Is Healthcare a ‘Right’?


Healthcare cannot possibly be considered a right.

As we all know, the Senate is gearing up to begin the debate on Obamacare. As we move forward one of the first scheduled stops will be in the Senate on June 16 as the Health Education, Labor and Pensions Committee moves to begin its mark-up of the Health Care Reform Bill. But what are the basic assumptions that underlie this bill? Let’s take a look at one of them.

In a statement issued by Senator Edward M. Kennedy, Chairman of the HELP Committee, we see at least one assumption that is popular on the left, but one that should give pause to any liberty loving American. (See pdf file)

“The Council’s report emphasizes the major economic benefit to the nation that will also be
achieved if we make health care a basic right for all. In the current economic crisis, more and more families are being forced to leave their preferred doctors, forgo medication they need, or are even losing their health insurance entirely because their employer can no longer afford a health plan. We can’t afford to miss this chance to give the American people, at long last, the health care they deserve.”

Sure, it’s “compassionate” and all to say that healthcare is a “right.” But is it? Can it BE a right? And just what is a “right” anyway?

Simply defined, a right is something that an individual can exercise (as a sovereign individual) without asking anyone’s permission. It also carries the complementary notion that in exercising that right an individual cannot obligate anyone else to participate because to obligate others to act violates their own freedom of action (summarily eliminating their freedom to refuse to act, for instance).

So, how is health care a right? After all, to exercise the “right” to health care you are necessarily obligating a doctor or other health care professional to assist you with their time and training. Therefore to exercise health care as a “right” you are forcing other people to give you care. But, since your “right” to health care forces others to act on your behalf, you are basically violating their rights to refuse to participate.

Then we get to paying for it. If health care is a “right” then you are obligating government to pay for it and by obligating government to pay for it you are necessarily obligating taxpayers to pay for it, negating their right to refuse to participate.

This means that health care cannot be a right.

And this is just one of the many false assumptions that underlie the Democratic Party’s concepts of this health care debate. It is also just one more of the many reasons why conservatives and lovers of liberty and freedom should fight against it.

Finally, it is interesting to me that liberals that want socialized health care are obligating the taxpayers to pay for it, yet they use that same taxpayer’s obligation as a tool against other things. Liberals say, for instance, that schools should not be allowed to teach anything about religion because schools get federal money and taxpayers should not be forced to pay for any curriculum that might promulgate a religion they don’t agree with. On the other hand, liberals don’t want to give any taxpayers the option not to pay for someone else’s liposuction or transgendering operations. Ah, the pretzel logic of the left.

In the final analysis, healthcare just isn’t a right. By its very nature it cannot be. So, let’s stop saying it is.

Politicians and politicized bureaucrats are absolutely unable to resist pressure from constituent groups that want things covered, so whatever isn’t covered will be if the people who want it yell loudly enough.

Following the pretzel logic Warner talks about at the end of his article don’t people also have a right to feel good about themselves (if that’s possible for a liberal)? So if someone feels liposuction or a t-g procedure is necessary in order to “feel good” why wouldn’t state-run health care pay for it? Also older and terminally ill patients may get the short end of the stick under this health care plan in order to help fund such things. Oh wait, what about their right to health care??

Plastic surgery is covered only with accidents.

Plastic surgery SHOULD only be covered for accidents and I’m not entirely sure that I want to hear your diagnosis of “serious sexual defects.” Somehow I’d guess that would be any baby born with a penis.

You’ll remember Pelosi saying that it “reduces cost.” In other words, it decreases the number of people who will want health care. This is where liberals try to play fiscal conservatives. The same goes for euthanasia funding in Oregon. It’s funded by the state where cancer treatment is not.

Still, it seems to me Bill Gates, Ted Turner, and the Hewlett Packard heads alone probably fund enough “family planning” to cover everyone in the nation. Meanwhile it is top priority for the UN in third-world countries.

It’s also a means to keep their campaign $upport from Planned Parenthood and all their other interest groups.

I would agree that covering Viagra is no different from covering liposuction or a sex change. It keeps the politicians in power though.

By focusing on a few of you pet peeves (and in the process ignoring the issue behind the post: is healthcare a “right” or no), you stirred up a hornet’s nest.

