I don’t see enough republican engagement (on T.V.) invalidating the problems with this existing legislation. From what is in the bill to why it needs to be passed NOW as is. The Republicans should be out front and center with the rational for real cost containment and as to the benefits with a piece meal approach to this problem. Keep Rep. Ryan,s Ideas out front as the alternative to smoke and mirrors. His idea’s are well thought out and ring true to a rational American.

The Greatest Generation
I have been watching the recent clips about college students demanding no cuts in education and protesting in California shutting down interstate highways. There seems to be a feeling of entitlement among these gentlemen and ladies. These people without a second thought have no problem stealing another’s wealth abrogating personal property rights concentrating power in Washington.. With forty years of socialism and increasing government failures we may have to ask the greatest generation for one more act. You see the greatest generation spoke commonsense and understood truth. There are many in the country that are still able to hear and understand rational argument. As a common sense baby boomer I learned from your generation and understood why this country is great.
What the left does not understand is the American philosophy does not have a problem with health care reform. The problem is who will be in control (look at the new bureaucratic creations in this bill) the country knows where that will lead and they reject it. It is not only rejected from a implementational standpoint but from a philosophical one. So I would humbly ask the Greatest Generation for one more act to secure America. Look guys you may be to intelligent to understand what moves economies. In case you are I have some recommendations for all the administrations experts and czars. We are hiring (all the experts welcome) lets hold hands and sing we are the world. Here is where you can help. (UNLESS YOU NEED TO BE IN CHARGE FOR SOME REASON)
1. Health care. We need people to empty the bed pans and wash individuals who cannot take care of themselves. Pay 10 dollars an hour.
2. Cap and trade. The world is melting so we need people (including CEO’s of the major corporations who support this junk science) to go around and make sure that the methane gas released from cows and humans does not exceed the new EPA limits. This may be hazardous to your health so we will Pay 11 dollars an hour.
3. The deficit. We need people than can look beyond the next election for the good of the American people. Must be intelligent, a good grasp of history that refutes a centralized approach to the economy and a deep understanding that can only recognize the freedom of the individual as the only architect to an entrepreneurial spirit. Pay: what the free market will bear and the knowledge that no one holds a mortgage on you and your children’s future.
Past generations have surmounted much larger mountains than this This generation can do the same.

1. THE DEFICIT IS THE PROBLEM. Before this can happen the federal government must reduce their own reach and power. They must prove to the American people that they can reduce spending and the micro management of the economy before the American people can get behind any serious deficit reduction.
2. For a ten year period (so business can plan) abolish the corporate income tax.
3. Drop current health care and cap and trade bills so business can plan. Allow the free market to open health care to true competition across state lines, incorporate private accounts and true tort reform.
4. Look into VOLUNTARY forfeiture of social security benefits for well off individuals that in turn may receive an estate tax benefit.
5. Reduce the power concentrated in Washington. Move that power out to the local and state area’s where it is best checked.
6. A complete halt to new government hiring and spending on new programs without equal budgetary offsets.
7. In all aspects congress must live by the very laws they create. You are public servants.
James Madison wrote. “The house of representatives can make no law which will not have its full operation on themselves and their friends, as well as the great mass of society. This (circumstance) has always been deemed one of the strongest bonds by which human policy can connect the rulers and the people together. 8. A restriction of all relatives or married partners benefiting in any law being enacted by members. This keeps the axiom of “In the countries best interest “vigilant.
9. Free and open (public airway sponsored) televised debates. So a progression of ideas can be examined and deliberated among the citizenry.
10. Everybody that works in the United States pays a flat tax. All will have a stake in the size and intrusiveness of government while cutting out congressional shenanigans through special tax laws.
11. All legislation in front of congress should be transparent and visible (not accessible two hours before the vote). Prohibit the use of non vetted attachments.
Congress must start to understand that the American people are not used to such a level of intrusion. The socialist mindset says over time that all people can be controlled but again history does not bare this out. Everything is monitored or mandated without regard to the constitutionality of the law. Instead it favors the narrow interests of a GE or a Pfizer. e.g. The latest eminent domain case where Pfizer would benefit from the taking of private property so they could build condo’s in New London Ct.at the top of the market. Congress you need courage there is only one to blame and that is you.
I see more and more members of congress retiring. This maybe do to the revulsion of the current and past congressional management that promote such un- American procedures.. I would say the American people are also disgusted. It is not too late to show some backbone and do what is best for America.
What congressional members do not understand is that we do not send you to Washington to create havoc. We expect you to manage (from a constitutional basis) what is in the best interest of the country. You seem to have no idea how you look to your countrymen. It is very simple be an American.

