NH SENATE RACE-10 REASONS WHY KELLY AYOTTE IS NOT A CONSERVATIVE


After reading this site for the better part of the last year……..and the posts relating to the New Hampshire GOP US Senate race, I decided that it is time for me to say my piece.  I admit to being a “classic” New Hampshire conservative in the Ronald Regan or compassionate conservative tradition.  I dislike labels, but I think it helps frame me for the discussion.  I am not a New Hampshire native, but I married one and have lived here for the past 33 years……..and  by now I feel I have earned my conservative stripes.  Owning a business has also hastened that conservative development process……well enough I think to know a true conservative when I see one.  Former Attorney General Kelly Ayotte is no true conservative.  She has labeled herself as a conservative to run for the US Senate seat, but that is completely self described and not supported by her record as AG.  Her labeling offends my sensibilities.

Her experience as our AG is the sole basis for the legitimacy of her candidacy…..so it is fair game for me to use it, and it alone, as the basis for my contention that Kelly Ayotte is not a true conservative.  If you don’t fancy yourself a conservative or feel that conservative principles are what is needed to turn our country around, then vote for her anyway as it doesn’t matter.  However, if you believe like I do, that now is the time to send true, authentic conservatives to Washington to fix this Obama driven mess, then I offer the following examples:

1) She was responsible for supporting Gov. Lynch’s attempt to raid the $110M JUA fund in 2009.  This attempted private property taking by our government was stopped by a lower court and confirmed by the NH Supreme court.

2) She repeatedly urged Gov. Lynch to veto the expansion of the Castle Doctrine in 2006 (SB318) and 2009 (HB160).

3) She supported the nomination of Judge Sonia Sotomayor,  but now opposes Elena Kagan’s nomination.

4) She previously supported Federal earmarks before changing her position, as candidate Ayotte, to oppose them.

5) She spearheaded the state’s efforts to apply for Federal stimulus funds and was responsible for their administration, but now candidate Ayotte opposes the stimulus spending.

6) In 2005 she forbade state police from enforcing trespassing  laws against illegal aliens and using them to take the aliens off the street, but now supports Arizona’s right to defend itself.

7) In 2006 she testified in favor of HB1713 requiring a photo ID to buy cold medicine.

8) In 2007 she testified against HB906, informing juries of their right to nullify.

9) In 2009 she opposed part1, article 8 right to hold public officers accountable in HB312.

10) In 2008 she testified in support of broad application of state DNA testing  in HB1640.

In addition to the above, there are many other controversial issues involving AG Ayotte that many people feel have never been fully vetted,  the ongoing FMR ponzi scheme case and the 2007 Liko Kenney -Bruce McKay shootings in Franconia to name just  a few.  Just spend a little time with your search engine and you’ll find them.  I take most of them to be related to her performance as our AG, as opposed to defining her true ideological principles, so they won’t make this particular list.  I think when you have spent nearly your entire professional career working for the government, prosecuting people and businesses in the AG’s office, it’s hard to turn the switch and represent, work for, and defend the rights of everyday people.

Like other examples of truth in advertising, I have no problem with Kelly Ayotte saying she is a moderate and holding true to her past positions and her record as our AG.  But a true conservative she is not, because a true conservative’s record as AG she doesn’t have.  I don’t think of her as a bad person and have no personal history that would predispose me to dislike her.  Maybe if I spent more time looking at her performance I could get there, but already knowing I wouldn’t support her it doesn’t matter.  If a presumed pro-life, tough on crime moderate Republican is your cup of tea, well you are all set…….hitch a ride on Kelly’s wagon and take the ride…….. in sort of the pro-life version of Rudi Giuliani.  However, if you are like me and want the real deal, true blue conservative Republican who doesn’t have to change his positions to run to the right …….vote for Ovide Lamontagne in the truest tradition of Ronald Regan.  I think the choices would be pretty clear if both the labels were on correctly.