Which is a shame since you don’t seem doing the usual parroting of leftist talking points, at least on certain points.

So here’s where to go if you actually want to contribute to the conversation at RedState rather than be a source of entertainment on a slow day:

1) When you’re new at RedState, you need to be on you best behavior. At this point, you’ll have to do even better because you’ve not exactly gotten off to a good start. In fact it’s been rather hideous.

2) Please keep to the topic at hand. Your comments about the content of health plans isn’t really germane to this post, but there have been other posts about healtcare where this issue is more germane. Make your comments there. Similarly, Global Warming Climate Change is a frequent topic here, and if you’re patient, you’ll find a post sooner of later. But this is not the thread for that.

3) Particularly when you’re new here, appearances are important. And we do tend to be a bit old-fashioned here at RedState in terms of wanting standard English grammar and coherent thoughts. That means a) using a spell-check to detect errors (plus a visual exam to look for homonyms and other errors that spell-check doesn’t pick up; b) writing in complete sentences; c) avoiding ad hominemss and animus, sticking with facts rather than ascribing motives to others here; d) coherent pargraphs and development of your arguments.

4) Check the site rules and site philosophy (advancing conservative and Republican goals) and follow them. You might want to peruse a number of posts and associated comments to get a handle as to what goes on here.

I may well be wasting my time with this comment, but if you’re serious about participating here, this is your recovery plan.

“Healthcare is a right” is a good slogan - maybe conservatives should use it.

And healthcare IS a right, just like gun ownership is a right. You have a right to healthcare, just like you have a right to own guns. You want a gun, get a job, save up your money, and go buy one. But the government doesn’t give everybody free guns and there’s no reason for the government to give everybody free healthcare … although, even without healthcare “reform” poor people can pretty much always get healthcare at a clinic, an emergency room, or through medicaid.

So healthcare is a right - and it’s a right all Americans have … RIGHT NOW. Do nothing and all Americans will still have a RIGHT TO HEALTCARE.

The problem is that Daschle wants to take the RIGHT TO HEALTHCARE away from the American people. They want to set up some system, force you to pay premiums or taxes or both to fund the mess, and then, when YOU get sick - well you better be young enough or valuable enough to qualify for treatment. Otherwise you’ll lose your RIGHT TO HEALTHCARE.

Government’s gotta fund all this healthcare, but the government’s gotta save money doing it. So if you’r e some old guy who needs a hip replacement - Tough. You won’t have a right to healthcare anymore and it’s not cost-effective to treat you cause you’re going to die soon anyway.

How many people want the health czar to determine whether they get medical treatment, just like the car czar determines which Chrysler dealers stay open?

Anyone who thinks that a government-run system is going to give them more options and free choice should stop in at the DMV some time and try to get a drivers llcense in a color other than the one specified by the state.

In your definition of a right, you have taken the side of natural liberty (”Liberty consists in the freedom to do everything which injures no one else, etc.”) whereas we proponents of health care reform have taken the side of civil liberty (”Liberty is not the right to do what one wants, but the right to do what one must.”). These interpretations will probably always keep us apart.

I can argue that whenever you exercise your right to limit health care to those who can afford it, you will obligate someone else to participate contrary to their rights. I truly believe that providing health care to all in the richest nation to ever exist is the morally right thing to do within the set of absolute morals. I am bound by my rights to provide it to those in need.

Other points: your health care is already controlled by non-medical “gatekeepers” and has been since the 1980’s. The difference in a government controlled gatekeeper situation is the lose of the profit motive. I have experienced health care overseas (Australia), with a pregnancy/birth, asthma control, emergency room visits and surgery. In every case it was as good as what I have experienced in the US. We do everything better than the rest of the world (both in government and in the private sector), I don’t doubt we would do national health care better than anywhere else in the world.

It comes down to what you can do versus what you ought to do. This country has a history of deciding laws and rights based on what is morally right. Health care should be a right for all American citizens.

First. there is NO POSITIVE MORALITY to nationalized healthcare. All you have to do is look at the real state of nationalized service across the world (not your anecdotal evidence) to see that it is anything but compassionate.

Second, The difference in a government gatekeeper and a private one is not the profit motive, It is the difference between a beuracracy that is a few steps removed from the feedback of it’s customers and one which is totally removed from the will of its customers.