Citizens United v. Federal Election Commission. The hoopla over 1st amendment rights are upheld. Great ruling the opposite would have been a huge leap towards communism. I think the real argument going forward is the education of the populace. Who the hell is advising the president.? All corporate fees are passed on to the consumer. That is why the statist corporations like PFE, GE and the rest know this health care bill will not come out of the corporations bottom line. I understand that these bailouts were wrong (except financial only because they were allowed to work on the American taxpayers dime so we owe it). This is what happens when you have a relationship between the government and corporations. Governments proper function is to level the playing field by uniform laws not pick winners and losers. This is what the marriage of corporations and government have wrought as they try to move away from free enterprise capitalism. The fear or deliberate planning of loss in competitiveness in the new global economy left U.S. big business running to the government for security and monopoly power. The politicians mouths watered as control was placed in Washington’s hands.
This has been the view and direction that this country has attempted while we still had a prosperous middle-class. We all see the result. It is not capitalism that has failed it has been a government who’s interest has been aligned with interest’s that do not benefit this country. I still watch the benevolent interest Americans exert, as to the disastrous problems in Haiti. Fellow Americans we know in our hearts what is moral and correct. It is liberalism that is failing look at the new legislation its force and extortion committed on the American people. Liberalism needs to constantly come back for new sources of revenue. Was it Maggie Thatcher who said socialism is great until the money runs out.? It must be that congress is so afraid of an economic collapse due to their decades of spending that they look to heath care and cap and trade as the new piggy bank. The new fees and taxes that will breath life into the federal government maintaining the status quo.
History dictates a different story, they will spend this new money on other projects to hide their tracks. The new taxes and fees will fund an expansion of government. What the politicians do not realize is a new structure of fiscal discipline will not only save their jobs but correct the path this country is on. 1. Stop this ridiculous heath care bill NOW. This will show the American people two things. First that sanity has returned to Washington and that our government will start to regain fiscal discipline.
2. We begin to take a different approach to the world. Stop nation building. Let large American companies handle their own markets hell the American taxpayer is asked to pay off some dictator in sub Sahara Africa to open his country’s market to GE or ADM.

Another Sneaky Amendment
Wall Street Journal article at last minuet a provision is snuck into the bill to require small construction companies to provide insurance for companies with as few as 5 employees. The bill was introduced by Senator Jeff Merkley D Ore. Is it just me or could that provision be a way for illegal immigrants who make up a good portion of construction jobs able to receive health benefits.? Is this move to buy votes in the house.? Even Howard Dean admits this bill will not bring down costs as currently written. This bill will be a political nightmare. Take out a pen America and write down 3 things.
What does your insurance costs today.?

