Another Sneaky Amendment


Wall Street Journal article at last minuet a provision is snuck into the bill to require small construction companies to provide insurance for companies with as few as 5 employees. The bill was introduced by Senator Jeff Merkley D Ore. Is it just me or could that provision be a way for illegal immigrants who make up a good portion of construction jobs able to receive health benefits.? Is this move to buy votes in the house.? Even Howard Dean admits this bill will not bring down costs as currently written. This bill will be a political nightmare. Take out a pen America and write down 3 things.

What does your insurance costs today.?

Are decisions regarding your health unencumbered by Washington.?

Has this bill brought down the deficit.?

I would like to see the answers after 1 year of the government providing health care services.

This legislation is criminal. Congress not only are you breaking senate rules to pass this thing but are incontrovertibly shaking the roots of our civilized society with the largest encroachment of government interference in American history. Your action is forcing citizens to loose faith in the institutions that have made this country great. The fault lies directly at the feet of the legislative branch. Congress could have worked in a commonsense fashion to tackle the problem starting with defensive medicine and fraud and abuse in the system while instituting a safety net. Instead you regulate and impose false economic mandates distorting the marketplace. Like Fannie and Fredie Mac you creat a huge mess, never take responsibility then throw more money at the problem. Eventually private industry must come in and clean up the mess.


THE RIGHT TO HEALTH CARE and its effects.


Thomas Paine (1731–1809) further elaborated on natural rights in his influential work Rights of Man (1791), emphasizing that rights cannot be granted by any charter because this would legally imply they can also be revoked and under such circumstances they would be reduced to privileges:

It is a perversion of terms to say that a charter gives rights. It operates by a contrary effect — that of taking rights away. Rights are inherently in all the inhabitants; but charters, by annulling those rights, in the majority, leave the right, by exclusion, in the hands of a few. … They…consequently are instruments of injustice.

“Let’s begin by defining our terms. A right is a principle that specifies something which an individual should be free to have or do. A right is an entitlement, something you possess free and clear, something you can exercise without asking anyone else’s permission. Because it is an entitlement, not a privilege or favor, we do not owe anyone else any gratitude for their recognition of our rights.”

“1) To begin with, of course, the government has to tax some people to pay for medical subsidies offered to those it considers to be in need. As taxpayers, of course, they have to pay for all the programs; that’s point 1. But as consumers, they are also affected by all the distortions of the market which these programs create. Everyone pays the higher prices caused by the inflation of demand for medical services, together with the increased costs of regulation and paperwork. As people are priced out of the system, they are forced into managed care systems that limit their choices of doctors.

4) Yet another consequence is a growing demand for equality in health care. If something is a human right, after all, then it should be protected equally for all persons. Our system is based on the idea of equality before the law. Now if we plug into this system the additional idea that we all have a legal right to some good like health care, the natural inference is that we all ought to receive that good on a more or less equal footing.

5) The fifth consequence–the last one I’ll mention–is the collectivization of health care, and of health itself. Just as a mixed economy treats wealth as a collective asset, which the government is free to dispose of as it sees fit for “the common good,” so a collectivized health care system treats the health of its members as a collective asset. Under this regime, physicians no longer work for their patients, with the overriding responsibility to act in their interests. Instead, physicians are agents of “society” who must decide the amount and the kind of care they give an individual patient by reference to social needs, such as the need to control costs in the system as a whole. Indeed, even the individual in such a system is urged to protect his own health not because it is in his self-interest, but because he has a responsibility to society not to impose too many costs on it.

To summarize, then, a political system that tries to implement a right to health care will necessarily involve: forced transfers of wealth to pay for programs, loss of freedom for health care providers, higher prices and more restricted access by all consumers, a trend toward egalitarianism, and the collectivization of health care. These consequences are not accidental. They follow necessarily from the nature of the alleged right.

