So, why won't he show the birth certificate, anyway?

I am not personally convinced the birth certificate is an issue, but I have to say, I have no leg to stand on but my “feeling” that it isn’t relevant because we’ve not seen actual birth certificate to butress my “feeling.” So, what do I tell people that insist this is an important issue?

I have nothing logical to tell them to disabuse them of their notion because I can’t prove them wrong.

So, why won’t Obama just publish the real birth certificate?

Personally, I’d just as soon encourage them to pursue this line of investigation, in spite of the fact, that I, like Mr. Huston, don’t believe Obama is hiding anything about his birth. It does however bring us closer to getting our hands on other things that are relevant; his transcripts, documents from his community organizing days that are right now being protected from public view, and so on.

And then, there’s the outside chance that these guys are right that Obama isn’t a citizen. The Democrats are really known for being good at vetting, are they? If he isn’t, the Democratic Party would have a vested interest in keeping the facts under wraps, wouldn’t they? Something like that could implode their Party.

I doubt that the Supreme Court would rule on the matter on the grounds that it is a “political question.” The Court has often refused congressional challenges to executive power assertions, In those cases, one man may “over ride” the Constitution.

I have always recoiled from the assertion that the constitution says what the court says it says. That was not the system at the founding.

All branches of government are under an obligation and oath to uphold same.

One other problem in this area is the lack of definition for natural born within the document and even outside same. The Court could also refuse to rule based on vagueness and leave the issue up to the American people to decide politically.

There is no inherent illegitimacy for majorities to determine such an issue.

In some cases, the constitution means what one man; congress; electors or judges say it means.

I can get the link to my column in a bit. The main issue comes down to whether at least one of his parents was an American citizen when he was born, so that even if he was born in Kenya, so long as his mother had not renounced her US citizenship prior to his birth, then he was natural born.

belitling is not debating and most of your first post here was more about belittling than discussing anything. You handed out dictates as to what can and can’t be discussed, while discussing nothing, and cite the LA Times as the definitive authority on all things Obama.

Someone else here referred to a site called FactCheck. FYI on FactCheck: they are run by the Annenberg Challenge, which has a lot to lose if they are covering for Obama in any way, considering he used to be on the board there along with Bill Ayers and others of the far left.

Given these things, I can understand why there’s still a lot of doubt out there about who Obama really is; and this coming from someone who stated upthread that she doesn’t believe that Obama is lying about his citizenship so take it for what it’s worth.

And I’d take Neil’s threat seriously if I were you, although, you’ll probably go to KOS or somewhere else and make spurious claims of being banned for wanting to “discuss” things.

none of his medical records have been made public. That would not be a problem, if the the left had not demanded and succeeded in getting everything they could about John McCain and his cancer history out there. Also, Joe Biden enjoyed limited medical history release.

The fact that all of Obama’s college records are sealed and we have no documentation of any of those years, is what make him suspect. Although, as Janis commented further down, the “conspiracy succeeded.” The citizenship issue can be of no help at this point.

If he took over his adopted fathers citizenship that would make him ineligible to be President…I don’t believe you can have duel citizenship and be President. It is “rumored” that he traveled to Pakistan (at a time when American’s did not travel to that area.)

I would like to see the documents like his birth certificate, any prior passports and documents on who paid his tuition released. I’m not going to hold my breath waiting for them however.

That one about traveling to Pakistan is pure rumor, If you look it up there was no travel restrictions for travel to/from Pakistan for US citizens.

Not that it matters. Citizenship goes through the Father, so Obama was born either Kenyan and/or with British Citizenship as well as US Citizenship.

The argument is if “Natural Born” means Born to 2 US citizen (NATURAL or NATURALIZED) parents. Otherwise I believe the Founding Fathers would have used the term “Native Born”.

Being adopted does not destroy citizenship under our law. No other person, court or country can destroy our citizenship as far as it applies to this country.

Some foolidh Americans, in the Twenties and Thirties, took their families and went to the Soviet Union. They and their children became Soviet citizens under Soviet law. However, when those children reached their majority, they were allowed, under American law, to return to the United States. Neither the actions of their parents or Soviet law could destroy their citizenship.

The mere fact that another country may consider a person a citizen under their laws has no effect on that person’s American ciutizenship. The acceptance of and use of another’s countries passport does not destroy American citizenship.

The acts that would destroy a person’s American citizenship cannot be performed by a minor child and neither the child’s parents or guardians can peform those act on the child’s behalf.

Do not classify the words or deeds of your opponents as being hatefull, malicious or criminal in nature if they can also be easily characterized as simple ignorance or gross stupidity. Anon.

