OPINION:  A Return to Regular Order to Handle the Debt

The hopes of the country were high – unjustifiably high – following November’s landslide election of a new House of Representatives committed to balancing the federal budget and avoiding a Greek-style calamity.

We can say “unjustifiably” from the reality that Republicans won only one of the two houses of Congress and the White House remains in the hands of President Obama. That leaves two of the three bodies required to pass a law still in the hands of those who created the current crisis and remain committed to staying their disastrous course.

The House has the power of the purse. With a judicious use of this power, we can force positive change. We have not done so thus far because we have not effectively used the legislative tools given us by the Founders. Those tools are the regular order of the legislative process. Here’s how they work.

The House passes a bill, which is then sent to the Senate. The Senate can pass the bill or an alternate more to its liking.

The House and Senate then appoint a conference committee to sit down and work out the differences between the two versions. If the conference committee makes no progress in producing a compromise, the speaker and the Senate majority leader can meet to negotiate a way around the impasse.

This compromise bill is then sent back to both houses for final approval. If it passes both the House and Senate, it is sent to the president to be signed into law or vetoed. If it is vetoed, the speaker and Senate majority leader can pressure the president for a compromise or work together to overturn the veto by a supermajority vote.

This is regular order. It is how the House, Senate and White House work together to produce an acceptable result and maintain a guard against any one legislative house or the president gaining unbridled power.

Instead, we have allowed Mr. Obama to skillfully circumvent the democratic process to his political advantage.

The Republican House has done its job in passing tough budgetary measures to control deficit spending. Then the Democratic Senate has refused to take any action, while Mr. Obama begins direct negotiations with the House, effectively eliminating Senate action, House and Senate compromise, final House and Senate approval and joint House-Senate political pressure on the White House.

If the negotiations fail, which the president can guarantee unless the House acquiesces to his demands, the White House is set to use its bully-pulpit advantage with the national media to blame the Republican House for global economic calamity.

The Democratic Senate is allowed to sit on the sidelines, doing nothing, taking no tough votes to have to defend in the next election, and watch the House squirm as Mr. Obama blocks the regular order of the constitutional legislative process.

This is not the working of government designed by our Founders. These are the political hallmarks of a monarch or dictator dealing with an inferior legislature. If you recall, we rejected this form of government with the U.S. and Texas Declarations of Independence in 1776 and 1836, respectively.

This must end if we are to salvage our economy and our future. Now is the time to cease out-of-order negotiations with the president and get down to legislative work through regular order.

We know what must be done to restore fiscal health to our government. We must significantly cut current and future federal spending, put the nation on a course toward a balanced budget in time certain without accounting gimmicks, and begin the process of legislative and constitutional reforms to prevent a repeat of this disaster in the future. With all three of these goals accomplished, we can afford to pass a reasonable temporary increase in the debt ceiling to prevent a downgrading of the U.S. dollar as part of the package of getting our national finances under control.

We have more than enough votes to pass such a measure in the House with flying colors next week. We should do so immediately and then move on to other business until the Senate takes action through approval or the drafting of an alternate version. If the Senate refuses to pass either the House measure or an alternate, the debt ceiling will be reached and no further borrowing will be able to occur because of the Senate’s failure to act. The economic results will be bad, but ultimately no worse than continuing down this road of suffocating national debt. We can lessen the negative impact by passing the Full Faith and Credit Act to guarantee that our bonds cannot be forced into default for political purposes by the Obama administration.

The president should not be allowed to derail the regular order of the democratic process again. House Republicans should stand solidly behind the speaker and refuse to negotiate with anyone other than the Senate until its version of a bill has passed and a conference agreement has been reached.

Our nation is blessed with the inheritance of a system of checks, balances and legislative processes that at times seem unwieldy but together provide us with the tools we need to preserve the ordered liberties that make the United States the greatest nation on earth.

But tools are only useful if someone picks them up and gets to work. It is past time for somebody other than House Republicans to grab a hammer.

    House Republicans should tell Obama to keep his nose out of things and call upon Senate Democrats to Put Up Or Shut Up, just like Rep. Carter has said.

    My quibble: The current crisis has been a long time coming and is the responsibility of all who have kicked the can down the road for the last 3-4 decades. That is a bi-partisan failure. Yes, there are now a substantial number of real conservatives in the GOP controlled house and they can be absolved, especially if they are new freshmen. The veterans are still to blame. they can redeem themselves by holding firm and leading.

    We are where we are because the GOP leadership have failed us for multiple cycles. They have done so, not because they are ineffective, but because they are moderate squishes at heart.

    They like spending other people’s money; they believe in the various social handout programs.

    They don’t mind sliding down the road to hell as long as they can tell their constituents ‘we tried – they lied, they tricked us, we don’t have the power’ and so on. By allowing themselves to be out-maneuvered, they effectively preserve their ability to not take a stand and continue blaming the Dems.

    Erick and others continually castigate the GOP for snatching defeat out of the jaws of victory. This is not an accident. They are not Conservatives at heart and are not the people’s servants.

      So the President has made it official and stated he’ll reject any short-term deal.
      Hopefully he’ll give a courtesy call to tell his Vice President to drop the charade, as his working group hashing out a short-term deal was all for show.

    I took the liberty of posting a press statement that Rep Carter issued. This represents solid thinking and also an approach based on the correct fundamentals, fundamentals which will happen to keep the Republicans off the path of getting politically steamrollered by Obama and Reid.

    The whole smokey-backroom dealmaking approach is designed specifically to get Democrats off the hook – so they can be not responsible for either the debt or the spending cuts or the hard choices.