This legislation is criminal. Congress not only are you breaking senate rules to pass this thing but are incontrovertibly shaking the roots of our civilized society with the largest encroachment of government interference in American history. Your action is forcing citizens to loose faith in the institutions that have made this country great. The fault lies directly at the feet of the legislative branch. Congress could have worked in a commonsense fashion to tackle the problem starting with defensive medicine and fraud and abuse in the system while instituting a safety net. 3) A third major consequence of implementing a right to health care is the increased burden imposed on consumers of health care—the ones who were originally not in need of government subsidies. As taxpayers, of course, they have to pay for all the programs; that’s point 1. But as consumers, they are also affected by all the distortions of the market which these programs create. Everyone pays the higher prices caused by the inflation of demand for medical services, together with the increased costs of regulation and paperwork. As people are priced out of the system, they are forced into managed care systems that limit their choices of doctors.
4) Yet another consequence is a growing demand for equality in health care. If something is a human right, after all, then it should be protected equally for all persons. Our system is based on the idea of equality before the law. Now if we plug into this system the additional idea that we all have a legal right to some good like health care, the natural inference is that we all ought to receive that good on a more or less equal footing.
5) The fifth consequence–the last one I’ll mention–is the collectivization of health care, and of health itself. Just as a mixed economy treats wealth as a collective asset, which the government is free to dispose of as it sees fit for “the common good,” so a collectivized health care system treats the health of its members as a collective asset. Under this regime, physicians no longer work for their patients, with the overriding responsibility to act in their interests. Instead, physicians are agents of “society” who must decide the amount and the kind of care they give an individual patient by reference to social needs, such as the need to control costs in the system as a whole. Indeed, even the individual in such a system is urged to protect his own health not because it is in his self-interest, but because he has a responsibility to society not to impose too many costs on it.
To summarize, then, a political system that tries to implement a right to health care will necessarily involve: forced transfers of wealth to pay for programs, loss of freedom for health care providers, higher prices and more restricted access by all consumers, a trend toward egalitarianism, and the collectivization of health care. These consequences are not accidental. They follow necessarily from the nature of the alleged right.
The long-term direction of public policy is not set by electoral politics, or by horse-trading in Congress, or by this or that court case. In the long term, at a basic level, public policy is set by ideas—ideas about things are just and worthy, what rights and obligations we have as individuals. The idea that people have a right to health care is inimical to our genuine liberties. The policies that flow from that idea are harmful to the interests of doctors and patients alike. To fight against those policies, we have to attack their root.1) To begin with, of course, the government has to tax some people to pay for medical subsidies offered to those it considers to be in need. So the first consequence of implementing a “right” to medical care is forced transfers of wealth from taxpayers to the clientele of programs like Medicare and Medicaid. And this will inflate the demand for health care services. Offering free or heavily subsidized care is inevitably going to increase overall use of the health care system.
It is also worth noting that the Supreme Court has never recognized a constitutional basis for any welfare right, including the right to medical care. The Court recognizes that the concept of rights embodied in our legal system is the concept of liberty rights. Welfare rights are a product of later movements to expand the role of government beyond the original conception of its role. In our constitutional system, there is no requirement that the federal government provide health care. Health care entitlements, unlike fundamental rights like freedom of speech, have to be invented by legislators.”