 
 
 
 

I'm Just Tired of The One Getting A Pass

The Obamessiah is supposed to be so transparent & could put this to bed by opening all of his documents to PUBLIC scrutiny, not Snopes, Kos, & fact check.org. McCain had to deal with this issue over his birth in Panama to US citiizens that could pass on US Citizenship in what was at the time of his birth US sovereign territory. If the Dear Leader is in fact eligible beyond a reasonable doubt then hope for the best that he does the least amount of damage possible.

If not, I am a Naturalized United States Citizen & a Veteran of the United States Military, this to me is a serious issue. I took an oath to support & defend the Constitution of the United States TWICE, once to officially become an American, & also to serve in her defense. This is a serious issue because there are lawsuits lining up Military members as plaintiffs as to his status, & they face the very real prospect of Courts Martial & punishments that goes with it for questioning his bona fides as POTUS. The left bellyached & moaned over when the military was primarily draftees with no choices, & now with their arguments with an all VOLUNTEER force they would pounce at the opportunity of saying the most respected institution in this country is in the early stages of mutiny in their eyes.

If he is truly qualified to be POTUS, he owes to those who will be put in harm’s way. I lived in NYC when the towers came down & I despise the “Truthers” that claim it was an inside job, but never paid attention in or took a basic physics class. My gut tells me he has something embarassing, but unfortunately not disqualifying.

However, I believe the Natural Born requirement should be adhered to, god forbid Schwarzenegger got a chance at the Presidency.

There is no way to prove it without a shadow of a doubt, just like everything else in this world, there is always a chance that its fake.

But when most of the evidence points in the other direction, you can only assume which one is right.

As I sit right now in a jury holding area, again participating in what I believe to be my civic duty, I believe any concerned Citizen should be able to file for a long form copy of O’s birth certificate after filing out a FOIA form which is the entitlement of all citizens, pay a filing fee and get it. This would put a vast majority of this to bed.

All candidates should have been thoroughly vetted by all states’ Secretaries of State. They are all complicit for malpractice if in fact it is found in the remote possibility that he is Constitutionally ineligible, & this should have been brought to light before the Electoral College was sat, there primary role is to insure that the Constitution is not usurped. Honestly, let’s for arguments sake he is found ineligible the Secretaries of State, & the Electoral College have undermined the votership of the United States, because if he was found Constitutionally ineligible we would not be having this discussion.

Do this with all of his records. The moment he stepped into the political spotlight he set himself up to the scrutiny. Again I think he has something in his paperwork that is of an embarassing nature.

Again my only true concern is people no matter how well intentioned are bringing in as plaintiffs Active Duty Military personnel. I believe like they do that what was written in the Constitution is in there for a reason & is just as pertinent today as when the ink was still drying. It is the foundation for our rights and protections, that many who wood like to scrap it for an internationalist model would love to do away with, my proof is the next Justice nominee Koh.

Again let me reiterate, don’t like Barry myself, didn’t vote for him I think he lacks class, but I think there are some really embarassing things he is fighting like mad to keep under wraps, not that he is ineligible as POTUS.

Release them for PUBLIC SCRUTINY BY ANY PRIVATE CITIZEN, not the usual suspects that will shill for him on the left. Be TRANSPARENT while I HOPE for the start of some CHANGE in 2010 for the better.

Because there is so much evidence that the Holocaust happened, and so little evidence that the faking of the birth certificate happened, we can safely conclude that Obama is a natural-born citizen, and that the more conservatives bark up this tree, the less credible their opposition becomes.

the reason there is not a lot of evidence might be the same reason there was no evidence for the holocaust in Britain or the United states during the war. We only found out after. Since those people who might be covering it up are still in power they might be, well, covering it up. It is a further fallacy to say that hundreds or dozens of people must be involved. It might only be a handful.

I don’t know about conspiracy theories or any other reason he shouldn’t be POTUS; however when something so simple can not be answered my antennae goes up. My guess if there is a problem it’s that there may be a reference to him as Kenyan, Muslim, our some other reference that would be “embarrassing”.

In brief:

An American birth certificate would establish American citizenship at birth. However:

1 - the constitutional requirement that the president be a natural born citizen is not met merely by American birth. If his father was Mr. Obama Sr, then he’s not a natural born citizen.

(And, No, the 14th amendment has nothing to say about this.)

If, however, his birth certificate gives his father as an American - say Mr. Davis- he would be natural born, and he’d have an obvious explanation for his failure to produce his birth certificate. (and, less obviously, and explanation for his ability to enter and stay in expensive private schools from Hawaii to L.A., Boston and Chicago)

2 - His mother married in Indonesia and sent him to an approved school there. Neither would have been possible unless she formally renounced her American citizenship and that of any dependent children first.

