MEMBER DIARY

Obama tells Kyl in private Oval Office meeting: I won’t secure border b/c then Republicans will have no reason to support “comprehensive immigration reform.”

promoted from the diaries. Cold Warrior, the author of this post, shot this video himself, and posted it at youtube.

On June 18, 2010, Arizona Republican Senator Jon Kyl told the audience at a North Tempe Tea Party town hall meeting that during a private, one-on-one meeting with President Obama in the Oval Office, the President told him, regarding securing the southern border with Mexico, “The problem is, . . . if we secure the border, then you all won’t have any reason to support ‘comprehensive immigration reform.’” [Audible gasps were heard throughout the audience.] Sen. Kyl continued, “In other words, they’re holding it hostage. They don’t want to secure the border unless and until it is combined with ‘comprehensive immigration reform.’”

Sen. Kyl also said he reminded President Obama that the President and the Congress have an obligation, a duty, to secure the border. I shot the following video of Sen. Kyl while sitting next to the man who asked the question.

(Here’s the entire clip; Sen. Kyl’s remarks begin at the 3:17 mark.)

      UNITED STATES V. BRIGNONI-PONCE, 422 U. S. 873 (1975)
      Argued February 18, 1975

      Decided June 30, 1975

      422 U.S. 873

      parts of decision
The Government makes a convincing demonstration that the public interest demands effective measures to prevent the illegal entry of aliens at the Mexican border. Estimates of the number of illegal immigrants in the United States vary widely. A conservative estimate in 1972 produced a figure of about one million, but the INS now suggests there may be as many as 10 or 12 million aliens illegally in the country. [Footnote 4] Whatever the number, these aliens create significant economic and social problems, competing with citizens and legal resident

      Page 422 U. S. 879

aliens for jobs, and generating extra demand for social services. The aliens themselves are vulnerable to exploitation because they cannot complain of substandard working conditions without risking deportation. See generally Hearings on Illegal Aliens before Subcommittee No. 1 of the House Committee on the Judiciary, 92d Cong., 1st and 2d Sess., ser. 13, pts. 1-5 (1971-1972).

The Government has estimated that 85% of the aliens illegally in the country are from Mexico. United States v. Baca, 368 F.Supp. 398, 402 (SD Cal 1973). [Footnote 5] The Mexican border is almost 2,000 miles long, and even a vastly reinforced Border Patrol would find it impossible to prevent illegal border crossings. Many aliens cross the Mexican border on foot, miles away from patrolled areas, and then purchase transportation from the border area to inland cities, where they find jobs and elude the immigration authorities. Others gain entry on valid temporary border-crossing permits, but then violate the conditions of their entry. Most of these aliens leave the border area in private vehicles, often assisted by professional “alien smugglers.” The Border Patrol’s traffic-checking operations are designed to prevent this inland movement. They succeed in apprehending some illegal entrants and smugglers, and they deter the movement of others by threatening apprehension and increasing the cost of illegal transportation.

Against this valid public interest we must weigh the interference with individual liberty that results when an officer stops an automobile and questions its occupants.

      It continues further on down the ruling;

“The Fourth Amendment does not require a policeman who lacks the precise level of information necessary for probable cause to arrest to simply shrug his shoulders and allow a crime to occur or a criminal to escape. On the contrary, Terry recognizes that it may be the essence of good police work to adopt an intermediate response. . . . A brief stop of a suspicious individual, in order to determine his identity or to maintain the status quo momentarily while obtaining more information, may be most reasonable in light of the facts known to the officer at the time.”

      Id. at 407 U. S. 145-146.

These cases together establish that, in appropriate circumstances, the Fourth Amendment allows a properly limited “search” or “seizure” on facts that do not constitute probable cause to arrest or to search for contraband or evidence of crime. In both Terry and Adams v. Williams, the investigating officers had reasonable grounds to believe that the suspects were armed and that they might be dangerous. The limited searches and seizures in those cases were a valid method of protecting the public and preventing crime. In this case as well, because of the importance of the governmental interest at stake, the minimal intrusion of a brief stop, and the absence of practical alternatives for policing the border, we hold that, when an officer’s observations lead him reasonably to suspect that a particular vehicle may contain aliens who are illegally in the country, he may stop the car briefly and investigate the circumstances that provoke suspicion. As in Terry, the stop and inquiry must be “reasonably related in scope to the justification for their initiation.” 392 U.S. at 392 U. S. 29. The officer may question the driver and passengers about their citizenship and Page 422 U. S. 882

immigration status, and he may ask them to explain suspicious circumstances, but any further detention or search must be based on consent or probable cause.