Simple answer is “no”. I don’t think Bill makes it to the “moderate” level in NH……..maybe he would in MA. Listen, when you have all the money you will ever need, own a country club on the ocean, and probably are too old to drive your own race cars………..why not spend a few bucks and run for the US Senate. Maybe he has the best intentions, he would be a much better fit (CEO) running for Governor. Unfortunately, like our last rich republican CEO turned Governor (Benson) it is really hard to go from having almost complete (do as I say) command and control running a private company to being part of government. At least as Governor, you are still only 1 of 1……….as Senator you are 1 of 100……..huge difference. No one has ever successfully managed to buy a Senate seat in NH in the past and I don’t see this as being any different. Binnie has no true base to show up on Primary Day………and falls short. He won’t get conservative voters (like me) in a primary…………general election against Hodes is another matter.

I grew up in PA but my family is from West Side Manchester, and I have watched this unhappy dynamic in NH politics all my life!! The perfect as enemy of the good!! The worst example of this was 1980, when 6 conservatives split the vote and we ended up with the liberal Repub Warren Rudman as Senator!! Aaaarrrgh!! Please not again!! Ovide Lamontagne has been losing all my adult life. No more please!!

The GOP primary winner wins the general election in November. NH will not elect (liberal) Paul Hodes to the US Senate in 2010. None of the 4 major GOP candidates are liberal………so the real spectrum is:

Binnie: Left of Center Moderate

Ayotte: Center Moderate

Bender: Right of Center Moderate

Lamontagne: Conservative

To each his own. I choose Conservative.

Given that Ayotte has a huge lead in general election polling and is fairly moderate, I’m glad to have her in the Senate over a liberal.

Our country is in this mess because we Americans too often “settle” for someone to elect, rather than trying to elect the person we really want. If Ayotte is the candidate you truly think is your best choisce, then by all means vote for her as your personal conviction. However, if what you really want is a true conservative, then don’t settle for the most conservative person as possible this time………this time anything is possible. All we have to do is look around this blog site and understand that this country is just yearning to elect real conservatives this time…….and not settle for runner up conservatives who are perceived by the media…….or the pundits…….or the press to be the most electable. We the people get to decide who is most electable with our VOTE on primary day. I say vote for the person you WANT to represent you in Washington and the heck with “second best” conservatives.

Senator Gordon Humphrey…………who chose to only serve 2 terms…………which is also the Lamontagne pledge. Gordon came back to NH by choice and was elected to serve in our State Senate. There is no shame in elected principled leaders like that.

I would gladly take 12 years from someone who is truly looking out for my interests over someone else who spends a liftime in Washington looking out for themself.

Well you obviously are not from New Hampshire. Polling means very little here. Anyone who studies polling (those that either run campaigns or do it for a living) knows this to be a truth. NH voters break very late……..every election………very predictable.

I will repeat the same thing I said above: “The GOP primary winner wins the general election in November. NH will not elect (liberal) Paul Hodes to the US Senate in 2010.” You can take that to the bank. Hodes could only win in House District #2 when the tide was against the Republican party……….he has no chance to win a statewide election when the tide is against the Democratic party.

WEDNESDAY UPDATE: HODES TRAILS ALL FOUR. Another tough poll for U.S. Rep. and Senate candidate Paul Hodes and the Democrats has just been released.

The new Rasmussen Reports poll, a telephone survey of 500 likely New Hampshire voters conducted on July 12, found that for the first time, Hodes trails all four Republican U.S. Senate candidates in head-to-head matchups.

Kelly Ayotte and Bill Binnie fare equally well against Hodes. Ayotte leads the Democrat 49 to 37 percent, while Binnie leads him 49 to 38 percent.

But now, Rasmussen says, Jim Bender and Ovide Lamontagne have moved slightly ahead of Hodes. Bender leads him 43 to 39 percent and Lamontagne leads 43 to 40 percent.

Given the poll’s 4-1/2 percent margin of error, those two results are statistical dead heats.

Maybe I have failed to be clear in my opinion on polls. My bad.
I don’t believe in their ability to accurately predict the outcome of elections in NH…..simply because they have failed to time after time after time. I understand that looking from the outside, that’s all you have to go by. That is unfortunate. The truth is that all these races in NH are very fluid and you won’t find any arms length NH pundits willing to make a prediction on a winner in the contested GOP races (Senate, 1st District, 2nd District, and Governor). It gets a little easier to put some greater reliance on the party to party head to head match ups, but even those numbers have little certainty at this stage.