As for your gratuitous assertions that it amounts to amoral view I could ask WHO THE HELL DIED AND MADE YOU GOD? What is the difference between you trying to push your morality on me and if I decide to try to use the laws to end all abortion, or anything else/

I am sure your feedback to your health-care provider has been well-received and incorporated into operating practices and pricing determinations. I can vote out the people in government to make changes to policy. I can switch health-care providers but usual and customary fees rarely change across providers.

Listen you little lightweight. I am just waiting for your analysis on those numbers you provided. 80 years Canada, come on where did you get those from Dailykos or some other special interest group? You need to examine the numbers and the methods for determining those. Mathematicians and statisticians usually do a little more analysis then I have seen in the comparison of life expectancies using data from the UN or the country where the numbers originated.

Also, I expect you to do a full accounting of the medical treatements done by those countries, that is what medications do they use and equipment do they buy for their diagnosis and treatment of disease. Plus I ask that you do a populatoin analysis to make sure that you are calculating apples and oranges. U.S. 300+ million people, Canada <<<300 million people. Please while you are quoting numbers I want the breakdown on how many Canadians come across the border for treatment for cancers and heart disease or any other life threatening conditions; if in a country of 20 million people if only 500,000 come across and recieve treatment that pretty much messes up the comparison. Also how many medicines are given to Canadians at dirt cheap prices only because Americans foot the bill to pay back the pharma companies for their R&D?

Lastly, tell me the last cure that was discovered and produced by the Federal Government or any health system run by the United States?

Is it your position that the CDC provides no benefit and has not assisted in the cause detection and vectors studies that ultimately led to the cure or vaccinations for countless illnesses? How many cases of malaria in the US occur each year? Maybe you should check out their website.

My grandparents and parents are dead, so no worry there for you. My sister is a psychiatric charge nurse, so just don’t go crazy in NY State and you should be fine.

My point from the start is that the use of individual liberty to prove that health care is not a right whereas civil liberty can show that it is a right is the basis for the continued arguments between the right and the left. Your side has used the individual liberties argument for the past 30 years. The result is the economy where it is at, health care where it is, housing where it is at. Too many in this country fail the old experimental method and they fail to understand that it is innocent until proven guilty not the other way around.

For our friend above, the scientific method is to come up with a hypothesis then prove your hypothesis to be right through experimentation or analysis. If in one case, argument or experiment the hypothesis fails then you hypothesis is wrong. Unfortunately, I think he missed out on that class in the public school system. I just hope he is able to complete his analysis of the numbers because we have gone through this drill back in December about the life expectancy argument. After my research into those numbers I could find no way to correlate countries from the data. The problem was complex and each countries life expectancy was done differently and the criteria used by the United States was much more strict. Plus the sample numbers between the U.S. and the other countries in the “study” were very diverging and no statistical or probablistic not to mention confidence intervals were brought to forefront. Comparing a country that has 80 years w/ 20M people to a country that has 77 with 300M people doesn;t take that much error in both to equate them. Not to mention all of the other factors that make it difficult to connect the two.

I don’t know where he got his numbers from, or if they are accurate. They might be accurate, considering we are footing the bill for 40 million illegal aliens. That type of thing can be pretty expensive. Either way, I would be interested in seeing his source. I just took some contention to his argument of “You don’t like my numbers, prove them wrong. I like them. I found them. What do you have? ” Seems like an immature form of argument to me. I know I don’t comment or post often, but this seemed to need challenged. I am still waiting for your analysis of the numbers. I want to see data sources and how exactly those numbers were calculated. Then I would like you to answer my questions that were in the previous comments. Now I expect you not to answer these questions because no one to date has successfully been able to draw comparisons on Government health care to the American system because single payer health care around the world is heavily dependent on the American innovations in the private industry. So please stop on back when you have the information to prove your points rather than anecdotal evidence and wikipedia information. My guess you will need a PhD in this subject before you can successfully be capable of analyzing the implications of the failure of the private health care sector in the U.S.A caused by the U.S. monopoly of the health care sector.