The long-term direction of public policy is not set by electoral politics, or by horse-trading in Congress, or by this or that court case. In the long term, at a basic level, public policy is set by ideas—ideas about things are just and worthy, what rights and obligations we have as individuals. The idea that people have a right to health care is inimical to our genuine liberties. The policies that flow from that idea are harmful to the interests of doctors and patients alike. In our constitutional system, there is no requirement that the federal government provide health care. Health care entitlements, unlike fundamental rights like freedom of speech, have to be invented by legislators.”

n. the right of all persons to have the same access to the law and courts and to be treated equally by the law and courts, both in procedures and in the substance of the law. It is akin to the right to due process of law, but in particular applies to equal treatment as an element of fundamental fairness. The most famous case on the subject is Brown v. Board of Education of Topeka (1954) in which Chief Justice Earl Warren, for a unanimous Supreme Court, ruled that “separate but equal” educational facilities for blacks were inherently unequal and unconstitutional since the segregated school system did not give all students equal rights under the law. It will also apply to other inequalities such as differentials in pay for the same work or unequal taxation. The principle is stated in the 14th Amendment to the Constitution: “No State shall…deny to any person within its jurisdiction the equal protection of the laws.”

Does the benefit Nebraska citizens receive in this legislation violate the rights of citizens in other states.?

The Allgeyer case concerned a Louisiana law that proscribed the entry into certain contracts with insurance firms in other states. The Court found that the law unfairly abridged the right to enter into lawful contracts, as guaranteed by the Due Process Clause of the Fourteenth Amendment.

In Allgeyer and Lochner and in other cases like them, the Court did not find that state legislatures had failed to enact their laws using the proper procedures—which would present an issue of procedural due process. Instead, it found that the laws themselves violated certain economic freedoms that inhered in the Due Process Clause, specifically its protection of liberty and what the Court described as freedom or liberty of contract. This freedom meant that individuals had the right to purchase or to sell labor or products without unreasonable interference by the government.

Is this forced purchase of insurance constitutional. ?

The phrase “procedural due process” refers to the aspects of the Due Process Clause that apply to the procedure of arresting and trying persons who have been accused of crimes and to any other government action that deprives an individual of life, liberty, or property. Procedural due process limits the exercise of power by the state and federal governments by requiring that they follow certain procedures in criminal and civil matters. In cases where an individual has claimed a violation of due process rights, courts must determine whether a citizen is being deprived of “life, liberty, or property,” and what procedural protections are “due” to that individual.

Procedural due process also protects individuals from government actions in the civil, as opposed to criminal, sphere. These protections have been extended to include not only land and personal property, but also entitlements, including government-provided benefits, licenses, and positions. Thus, for example, the Court has ruled that the federal government must hold hearings before terminating Welfare benefits (Goldberg v. Kelly, 397 U.S. 254, 90 S. Ct. 1011, 25 L. Ed. 2d 287 [1970]). Court decisions regarding procedural due process have exerted a great deal of influence over government procedures in prisons, schools, Social Security, civil suits, and public employment.


Enumerated Powers


Nelson Lund a professor at Virginia law school has remarked that since 1791 ” Congress has never approved a constitutional amendment that decreased its own power in any significant way. indeed, since the bill of rights was adopted, Congress has not even approved any amendments – with the possible exception of the 21st amendment- that reinforced the original plan for a federal legislature that of limited and enumerated powers.”

The enumerated powers are a list of specific responsibilities found in Article 1 Section 8 of the Constitution, which iterates the authority granted to the Congress may exercise only those powers that are granted to it by the Constitution, limited by the Bill of Rights and other protections found in the Constitution.

Congress can you hear America yet ? YOU ARE OUT OF CONTROL. Even the Senate where cooler heads should prevail have lost it. Look at your actions as to the rules and procedures and back room deals. What this administration and congress have shown the American people is that you are incapable of rational leadership. As a group you march like zombies following the president without regard for legislative quality only the end result. Look at yourselves , the third Saturday working with staff and a vote on the eve of Christmas. All due to an arbitrary date dictated by the president. In other words only a few days to read what is in the bill. I can only say how un- American this looks.

This current legislation is full of spending gimmicks which alone should prompt a no vote. The expansion of government bureaucracy limiting choice and freedom is enough for any American congressman to vote no. Forcing the young to purchase health insurance or face jail time is another reason to vote no. Scrap this current bill and work in a bipartisan fashion and fix what is wrong. This is nothing but a government take over of the best health care system in the world. Which is why the far left caves in. With this legislation the left has begun the process of considerable intrusion into the lives of free Americans.