My predictions for a GOP win in the senate race is not based on the latest Rasmussen poll……..its based on the street sentiment that no way will NH elect Paul Hodes to be our next US Senator in November. The GOP winner would have to be charged with a criminal offense between Set 14 and Nov 2 to lose the election to Hodes in 2010.

But if you want to convince us...

I don’t think any position on who does what to whom can be substantiated with proof in advance of the outcomes. I can’t offer you proof that votes given to Lamontagne will be at Binnie’s expense any more than you can prove that votes taken from Lamontagne go to Ayotte. I agree that my opinion doesn’t matter, but it is my opinion.

If everyone believed that Republican primary voters simply had to vote for Ayotte for fear that a more liberal Binnie would get the nomination, or that only Ayotte could take on and defeat Hodes in November, then I suppose we didn’t need a primary at all……..we would just anoint her the nomination now. But keep in mind that it is highly probable that the primary winner won’t pull much more than 35% votes…….or put another way, nearly 2/3 of the voters will vote for the losers.

I happen to believe in a candidate other than Ayotte as my 1st choice and it is likely that at least 60%+ of the voters on primary day will be voting likewise. Therefore, I will vote and support my 1st choice with conviction and let the chips fall where they may. To me, we are at a place in time for people in New Hampshire to vote for the most conservative candidate that they believe in……..not who the party (Judd Gregg) has hand picked to be the nominee. If for you that is Ayotte, then by all means support/vote your conviction.

The idea is to position the Republican Party to take over the Senate in 2011 or 2012. That means electing the most electable Republican and that is Ayotte. Her actions and policies as AG in New hampshire have to be seen in light of the job and its effect on law enforcement, her primary responsibility in that job title. Please don’t shoot yourself in the foot my nominating an unelectable candidate against the decidedly liberal Paul Hodes!!!!

First I would say the same thing as I just said above to Neil. The GOP nominee wins the general election in 2010…….you would know this to be true if you lived here. If there is a window in Vegas to place that bet, it is money in the bank.

Although we are not as RED as we used to be, we are decidely not BLUE. We have the three current Democratic representative (Hodes, Shea-Porter, and Shaheen) in Washington because the voters threw the baby out with the bathwater just like the rest of the country. All the sins of the world were dumped onto Bush and these folks paid the price. It was a tragedy that we lost a couple of great people in Sununu and Bradley.

Now Obama and his supporters (Hodes) has handed us all the fuel we need to take back our state.

I can tell you what I know from living here for the past 33 years, raising a family, and running a business. NH will not elect Paul Hodes to the US Senate in November, 2010.

If you bel;ieve that fundamental premise, then you are free to vote for the candidate you really want instead of the candidate that the pollsters say has the best margin over Paul Hodes. As I said before, nobody should make poliitical decisions based upon NH polling………the only poll that counts is election day.

The one and only reason we have liberals elected in NH now is the the 2008-2010 anti-Bush syndrome………..which is over. We are not a liberal state and Hodes is liberal to a fault.

1. Ronald Reagan was no “compassionate conservative”. He allowed domestic spending on some programs to rise because he saw it as the price to be paid to a Democratic House (and later Senate) to win the Cold War.

2. “Compassionate conservatism” is neither. One of the big difference between Reagan and the Bushes is that while Reagan allowed spending (used it as a bargaining chip with Democrats), the Bushes actually encouraged domestic spending.

3. There is no such thing as a “true conservative”. Use of that term here typically marks a Moby, a concern troll or just a fool. Pick one. There are no other choices.

4. Lose the caps in the title, they’re offensive. If you’d actually paid attention for the year you say you’ve been here you’d know that.

I apologize if I don’t measure up to your standards. Maybe I’m just not as smart as you or as educated as you or maybe I was born with defects I’m not aware of.

Since I have no previous posts, I admit to having no credibility to speak in your club. What I do have is a lifetime of experience living and working in MA and NH and understanding New Hampshire and New England very well. So I simply speak from what I know. There is no premise here that I am trying to qualify for national office.

If my descriptions or analogies are not good enough or pure enough to warrant your serious consideration, then I am sure I won’t hear from you again.