You really need to examine how private health care insurance works then tell me how the effect that a collapse of the private insurance sector will have on the U.S. economy. If your answer does not include a catastrophe then you have no idea how the private health insurance companies get the money to pay for your health care. They just do not pull out money from your monthly premiums to cover your costs nor does solely pooling your money with everyone else cover the cost. So, how does a private insurance company raise the capital to pay for your expensive procedures? Answer this question and you will know what happens when you destroy the private health insurance market.

Lastly, do not think for one moment that the problem is solved with public health insurance the prices will still be astronomic because health care reform still has yet to address Tort reform; therefore, I refuse to be a party of the many lawsuits that the Government will be involved in to cover all the lawsuits. News to you that the Government lawyers are not very good compared to their trial lawyer counterparts, the Gov just does not pay very well.

OK, now that I have given you some thoughts on the additional effects caused by your One Step thought process. Consider the implications of what you want in the long term once you figure out that the private health insurance companies produce capital and medical professional jobs in our economy. Remember, there is much to know and I do not even know every aspect by the linear representation you provided does not occur. The law of unintended consequences I assure you has not gone away with Zerobama.

Why is it then that a relatively small group (when compared to nationaized healthcare) of 8 million veterans have complained for years about their inadequate treatment at the hands of your U.S Department of Veterans Affairs health care program, sponsored and run by the U.S. government?:

Furthermore, nationalized healthcare is really frighteningly bad in most parts of the world. And that seems to be a function of how long it has been in place. Nations which only nationalized twenty years ago have problems with waiting lists for important operations and a lack of doctors,

But places that nationalized forty or more years ago, Like Britain are in near collapse, Look at the state of Britain’s system, do some homework, don’t be a brainwashed fool. The healthcare costs in Europe are bankrupting them faster than ours are bankrupting us.

Someone’s got to pay for it, either directly, through tax money, or insurance premiums.

I find it really scary that a health czar could be appointed who would decide whether or not you are worthy to receive healthcare.

Agree that the current health insurance system isn’t perfect, but maintaining a tension/competition between various companies strikes me as safer than concentrating all power in the hands of the government.

Other countries, to some extent, benefit from the health research conducted here - they get the medicines and techniques but often to pay the same average toward supporting development costs. Other posters have noted that to some extent America is subsidizing Canadian healthcare by treating Canadians in American hospitals.

Liberty is not the right to do what one wants, but the right to do what one must.

I’m curious - exactly who gets to decide what I “must” do? If it’s me, then the difference between the two definitions becomes one of minor semantics (what I “want” to do versus what I feel I “must” do).

However, I suspect that in your worldview, what the individual “must” do is defined by the collective, most likely in the form of some sort of government entity. If that’s the case, then your statement is the sort of Orwellian doublespeek deines liberty as opression.

All American citizens have a Right to healthcare. That would be “all persons BORN or naturalized” according to the 14th Amendment. Read the Constitution - there’s no exception if your momma didn’t want you and you got born during an unsuccessful attempt at an abortion - doesn’t matter. You’re born, you got rights - including a right to healthcare. Except, President Obama doesn’t think you’ve really got a right to healthcare - he’s voted against a right to healthcare for newborn infants on numerous occasions.

Maybe Barrack Obama isn’t the best person to devise a plan to guarrantee healthcare for everyone. His plan might come with a hidden slogan “Life Unworthy of Healthcare”. Seems like another slogan I heard about a few years back - “Lebensunwertes Leben” - which doesn’t translate exactly the same, but it’s close.

Somehow, I just don’t trust the Democrat Party to come up with a program that guarrantees Americans their right to healthcare.

Republicans can be trusted more on this issue. But healthcare is more than rights. It’s also responsibilities - if you want healthcare, you gotta pay for it. So get a job, earn some money, pay your doctor and/or your health insurance company.

Remember, there’s no such thing as a free lunch, so there’s certainly no such thing as free surgery. But you certainly don’t need a health czar telling you whether you’re worthy of healthcare like that car czar is telling Chrysler dealers whether or not they’re worthy to sell cars.

Seems to me that any government-run “charity” has the same moral problem; as soon as the government starts handing out money, goods, or services to those that it deems more deserving, it does so by taking the equivalent wealth from those it deems are less deserving.

I’ve never been able to figure out where the constitution grants the government the power to determine that one man deserves the fruit of someone else’s labor.