Law suites will fly if this monstrosity passes leading to an eventual overturn on constitutional grounds. The left is truly overreaching. The language reads as a straight jacket on individual freedom and choice.This is bad legislation not only because of what is in the bill but the way it has been handled. Both the president and the democrats in rushing this bill are acting like children not mature individuals doing what is in the best interest of the country.

The only venue left for the citizenry of the country is to reduce the concentration of power in Washington and migrate said power back to the states maintaining the Republic. There needs to be a new debate as to the extent of congressional authority under the constitution. Increasingly, (with the lack of an intelligent argument for both health care and cap and trade) the President and Congress are being viewed as drama queens (EVERYTHING IS AN EMERGENCY) embarrassing the American people on a world stage.

You have too much power when every special interest has to run to the federal government for their economic survivability. Would not it be more productive if you could concentrate on the best interest of the country as a whole instead of petty agendas. That means Congress legislates to reduce its own reach. Go back to the Constitutional powers that are listed not what you think you control and have taken. Health care is not a RIGHT it is a good a service.

The Enumerated Powers Act, introduced by Congressman John Shadegg is a proposed law that would require all bills introduced in the U.S. Congress to include a statement setting forth the specific constitutional authority under which the law is being enacted. The pendulum has moved way to far to the left maybe it is time to discuss the reach congress has usurped over the years limiting the freedom of the American people.

Global warming: The media has spent at least a decade conditioning the young on the catastrophic effects of global warming. The US president in Copenhagen calls again for ACTION NOW ! WE CANT WAIT !. What is it with the democrats, the American people see the chicanery in this. A rational discussion might begin with the SCIENCE that is in question. I am a little suspect to the unintended or intended consequences of such legislation. Here are some questions that should be answered.

Was it the governments plan colluding with the S & P 50 largest corporations to create a fallacious market with makeshift jobs born out of junk science.?

Was this a scam to extract more taxes from American citizens to prop up the out of control spending coming out of Washington?

Was this a way of offering the framework for one world government by increasing regulation across sovereign country’s borders.?

Just some of the questions to be answered . Where does this leave us, our government and media just disregard the American people and forge ahead.

Does not Washington see the loss of credibility on their part.?
Is congress so beholden to big business that they will move ahead on this global warming tax scheme regardless of the American peoples view.?

The funny thing about your philosophy being the redistribution of wealth also called CHANGE is that through market interference the result has been a concentration of wealth including your own CONGRESS !. I think all the news reporters should center in on the Senate as I write this. Sen Sanders Amendment is being read allowed on the floor as to the single payer. Senator Sanders has tried to dispense with the reading twice now but has been objected to by the Republicans which is usually allowed to be read. It is scary how involved the rules are in this amendment unless you like bureaucracy. So far it has been read for a half hour and still going. The press could have a field day with this as to the intrusion on American freedom this Administration is pushing with the democratic leadership.


Our Delirious Government


Congress look at yourselves, what are you after? There is no commonsense to what you are attempting to do. The nationalization of 1/6th of the US economy with mandates, jail time more expense and new bureaucracy is just stupid and asinine. The country is in recession this administration has no practical business experience, yet they cap private executive wages and raise their own. Do you know how this looks to the American people.?

When and if you really want to fix this you would start piecemeal with fraud and abuse. reduction of frivolous law suites and cross border insurance sales. With this lack of commonsense I can only surmise that your agenda is something different. It cab only be control. A top down central planned economy. That is socialism yes socialism and very unAmerican. Over the weekend senators make the point that social security is a government program would you give that back.? There is one difference, receiving a social security check does not open you up to government mandates that dictate my lifestyle as to diet exercise and mobility.

For any interested I was struck by a history channel program called “The People Speak”
I was taken by the star studded roll out staring Matt Damon and entourage. When they were done every malady in the world through history was the fault of American ideology.
I would suggest some of these new propagandists from Hollywood might like to look at history before America was a world power. Capitalism raised the standard of living in the world more than any known economic theory to date. Capitalism has lifted more individuals to freedom worldwide than any other economic philosophy. With the wealth you guy’s have accumulated in Hollywood through capitalism I wonder why your program was so anti-American. America donates worldwide Fy2009 about 130billion dollars in foreign aid. Socialism, What’s going on Washington?