Ayotte is a conservative. She is absolutely a conservative and a fighter. She fought to protect a pro-life parental notification law in her state, against the will of her democratic governor. She is conservative down the line on the issues. She is tough on crime, pro-gun, pro-life, pro-national security and a deficit hawk. She refused to take a pay raise as Attorney General and was named Citizen of the Year by the conservative New Hampshire Union Leader.

Oh and Binnie is a liberal, not a moderate. And Bender is pro-choice, and pro-gay marriage. Ovide is a 2 time 15 point loser who has done nothing but sink in the polls since he entered the race. Ayotte is who conservatives should rally around because she is conservative, she is new, she is a fighter and she will crush Paul Hodes.

From Bender’s website:
“State government has the responsibility to regulate in this area without interference from any branch of the Federal government. I believe in strong parental consent laws, I oppose Federal funding for abortion and I support the ban on partial birth abortions.”

That sounds like the liberty position to me.
And, the following does not sound like pro-gay marriage to me.

“I believe that marriage is between a man and a woman. I support civil unions with equal rights, but the federal government should not require churches to violate their own beliefs. Religions that believe marriage is between a man and a woman must be respected and the federal government’s role should be subordinate to the states, just as the Constitution provides.”

I’m voting for the Constitution.

I know from your posts that you believe in Ayotte. That’s OK. I have many friends who are Ayotte supporters and I take nothing away from them. But my point from the beginning is that you can’t just claim to be a conservative to be one. Your public record has to support your claim. Her record as our AG and her public statements are laced with non-conservative positions. So if she has only proven herself to be conservative on some issues through her record, claims to be conservative now on other issues where she has no record, and has shown herself not be conservative on other issues in her record as AG, why does she deserve to be self labeled as a conservative to run for Senate? I stick by my 10 examples above, but I’ll list more if you really insist. Please go ahead and refute any one of them as not being accurate.

Most of the things you cite are directly related to her position as Attorney General. She is a prosecutor first and foremost, so of course she may seem stringent in that area.

First, that may offend some libertarians, but you are not going to find too much sympathy here. There is a balance. and she is a typical law and order republican.

Second, I suspect she may moderate a little to appease the greater base, but more importantly, none of that matters as a Senator. Kelly will have nothing to do with criminal law as a Senator.

DNA testing, juries instructions, IDs to by cold medicine…. Are you serious. Most of the things you cite can being explained away rather easily and anyone who votes against her because of criminal procedure is a dope.

Your past posts didn’t go unnoticed. Please note that I never said not to vote for her if she is who you like. If you want her to win…vote for her. I’m saying in my 10 examples, with a declining level of importance, that her actions as AG don’t sit well with a lot of us…….that they cause her to not be conservative enough for our taste in a candidate in 2010.

Can she beat Paul Hodes?…….I surely think and hope so. Do I personally want to see a more conservative candidate win the GOP nomination?……..absolutely. Her attempted $110M JUA funding grab was enough for me to look elsewhere. She was the AG. She didn’t have to do what the Governor told her to do……..and behinds the public screen she was intimately involved in making and supporting the decision to go forward. Just add to that her opposition to expansion of the Castle Doctrine and that’s more than enough for me.

However, if I have too, I will hold my nose and help her in November if she is the GOP nominee.

@Neil Stevens – there is no reason for Lamontagne to stay any more than 12 years – what he is proposing as a term-limit. I agree with him. If he is an effective leader (which I am certain he will be) he can get done what needs to be done in 12 years and let someone else come in.

We don’t need anymore Kennedy’s or Byrd’s.

Further – Rasmussen today has Ovide beating Hodes. Choose the conservative you can trust.

As I have said before the RECORD doesn’t match up to the label of Conservative. Maybe she can be a real conservative in the future as a Senator……….as in like be one on most all the issues, not just some of the issues. Most people find in harder to walk the walk than talk the talk. Her actual public RECORD as a conservative is thin to be very kind.

Too bad Sarah didn’t actually check out her record before yesterday’s endorsement. Then again, Sarah doesn’t have to pick the best conservatives to make it into her pack of mamma grizzlies……..hope it comes back to bite her in 2012. New Hampshire conservatives will remember.