We have no record that he ever availed himself of the opportunity allowed by law to reclaim his American citizenship after his return to the United States.

Thus the most likely reality is that he’s actually an illegal alien.

As far as I know he has no defence on this - and so the suspicion arises (but note that there’s no factual evidence) that he’s withholding a legal birth certificate for release if/when his status becames a public issue just so he can tar all the eligibilists (!) with one brush (off).

As I posted above, no other person - not even his mother, an American citizen by birth, can renounce Barrack Obama’s citizenship.

As Barrck Obama returned to live in the United States while still a minor child, there was and is no legal necessity to “reclaim” American citizenship.

If the child is born to US parent(s) there is a certain length of time to notify and fille a document with Dept of State. It is called something like
“Notification of Birth to US citizens when abroad.” I can’t remeber the exact name but it exists and I have seen them. Anyway at different eras there are different time-frames. So this covers kids born to US missionaires or to U.S. citizens working abroad.
So as I was working in travel and had to view people’s citizenship docs, I viewed one, a Certificate of Naturalization (not the above mentioned doc),one like any one that wants to become a citizen receives. The man had one that showed his citizenship was Afghanistan. I asked how did he end up as Afghani? (He obviously was not a Moujahedeen). He replied that his folks were missionaires and did not return info about his birth until outside the time frame for doing so. So he ends up with a Cert of Nat and then he can get a PP if he wants to.
Anyway that is what I think Obie has: A Certificate of Naturalization document showing Kenya as citizenship. All this is not rocket-science. IT should have been available, or made available.
At College, it reads like he was in the foreign students dorm. Was he getting money or subsidy for this?
Better to pay attention to electing Conservative Reps and Senators. The BC thing is a distraction to keep us from the work at hand.

If Obama came out and SAID he was born in Kenya, it would not matter. No court would overturn the election. This Congress certainly would not impeach he. There are plenty of other things to focus on.

For that mattter, technically, Hillary should not be Sec of State. Check the emoluments clause.

It’s not that it’s really fake you understand. kchand, nobody is spending all that much time on this topic. It crops up and we’re reminded once in awhile that it’s still an viable topic but open your eyes and look around at all the other things that we discuss that are the here and now. This is not something we should focus on, IMHO.

If anything, the focus on his birth certificate should be based around the fact that every other candidate for the Presidency before him had to produce it to the baying of the Press Corps.

Every other candidacy for the Presidency also had to let the world have a peek at his medical and academic records. McCain did.

Obama did not.

Let’s focus on that stuff instead if documents are what we’re after.

Without the birth record issue as insurance, how would the Democrats have any lever to release an untested, inexperienced President (with a radical background to boot) from his duties if push came to shove and Obama proved a loose cannon or decided to jump the rails of his party’s handlers? If Obama causes real harm to the party, any grounds to impeach him other than a constitutional breach would cause Democrats massive voter reprisals from the demographic upon which their party is dependent.

Under US immigration law, the determination of the child’s status as a US Citizen is different as to whether it is the mother or the father clainng the status. It basically comes down to who gets pregnant. Honestly.

If the citizenship is claimed through the mother — as is the case here — it is automatic. You know its her kid, she was heavily involved in the birth, to be a bit blunt.

If if the citizenshi is claimed through the dad — Dad must acknowledge paternity before the child is 18.

There is NO restriction that I am aware of that the President cannot be a dual citizen. In this case, natural born US citizen through Mother and then whatever the laws of Kenya apply with regard to his father.

My take — the Republicans need to drop this. There are so many more things of substance to attack him on. Harping on the birth certificate just makes us look like the Democrats who complained about Bush being “appointed” by the US Supreme Court. We have better things to do with our time and resources.

Winston Churchill’s mother was an American. I watched a program about him where he is reported to have said that had his father been the American instead of his mother, then he would have been POTUS.

I do agree with you, however, that nothing at all is going to be done about the questions surrounding Obama. He will remain POTUS until someone else is voted in.

I don’t think anything is going to be done to roll back Obama’s election based on the citizenship issue. The Courts are making themselves pretty clear that the issue is moot.

But it seems to me that this should be addressed at the State level and that a Secretary of State of any particular state should be allowed or perhaps required by State Law to satisfy himself that a candidate for a particular office meets the Constitutional Requirements of that office before that candidate’s name is placed on the State ballot.

We need to get the law changed in a few purplish red states before 2011 so that the Secreatary of State is required to keep Obama off the ballot if he does not produce satisfactory proof of eligibility.