Socialism, 1 : any of various economic and political theories advocating collective or governmental ownership and administration of the means of production and distribution of goods.

I ask the American people where are we headed?
The EPA uses a gun to the forehead of the American businessman employing methods to control our lives based on junk science and sanctioned by the supreme court. Is it getting scary yet?. Except for the big company’s that play ball and pay for protection behind the government red tape cementing their position in the marketplace. Some people call that corporatism. It sure as hell is not free enterprise capitalism. The problem is the transfer of economic power to Washington. I would even submit that these policies socialist champion have led to the concentration of wealth instead of the distribution of wealth. This is not the fault of free market capitalism but a grotesque form that rewards graft and parasitism by various CEO’s in bed with federal or state bureaucrats.

Congress is out of control. Both health care and cap and trade bills are bad legislation. The union between big business and congress has overstepped its bounds when the combination destroys individual freedom. When legislation reaches into the lives of the individual to such an extent that they no longer control their medical decisions or the imposition of heavy taxes based on made up out of thin air markets like cap and trade something has to change.

Instead of congress taking a commonsense approach you scare the hell out of senior citizens in this country. Then you draft legislation mandating the purchase of insurance or face imprisonment. This is an unconstitutional force on a free electorate.

What is your agenda.”? I can only surmise it is control and its name is socialism. You argue that social security had the same response. Social security is a safety net that did not reach into the lives of people dictating their actions. What you can eat, smoke, drink, the amount of exercise you have. You say that level of dictates are not in the bill. When has government ever not advocated control when they are in charge of the purse. You proved it with the banks, GM, and the recent report on mammograms.

Cap and trade will even be more intrusive. The administration as well as congress should admit your short comings and realize your limitations. Government is to political and inefficient. The decision process is to bureaucratic.

Before you institute something that will be reversed either by a new congress or the supreme court think about the effect on the country. The road this administration along with the democratic controlled congress is on will result in a cold exile. This exile may last longer than Moses and his followers wandering lost for 40 years. As the American people contemplate your threat to our liberty we will now re-educate the current and new generations to begin a rebirth as we re-acquaint ourselves as to the question: what does it means to be a free individual, an American.? Throw these legislative drafts away and start in a bipartisan fashion that targets the problem not enslaves a free people with a bureaucratic nightmare.

We as a nation have nothing to fear as long as we hold true to individual freedom. The lefts view is collectivism and control. There was a great old saying, Don’t piss down my neck and tell me it’s raining.

As I write this Joe Lieberman is on the band wagon for global warming legislation. Yes Joe GE is domiciled in Fairfield Ct. Will this be your reason to vote for democratic health care.? Do what is right for the country not narrow GE interest to supply funding for the next election. Jeff Immelt should seek real markets not government created markets. This legislation is a straight jacket to individual freedom. Senators and businessmen wonder why the American youth are disheartened. Look no further than your own actions.


I would still be cautious


I would not rest, this bill is not defeated yet at all.

The media even reports that there is a big split within the democratic party.
Although they always seems to come together when the vote comes.

I have never seen our government so out of control. Literally acting as irrational gangsters trying to convince a rational judge that there direction is true and for the good of the nation.

Have you noticed the trend from the administration aided by the media.?

1. Float a test balloon as to the legislation.
2. Leak a statement the legislation will not be brought up or it is dead.
3. Then miraculous the legislation revives itself from the  ground swell of supporters and they pass it.
4. You cant read it passage must be immediate and they vote on a Saturday when no one is watching..

There can be no other reason for the passage in the house and senate totally ignoring the wishes of the American people ( not for a cause that is enlightened born of natural rights) but one that is CONTROL that restricts choice and expands government placing our nation further into debt. I would only ask, without the parliamentary games, do you really believe this is the road freedom loving Americans will be able to live with.?

If this final bill passes with the mandatory purchase of insurance or face fines or jail time you open constitutional questions as well as possibly criminalizing 35 million people who choose not to purchase insurance. Your view of UTOPIA must be balanced, check your premises your road leads to unhappiness. If your goal is socialism and control, debate it openly. I don’t think you have conditioned the American psyche enough for slavery. If you think America is ready for that level of control your allegiance dances to a different tune?. Americans follow the rule of law that is honest and makes sense.

