    She’s talking about a “contingency plan” if this event occurs but doesn’t specify what she has in mind.

    If the law is struck down entirely, then the “Secretary shall determine” provisions included in the law become a moot point, don’t they?

    As Secretary of DHHS, does she have the power within executive branch methods (outside O-care) that would allow her to follow through with implementation?

    With over 60% of the American people wanting either the entire law struck down or the individual mandate struck down (or both), wouldn’t pushing the issue at this point be close to political suicide for the Obama admin?

      but I am pretty sure that if the SC rules it unconstitutional, it is game over. I am more willing to bet that the mandate is all they will rule unconstitutional and may rule that forcing private business to accept preconditions gone as well, but even if not once the mandate is killed, OCare will die soon after.

      Then we will have to see if Romney keeps his word and repeals it.

        The Judicial Branch doesn’t really have anything to enforce their rulings if the President chooses to pull an Andrew Jackson.