Obama, in case you haven’t noticed, is the President. He has the constitutional responsibility to enforce our laws and defend the US. Does anyone seriously question that the US is being invaded by a hostile enemy? Did anyone read between the lines of Filipe Calderon’s address to the Congress? According to Filipe, Mexico has the right to write our laws for us. And our Obumbling leader invites this THUG to address our Congress? He should have been tarred and feathered and sent home in a manure spreader.

All Obumble can think of is to challenge the authority of Arizona to enact and enforce its own laws which clearly are not in conflict with any federal statute on the books. Obumble wants as many illegals as possible made legal so they can vote for Democrats, the dispensers of goodies paid for by taxpayers.

Obama knows only one kind of legislation….Comprehensive.

This idiot needs to go. While it is good for the Republican Party that Obama disgraces and beclowns himself daily it is bad for the nation. This is tantamount to treason on Obama’s part as he has put national security hostage to a policy goal. If not treason, the rank idiocy makes the guy unworthy to hold the office. You might as well say “get a rope.” There are things that you just can’t say and things that just can’t be done to THIS president.

And Biden wouldn’t be any better.

        • acat

What this president sets up is a massive conflict between the power of the executive branch and the power of the legislative branch – with some serious gut-check questions for the various governors.

While impeaching Obama is not likely, if the Dems wish to go on as a party they must reign in his worst dictatorial tendencies. There’s a couple ways to go about that short of impeachment. One would be to suddenly discover “states rights”, i.e. start reducing the power of the Fed. Another would be to use the power of the budget to limit the executive, i.e. specifically de-funding programs and offices to limit what POTUS can do.

The best not-impeachment that could happen may be a finding of “unable to continue to serve for medical reasons”. This would not have the .. call it stigma of impeachment, but would push Obama into retirement. While I’ll agree that “Plugs” Biden is not a great choice, he is a better choice than what we’ve got now – and the more moderate or selfish-career-oriented Dems know it.

All they need is a Grand Old Statesman to rally around – or, more accurately, an unimpeachable lightning rod to soak up the vehemence of the uber-liberal wing of the party. Doesn’t William Jefferson Clinton fit that bill to a tee? He holds no office, but he has experience. He holds no real power, but he knows how to use power effectively.

Patience is called for, Texas. Hunker down, and prepare to watch the fireworks.

of the governors of the several states of the Confederacy with their central government. A couple of them, notably Georgia and North Carolina, seemed more at war with Jefferson Davis than with Abraham Lincoln.

I well know the kind of gutless type you have to be to get elected to the US Senate, but governors have to either actually run their states or be able to tolerate having people around them who will, so they all either have or can act like they have spines. The sound of crickets emanating from DC Republicans doesn’t surprise me, but the crickets from the states is beginning to upset me, and not just about the Gulf. Jindal sounds more like he’s whining than shouting in outrage as the representative of a sovereign to the feckless Feds to just get out of the damned way.

And as I’ve long and thus far futilely advocated, Republican governors and AGs should be seriously trying to make unions and Democrat fronts’ misery their mission.

According to that article, it still seems like the governors still have the authority to call up the National Guard. but that the President can do it also. Or maybe the President can use the Insurrection Act to stop a governor from using the National Guard. Yuck!

          • broadsword

The problem might be that I believe the government has already “Federalized” the Guard by calling them up to help with Iraq and Afghanistan, but I’m not sure if thats been done.If not then she should be able to ,but the question is would she? It would be one hell of a slap to Obama’s face if she did.

KEY EXCEPTIONS TO THE POSSE COMITATUS ACT
A summary of key exceptions to the Posse Comitatus Act follows: 3
            ?
National Guard forces operating under the state authority of Title
32 (i.e., under state rather than federal service) are exempt from
            Posse Comitatus Act restrictions.
            ?
Pursuant to the presidential power to quell domestic violence,
federal troops are expressly exempt from the prohibitions of
Posse Comitatus Act, and this exemption applies equally to
active-duty military and federalized National Guard troops.4
            ?
Aerial photographic and visual search and surveillance by mili-
tary personnel were found not to violate the Posse Comitatus
            Act.
            ?
Congress created a ?drug exception? to the Posse Comitatus Act.
Under recent legislation, the Congress authorized the Secretary
of Defense to make available any military equipment and per-
sonnel necessary for operation of said equipment for law

to state active duty. The reason states rarely do it is that they have to pay them rather than the US paying them. We had a terrible wildfire season about ten years ago and called a lot of Guardsmen to state active duty and had the Devil’s own time sorting out the pay and benefits issues, but it can be done.