As free men and women the spot light is turned on you. We are starting to question the true motives of both congress and the administration.

Do what is right fix what is broken do not try to increase your reach look to inhibit your control.

Your goal should be to relax control not increase it. Trust the American entrepreneur not shackle the honest businessman. Lower taxes reduce control for a definite time frame so people can plan. You will be better Americans for a slow approach with a transparent debate.


Time to take stock


What the hell is going on ? President Obama, Director Summers and Treasury secretary Geithner,

In one years time the agenda you present is non productive, irrational and places the country further into debt.

1. The value of the dollar. Is your goal to weaken the dollar to pay off debt or a race to the bottom of currency devaluation before your neighbor devalues ? History negates the latter option.

2. Oil is $79 a barrel and gasoline is $3 a gallon.. We freed Iraq we are in a recession. Policy will not let us drill on our own land. Is your goal to force us to go GREEN through higher expenses.? Not a good idea for U.S. job creation.

3. The Democratic controlled congress continues to spend. The centralized economy approach has 300 years of history as being inefficient.  Are you afraid to let the American entrepreneur( with a level playing field ) compete.?

The policies you promote are job killers. Are you purposely trying to bring this nation into a depression with the idea that it would be easier to pass a socialist agenda.?

Move to the center you are out of control. People are becoming more distrustful of the government day by day.  We are a nation of laws let all Americans abide by them. Our voice is heard loudest on election day.

Everybody is looking towards government to put forth their agenda not through merit but by FORCE crafted in legislation. Americans are upset because we have lost the representation that was present when government was closer to home and rational. The federal government has literally corrupted our ability to forge our life without apprehension. This is accomplished by the constant drip of new regulation, restrictions and fear. Legislation is accompanied by slogans such as for your safety, do it for the children or the coming apocalypse of global warming.

The economy would be better off if control was relaxed from Washington.

A brief historical comment on the national debt.

A pamphleteer named Brutus in the 18th century warned against a centralized government’s power to borrow money.” borrow money on the credit of the United States . The Congress may mortgage any or all of the revenues of the union and may borrow of foreign nations a principle sum, the interest of which will be equal to the annual revenues the country. By this means, they may create a national debt so large as to exceed the ability of the country ever to sink. I can scarcely contemplate a greater calamity that could befall this country than to be loaded with a debt exceeding their ability to discharge. If this be a just remark, it is unwise and improvident to vest in the general government a power to borrow at discretion, without any limitation or restriction.”

Lets get down to real work.

Distrust plagues the economy. The federal government’s quest for control hampers the ability of knowledgeable people to move the economy forward. Individuals cannot plan when government has fostered an environment with autocratic laws and inconsistent rules. Large companies profit from this centralized approach with out true competition. The CEO’s of Wal-mart and GE have both backed the latest junk science coming out of Washington (current Heath care and Energy bills). They run to government and back every centralized plan being introduced without the spine to exercise commonsense and put the country first. Thankfully, so far small business is the largest employer of workers in the country.

If you need to pay Washington to open up a forieign economy then you don’t have free trade. Washington has either become a shill for special interests, drunk on power or completely out of touch with their constituency. If any of these scenarios are true the government has become ineffective and hazardous to individual rights as described in our founding documents.

This centralized approach of “one fits all” mandate is the crux of the problem. So I have to ask the American people what is the most amiable path to take. What offers the most freedom to the individual?. What system would be superior at keeping government in check?. The concentration of power has always led to atrocity even if it is congress instead of a dictator. Let us as Americans live up to our heritage and take the pressure off Washington. Let us alleviate the burden of narrow special interest so they can re-acquaint themselves on powers delegated to the federal government in the constitution.

Believe me Mr. President and Congress we can handle our own lives without the media induced fear or the top down management you exert. It is clear that power must revert back to state and local control. Americans can see that Washington is incompetent and meddlesome when it comes to the individual. This is where the modern political authoritarian must step back and check their premise as to their logic to force a free man or women that governments path is superior to their own. It is quite easy, constrain governments ambition to micro manage people and begin to look towards individual freedom as the goal, it is then our country will flourish again.

A total disrespect of the American people


We are told that congress will push through health care regardless of the public outcry over further debt passed on to our children. My god the president and congress act as though health care is a inalienable right. Does the congress along with the president fantasize that this is the Emancipation Proclamation number two. The difference is the defense of a Natural Right as opposed to a government produced entitlement. I would suggest congress and the president get out of fantasy land.