    Rep Carter is right. The GOP House can – and ALREADY HAS – made hard choices and take tough votes. So long as Boehner and the leaders negotiate behind closed doors, we do not see: the spending cuts, what’s on the table, what’s off the table, etc. Nor do we see where individual Senators stand. THIS IS DESIGNED TO PROTECT INCUMBENT SENATE DEMOCRATS, WHILE MAKING A DEFAULT ‘TRAIN WRECK’ MORE LIKELY.

    Regular order is the solution. Specifically, House action and a demand for Senate action on a specific debt ceiling bill is what needs to happen.

    As we call on Congress to ‘cut, cap and balance’ let us add this point: “… and do it in regular order, in the daylight, so we the people can see where each member of Congress stands.”

    I have known about John Moore sense I worked for Wackenhut Securities in the Mid 1980s. He is a born a new Christian who has inside government sources. As a people we can either jeer as the people did then, or we can do what Noah did and prepare. It is our choice. With what the USNIS, US Navy intelligence Service, says is coming at us, we are looking at the end of the Age of Grace. The US Navy intelligence service says that total destruction will occur on land that is sea level to 100 ft above sea level,(Rev 8:8; 11:16) major damage up to 400 ft, and major flooding damage up to about 600 ft, plus major world wide earth quakes (Rev. 6:15) and world wide volcanic eruptions.     Truthfully, I believe John Moore, and what he says is exactly biblical. We are talking of an event of such biblical proportion that if Jesus does not intervene no one may be left.
    I am sure that the oceans will be flowing on any land below 400 ft and can reach as high as 800 feet. When this double Jupiter sized Star (Rev. 8:11) makes its normal 3600 year loop through the solar system it is disrupting the sun (Rev. 16:8) and the equilibrium that keeps a large part of the oceans on the equator. The Navy is recommending the Arkansas/ Missouri Ozarks for retirement. Though they are not letting it out, I am sure they know where our planet will be in relation to sun’s swing through the inside of our solar system. The first recorded time through was Noah’s flood when it came through on the same side as the earth. (Think movie 2012- Genesis 6:13) The second time was when Moses crossed the red sea. It was on the opposite side of the sun from the earth. (EX. 7:10- 14:27) (I have PowerPoint picture proof of this) This time we will probably be somewhere 90 degrees from it.
    Those in power are going to force everyone to stay in place until it is too late then let them die. This disruption will wipe out about 1/3 of the population of the planet, their figures which corresponds exactly to the Biblical figures. We are talking about flooding in all the worlds coastal areas, major flooding of rivers from the rain drowning BILLIONS, major earth quakes across the globe, 200 mph+ straight winds, major volcanic action (hopefully not Yellowstone) the collapse of all the infrastructure and war over the left over resources. They are giving man’s prospective, but if you read Revelation from chapter 4 to chapter 20 you will see Jesus’ prospective of what is going to happen. I believe this is the end of the age of Grace but if it is not I, but especially my children must be prepared to survive it. If you are fortunate enough to have the money to build a house put it on land above 800 feet under ground with the Base poured on rock. You want it adhered to the Rock. Do not let them put sand between the concrete and the rock as the Base needs to be solid or it will look like the land fill area in LA during the 1994 Northridge quake. If you are not that fortunate find an old bus or tractor-trailer trailer and bury it.     Soon it will make no difference what congress does or how big the debt is. The age of grace is quickly coming to a close whether you believe it or whether you choose not. Our society and way of life is finished.

    This is a great minds think alike item. I had been wondering why on earth the Republicans don’t see the smokescreen here, with these ‘negotiations’ that end up producing nothing good, and when would Republicans demand Senate action and an open regular-order debate. lo and behold: Senator Johnson holds up the Senate to demand action; other Senators pitch in; and Rep Carter lays out fully what needs to happen.

    It gives me hope that the Republicans actually may be on the ball.

The left is widely abuzz right now, twisting Section Four of the Fourteenth Amendment to say that it demands that the president pay all obligations as they come due, even if it means borrowing money without Congressional authorization. This is absolutely false. This would be the mother of all Obama power grabs, in direct violation of Article I, Section 8, Clause 2 of the Constitution. The very fact that this is even being discussed ? and not repudiated by Obama ? is absolutely beathtaking. If anyone still thinks this administration, which feeds on manufactured crises, would not willingly cause an unnecessary U.S. credit default, please, just pass the Full Faith and Credit Act anyway. Thank you.

    Yes, indeed.

    The REAL Constitution says the opposite of what the liberals want to claim it says. It forbids the administration from repudiating the debt, which means they must pay the interest if it is at all possible; and they certainly can.

    It also clearly forbids the administration from issuing new debt, as that is clearly stated in Article I as a Congressional power. Amdt 14 speaks of not questioning debts issued “under law” – well, Congress makes law, not the President. He can’t invent debt on his own.

    The end result of a FULL reading of the Constitution tells us: The President MUST pay the interest. The President CANNOT create more debt. If the money starts running out, shut down the Government, but keep paying bondholders. Case closed.

    Absolutely. I have felt for some time that this was a manufactured threat precisely because Obama administration needed a stick to beat Republicans with – “Do it our way or the bond market gets it!” … and it is more obvious this is the case, when they engage in projection of accusing the Republicans of ‘sabotage’ of the economy.

    We need to keep the GOP spine, to not give in to the nonsense from the Democrat media complex. A debt ceiling increase, with spending cuts and no tax hikes is realistic, doable and the right way to go. Stay the course and stand the ground, Republicans!
