by the courts.”

“The PPACA also violates the Tenth Amendment, the Commerce Clause, and the provisions authorizing taxation. The Taxing and Spending power cannot be invoked, as the premiums go to private insurance companies. The traditional sovereignty of the States over the practice of medicine is destroyed by the PPACA.”

There are a few other graphs to this if you want to read the whole thing. The White House had us believe prior to passage that the medical community was all for this bill. Trotting out white coats at press conferences and making them available at every photo op. Obviously, by this suit, that’s not the case. The physicians are our allies in this fight and they can help when it comes to repeal.

Of course adding this suit to the 13 states (so far) filing suit should keep the White House lawyers busy for awhile.

    The more people that file suits against Obamacare the better. Now we have states attorneys general, a medical organization, and Mark Levin as a citizen. Once a bandwagon starts rolling, more are emboldened to jump on. I suspect that there will be many other types of organizations to join the movement. I wouldn’t be surprised if the medical device and supply community doesn’t join in. They are some of the first to be harmed with taxes.

    Yes, keep the Justice Department busy for a long time.

    I wrote the docs lawsuit earlier this morning. Then came upon SC govenor calling for a constitutional convention. Don’t like to post two diary’s in the same day, but have gave sound logic as to why repeal won’t work and lawsuits and things probably won’t work.

    it sounds tough to do, but I think this is something we as citizens can take part in. He’s calling to get the backing of other states now. We can call our state legislators and ask them to get on board. its not easy. But its not vetoable either. :)

    One of the big front page people need to do a larger article on what a constitutional convention entails. These conventions don’t happen often but boy when they work they change everything.