Mr President you are not Abraham Lincoln with a mandate. He worked to led the country to a higher calling based on individual freedom your crowd works to divide it for special interests and governmental control. He fought for natural rights you fight for the expansion of the welfare state enslaving all. Save your reputation and move to the center leave the socialist agenda it has never worked for long. You believe your mark in history will be “the man who brought health care to all” I would predict that you and the congressional members that support this travesty will be thrown out of office next election. History will say ” the day free Americans finally saw the enemy and threw out the seeds of socialism and that was the turning point to recapture our country and maintained our freedom”.

It’s really is up to you guy’s what you advocate works well in the cellars of Harvard or Washington. Historically centralized planning has never worked over time and has never worked for men who respect freedom and the individual. As free men and women we know that is not rational legislation. You see we would actually like to be left alone.

So Mr. president don’t over estimate your own importance. Recognize when you are wrong and become a great American president ( like Lincoln ) who freed the people not enslaved them with large governmental bureaucracy.

The economy


Today I watched the president of the United States take responsibility for the measures enacted last year that saved the economy. It was even backed up with Fed chairman Ben Bernanke commenting “the recession may have ended”. By the way I respect the Fed chairman and cannot begrudge the spin doctors partisan goal to structure the administrations message.

Something happened this past weekend that I think scared this administration. It was the American people. The spin doctors said get out there we have a problem !!!. So the President goes in front of spin doctor prescribed media events ( continuing through the weekend in friendly territory ). The unions applaud and show he is so enlightened that we should just follow him without question.

Obama administration you are the ones that need to wake up.

Move to the center you are out of control as Clinton probably told you in New York. Just be honest because people are becoming more distrustful of the Government. We are a nation of laws let all Americans abide by them. Our voice is heard loudest on election day.

Anyway enough of the fearful little media world on both sides.

The economy would be better off if control was relaxed from Washington.

If this be a just remark, it is unwise and improvident to vest in the general government a power to borrow at discretion, without any limitation or restriction.”

Lets get down to real work.

Distrust plagues the economy. The federal government’s quest for control hampers the ability of knowledgeable people to move the economy forward. Individuals cannot plan when government has fostered an environment with autocratic laws and inconsistent rules. Large companies profit from this centralized approach with out true competition. The CEO’s of Wal-mart and GE have both backed the latest junk science coming out of Washington (current Heath care and Energy bills). They run to government and back every centralized plan being introduced without the spine to exercise commonsense and put the country first. Thankfully, so far small business is the largest employer of workers in the country.

Now they include race as the problem on tonight’s news. My god it has only been 300 years of law and history that dispel central planned economies. We are a free people not to be subjugated by large intrusive government. That is what the spin doctors in the White house do not understand,

When government chooses to directly ignore the intent of the American people, discussion needs to take place with an option to check their power. The U.S. Constitution does not provide or authorize the recall of United States officers (senators and representatives of congress). Although it was considered, no provisions were made for such action. Recall in the Articles of Confederation was replaced with rotation in office during the convention in 1787. I see where the Supreme Court has nullified the argument under the 10th amendment clause although not commenting directly. The court interpretation asserts individual states never had the original sovereignty to unilaterally change the terms and conditions of service of federal officials agreed to and established in the Constitution. My understanding of the intent on the dispersion of power is that the constitution derives its authority from the states and the states from the people. This is the basis of our republican form of government and to be respected through fair elections and the RULE OF LAW.

It seems as though the agenda in Washington has not been in the best interest of the American people for the last 20 years. Washington has either become a shill for special interests, drunk on power or completely out of touch with their constituency. If any of these scenarios are true the government has become ineffective and hazardous to individual rights as described in our founding documents.

So it appears from various news services congress is going to ram this legislation down the American peoples throat. The same people congress works for. If this is truly the case we should look at constitutionally based alternatives. Options that hold public officials closer to the responsibility their office demands while promoting freedom not enslavement. Good legislation does not require force in most cases because it is not narrow in focus. I would suggest the states look into recall measures and begin the lawful process to incorporate these measures in their respective state constitutions. A super majority of the states population would be needed due to the importance of such procedures.