It is akin to the right to due process of law, but in particular applies to equal treatment as an element of fundamental fairness. The most famous case on the subject is Brown v. Board of Education of Topeka (1954) in which Chief Justice Earl Warren, for a unanimous Supreme Court, ruled that “separate but equal” educational facilities for blacks were inherently unequal and unconstitutional since the segregated school system did not give all students equal rights under the law. It will also apply to other inequalities such as differentials in pay for the same work or unequal taxation. The principle is stated in the 14th Amendment to the Constitution: “No State shall…deny to any person within its jurisdiction the equal protection of the laws.”
Does the benefit Nebraska citizens receive in this legislation violate the rights of citizens in other states.?
The Allgeyer case concerned a Louisiana law that proscribed the entry into certain contracts with insurance firms in other states. The Court found that the law unfairly abridged the right to enter into lawful contracts, as guaranteed by the Due Process Clause of the Fourteenth Amendment.
In Allgeyer and Lochner and in other cases like them, the Court did not find that state legislatures had failed to enact their laws using the proper procedures—which would present an issue of procedural due process. Instead, it found that the laws themselves violated certain economic freedoms that inhered in the Due Process Clause, specifically its protection of liberty and what the Court described as freedom or liberty of contract. This freedom meant that individuals had the right to purchase or to sell labor or products without unreasonable interference by the government.
Is this forced purchase of insurance constitutional. ?
The phrase “procedural due process” refers to the aspects of the Due Process Clause that apply to the procedure of arresting and trying persons who have been accused of crimes and to any other government action that deprives an individual of life, liberty, or property. Procedural due process limits the exercise of power by the state and federal governments by requiring that they follow certain procedures in criminal and civil matters. In cases where an individual has claimed a violation of due process rights, courts must determine whether a citizen is being deprived of “life, liberty, or property,” and what procedural protections are “due” to that individual.
Procedural due process also protects individuals from government actions in the civil, as opposed to criminal, sphere. These protections have been extended to include not only land and personal property, but also entitlements, including government-provided benefits, licenses, and positions. Thus, for example, the Court has ruled that the federal government must hold hearings before terminating Welfare benefits (Goldberg v. Kelly, 397 U.S. 254, 90 S. Ct. 1011, 25 L. Ed. 2d 287 [1970]). Court decisions regarding procedural due process have exerted a great deal of influence over government procedures in prisons, schools, Social Security, civil suits, and public employment.
Enumerated Powers
Nelson Lund a professor at Virginia law school has remarked that since 1791 ” Congress has never approved a constitutional amendment that decreased its own power in any significant way. indeed, since the bill of rights was adopted, Congress has not even approved any amendments - with the possible exception of the 21st amendment- that reinforced the original plan for a federal legislature that of limited and enumerated powers.”
The enumerated powers are a list of specific responsibilities found in Article 1 Section 8 of the Constitution, which iterates the authority granted to the Congress may exercise only those powers that are granted to it by the Constitution, limited by the Bill of Rights and other protections found in the Constitution.
Congress can you hear America yet ? YOU ARE OUT OF CONTROL. Even the Senate where cooler heads should prevail have lost it. Look at your actions as to the rules and procedures and back room deals. What this administration and congress have shown the American people is that you are incapable of rational leadership. As a group you march like zombies following the president without regard for legislative quality only the end result. Look at yourselves , the third Saturday working with staff and a vote on the eve of Christmas. All due to an arbitrary date dictated by the president. In other words only a few days to read what is in the bill. I can only say how un- American this looks.
This current legislation is full of spending gimmicks which alone should prompt a no vote. The expansion of government bureaucracy limiting choice and freedom is enough for any American congressman to vote no. Forcing the young to purchase health insurance or face jail time is another reason to vote no. Scrap this current bill and work in a bipartisan fashion and fix what is wrong. This is nothing but a government take over of the best health care system in the world. Which is why the far left caves in. With this legislation the left has begun the process of considerable intrusion into the lives of free Americans.
Law suites will fly if this monstrosity passes leading to an eventual overturn on constitutional grounds. The left is truly overreaching. The language reads as a straight jacket on individual freedom and choice.This is bad legislation not only because of what is in the bill but the way it has been handled. Both the president and the democrats in rushing this bill are acting like children not mature individuals doing what is in the best interest of the country.
The only venue left for the citizenry of the country is to reduce the concentration of power in Washington and migrate said power back to the states maintaining the Republic. There needs to be a new debate as to the extent of congressional authority under the constitution. Increasingly, (with the lack of an intelligent argument for both health care and cap and trade) the President and Congress are being viewed as drama queens (EVERYTHING IS AN EMERGENCY) embarrassing the American people on a world stage.
You have too much power when every special interest has to run to the federal government for their economic survivability. Would not it be more productive if you could concentrate on the best interest of the country as a whole instead of petty agendas. That means Congress legislates to reduce its own reach. Go back to the Constitutional powers that are listed not what you think you control and have taken. Health care is not a RIGHT it is a good a service.

The Enumerated Powers Act, introduced by Congressman John Shadegg is a proposed law that would require all bills introduced in the U.S. Congress to include a statement setting forth the specific constitutional authority under which the law is being enacted. The pendulum has moved way to far to the left maybe it is time to discuss the reach congress has usurped over the years limiting the freedom of the American people.

Global warming: The media has spent at least a decade conditioning the young on the catastrophic effects of global warming. The US president in Copenhagen calls again for ACTION NOW ! WE CANT WAIT !. What is it with the democrats, the American people see the chicanery in this. A rational discussion might begin with the SCIENCE that is in question. I am a little suspect to the unintended or intended consequences of such legislation. Here are some questions that should be answered.
Was it the governments plan colluding with the S & P 50 largest corporations to create a fallacious market with makeshift jobs born out of junk science.?
Was this a scam to extract more taxes from American citizens to prop up the out of control spending coming out of Washington?
Was this a way of offering the framework for one world government by increasing regulation across sovereign country’s borders.?
Just some of the questions to be answered . Where does this leave us, our government and media just disregard the American people and forge ahead.