If commonsense were present this would not be necessary. Only when the Federal government becomes so detached does it becomes our responsibility and right to restrict their power.

That will maintain freedom.”

Which philosophy requires greater force liberal or conservative?. The original concept of liberalism was closer to the Whig party or libertarian view concerning the Individuals relationship with government. The modern characterization of liberal is to signify more of a centralized approach regarding the individual with concepts such as fairness or equity in human life. From an historical sense once government applies its power towards enforcing (rights equity in life) and not (inalienable rights) as described in the constitution we get off track.

We have a constitution that protects the minority from the majority through the rule of law. The rule of law has been distorted over time by government mandates passed without constitutional vetting as to the validity of such rules. The enactment of laws to correct monetary disparity in society can have the effect of killing off a desire for most people to improve there position based on individual initiative and rise in society. Current welfare and affirmative action policy have such an effect in two ways.

1. The young man or women that relies on government handout may never progress past the addiction of the welfare state.

2. It kills the ambition of the young fearing their hard work may be usurped by a panel that values racial or gender diversity over competence.

It is this injustice that divides a society having the effect of excepting irrationality and favoritism as the standard. This is not a democrat or republican phenomenon this has been going on for decades. The current administration and congress have become so out of touch with mainstream America that they are shocked over the outrage nationwide to recent and pending legislation. The politician with the help of the media had thought that after fifty years of T.V.the population (with only the last thirty years being more a propaganda machine than entertainment) was dumbed down enough to push this centralized approach down the American peoples throat.

The mistake we make as a society is to look towards the federal government to satisfy our perception of equality (unless natural rights are denied). Unless we get back to a level playing field we risk depression and socialism. The entrepreneurs can not work against administrative sanctions protecting favored industries or the arbitrary dictates of large government.

Everybody is looking towards government to put forth their agenda not through merit but by FORCE crafted in legislation. Americans are upset because we have lost the representation that was present when government was closer to home and rational. The federal government has literally corrupted our ability to forge our life without apprehension. This is accomplished by the constant drip of new regulation, restrictions and fear. Legislation is accompanied by slogans such as for your safety, do it for the children or the coming apocalypse of global warming.

This centralized approach of “one fits all” mandate is the crux of the problem. So I have to ask the American people what is the most amiable path to take. What offers the most freedom to the individual?. What system would be superior at keeping government in check?. The concentration of power has always led to atrocity even if it is congress instead of a dictator. Let us as Americans live up to our heritage and take the pressure off Washington. Let us alleviate the burden of narrow special interest so they can re-acquaint themselves on powers delegated to the federal government in the constitution. Believe me Mr. President and Congress we can handle our own lives without the media induced fear or the top down management you exert. It is clear that power must revert back to state and local control. Americans can see that Washington is incompetent and meddlesome when it comes to the individual. Cash For Clunkers


The cash for clunkers program is a wild eyed success, government did something right. I know the czars are from the great schools where these decisions must take five PHD’s and twenty years of research to complete. Then the unveiling of a brilliant nationwide strategy. One thing I don’t understand or hear about in the media or from the central planners in Washington is that the program was based on TAX CUTS. I guess that does not go with the CAPITALISM HAS FAILED CROWD.

The left are threatening to pass health care legislation in pieces (Wall Street Journal 8/20/09 New RX Health Plan: Split Bill). The strategy seems to use various parliamentary procedures to pass the health care agenda. One is reconciliation (simple majority needed) for other sections of the bill and filibuster proof majority (60 votes needed). As to what procedure congress would use for passage on the public option or exchanges is still unclear. It seems to me that congress is deliberately going to try and force a public plan without regard to the desires of the majority of free men and women in this country. There is only a mere 300 years of history including our own sacred documents that warn us against large intrusive government.

The 2010 Orchestration


This following will come as no surprise to many. The more I see the Left hang on to a government option I can’t help but think their true agenda is not health care but dependency on government. Therefore this is not a democrat verses republican argument but socialism verses freedom. There are many great (free market) plans out there. Most are executable with the relaxation of government mandates and the ability to cross sell insurance beyond state lines, in other words true competition. I challenge the government to back away. Not favor the large insurance companies over small entrepreneurs and let a level playing field finally take place. The attention should be directed to how we as law abiding people wrestle these powers away from an entrenched federal government within the RULE OF LAW
The government forgot we like to be in charge of our own lives and destiny.
I know as Americans we can take responsibility for our own health careand should for the following reasons.
1. Not to burden following generations with cost and bureaucracy.
.
2. To keep the federal government from obtaining more control over our lives and freedoms.

3. Lastly we are sovereign individuals with inalienable rights and what this government is trying to do is deceptive and wrong.

The details of this plan at this point are inconsequential. It is the basic philosophy surrounding this plan that is so repugnant and must be discarded.

Finally, the left has come out of the shadows and shown their colors. In their mind along with the present administration the time is ripe to force their principles on the population (for their own good). It is interesting that their standards don’t spread freedom yet expand authority and lack choice. So I would ask congress to commit occupational suicide. Craft laws that limit your and subsequent legislators power. Bring into existence legislation that performs in the transparent none repeat scroll 0% 0%”>best interest of the Republic instead on the narrow interests. Enact laws that return power to the local level where it is best checked. You may no longer have a job but you will have made history. You will have given the country back to its rightful owners, the American people.

If I may put a few thoughts forward that people may find worthwhile in the quest to reduce the intrusiveness of large centralized government

1. States should look into adopting laws that can recall (with a super majority) members of congress that refuse to maintain the spirit of their constituencies principles. I do not believe this leads away from a republican form of government but checks power.

2. A complete halt to new government hiring and spending on new programs without equal budgetary offsets.

3. In all aspects congress must live by the very laws they create. You are public servants.

James Madison wrote. “The <house of representatives can make no law which will not have its full operation on themselves and their friends, as well as the great mass of society. This (circumstance) has always been deemed one of the strongest bonds by which human policy can connect the rulers and the people together. It creates between them that communion of interest, and sympathy of sentiments, of which few governments have furnished examples; but without which every government degenerates into tyranny”.

4. A restriction of all relatives or married partners benefiting in any law being enacted by members. This keeps the axiom of “In the countries best interest “vigilant.

5. Free and open (public airway sponsored) televised debates. So a progression of ideas can be examined and deliberated among the citizenry.

6. Everybody that works in the United States pays a flat tax. All will have a stake in the size and intrusiveness of government while cutting out congressional shenanigans through special tax laws.

7. All legislation in front of congress should be transparent and visible (not accessible two hours before the vote). Prohibit the use of non vetted attachments.

Remember as Americans we know how to roll up our sleeves, work as a country and accomplish the goals we choose. It is our history and our future. There is only one component we need as a people to accomplish this. It is simple common sense not the irrationality that spews from and the so called (Members of congress should take an honest hard look and ask two questions.1. Is your legislation helpful towards a free capitalist society?<2. Are you even equipped to handle such a task?
If people realize that this is the beginning and not the end we will start to bring common sense back to our country. Organize for 2010 and as the process starts, our belief that we as Americans can achieve anything will take hold. This is and will be our history as we have exhibited in the past.

Cap and Trade


Watch out for the end run on cap and trade. They are moving ahead as all the attention is on health care. If passed this system will be the new piggy bank for out of control government spending. The out of thin air market based on junk science will create the next financial bubble over time.

Let me be very clear


I constantly hear the mantra ” let me be very clear”  Well I am not clear with the true aim of this administration. We are told the main reason for health care overhaul is the expense. The private sector if allowed to truly work has the best chance of accomplishing the goal. I believe the real agenda is larger government and more centralized control.

What we don’t hear is what sacrifice is the left willing to make.

1. Tort reform no mention today in New Hampshire. Where is their contribution to rein in this concealed cost.

2. Where is congressional accountability. Where is their obedience to their own legislation.

3. The country will not heal economically until we know the rules. The only problem is when narrow interests ( both governmental and privately ) are involved sanity is not present.

The real lesson here is the Federal government has no business in health care ( except the destitute and that for the most part is handled by family and charities.) or many other area’s of a free individuals personal life.

The real argument is large government verses small or local government. That is what Washington is truly afraid of. There is 3000 years of history that points in only one direction and it is the latter ( small and local government is checked best )

So far the statement ” let me be clear ” is nothing but muddled water.