It actually resulted in my getting the only apology I’ve ever gotten from a newspaper. Somehow a group of Guardsmen got double pay checks. We found it on audit and moved to take back the second check. They went nuts and went screaming to the Fairbanks News Miner who wrote a scating editorial accusing the Administration generally and me specifically of being very bad people – without ever talking to me. So, since I can write pretty well, I wrote back and laid it on them, which ultimately resulted in a printed apology from the editor. Still have that in one of my “I love me” boxes.

There are some on the left who say, well, if we secure the border first, people won’t want to do more to secure immigration reform. I don’t think that’s true — I think that will help us get to comprehensive immigration reform

Now think of how disgusting this is, no matter how you cut it. We have democrats (including the ‘president’) on one hand holding the rape, murder and drugging of US citizens over the head of Republicans to get a new constituency. We have republicans on the other, who instead of showing the appropriate moral indignation and outrage, the most they can say is that they think amnesty can be sped up if we don’t hold the American people hostage.

I got a problem with Kyl telling reporters that he thinks securing the borders will help amnesty, and then telling people in this video, most of whom you can be sure DON’T want amnesty, this as a way to fan the flames and help the GOP. I can’t quite articulate it, but it seems duplicitous.

Ya know, the Mexican drug gangs and coyotes are little better than Taliban or Al Qaeda types. Very similar M.O. The motivations are different, but the outcomes are largely the same. And we have politicians willing to leave our fellow citizens on the border at the mercy of these animals to get more votes.

Kinda makes you wonder if the whole outrage at terrorists is feigned, by elements on the left and right. The very thought that democrats would dare think this should be enough to enrage any red-blooded american. Instead, Kyl tries to compromise with them. Shameful. Disgusting.

I am a fence guy. Fences work, and once a fence were in place and we could be assured that the border is secure and that no mater what we did, there would be no future mass exodus from Mexico, we would have more leeway in dealing with the millions we have let in for the last 20+ years, knowing that no 20 million more could easily get in.

with the practical aspects of this issue. I have not one way or another commented on that. the point was that he had no apparent moral outrage, certainly not well publicized. about these jerks using the safety of us citizens as a bargaining chip to get the gop’s complicity in giving them a new voting bloc.

THOSE FACTS I’m concerned with. I am all for fences, military on the border, you name it. I am also for castigating and making pariahs of those who would use the safety of their own countrymen as a bargaining chip, and of those on our side who would play nice with them.

As symbols. True it will make the invasion more difficult, but they will still come over under and around them. To be effective we need (in reverse order)…

        E) A fence.
        D) Cutting off all government benefits.
        C) More states emulating Arizona.
        B) Draconian fines and/or incarceration for those who employ illegals.
        A) Lengthy prison sentences for coyotes and especially for those who provide false documentation.

        • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

Agree with most of your other remedies except that I would only favor such fines or worse against employers if the employers also have a liability-preventing employee identity check system so that they would not be faulted if they use the ID system and the ID system is fooled.

          • Diogenes314

One thing many on the Center/Right either aren’t aware of or ignore is that the 1986 amnesty program did significantly cut down on illegal immigration-when it was enforced. The trickle gradually became a flood under the Clinton administration when the priority shifted from enforcing employer sanctions (as under Reagan and Bush I) to investigating ‘civil rights abuses’ of employers ‘discriminating’ against groups by disproportionately examining their credentials. The fact is, most employers won’t hire illegals unless they can actually fake citizenship. And the same parties who supply false documents to poor people looking for work also do so for drug dealers, kidnappers and terrorists. It’s not about jobs, culture or even respect for the law-It’s about National Security.

My first step towards Immigration Reform would be a mandatory 6 month sentence (prior to deportation against anyone possessing false ID. Said sentence to be waived in exchange for testimony against the suppliers- who would receive minimum one year consecutive sentences per offense.

Actually that would be my second step. The first would be figuratively kneecapping any GOP official who uses the word ‘reform’ in the same sentence as any Democrat proposal.

          • myron_j_poltroonian

It seems that the “E-Verify” system cannot be [legally] used by employers unless, and until they’ve already hired the employee in question. Say one who’s social security number has proved fraudulent. Then, adding insult to injury, the employer cannot fire said employee for fear of a wrongful termination lawsuit. “Mere words?” Or mere details never mentioned by the democrats or the blame stream media? . ” … you decide.”

        • aesthete

As Mbeck noted, it does nothing to change police operation on the ground, and in fact, makes their jobs more difficult for a plethora of reasons. B works pretty darned well, relative to other solutions. We sort of have E, but it’s a really crappy fence that’s broken in parts. I’m almost 100% certain that we have lengthy sentences for coyotes already (though I would favor summary execution for the savages, assuming no or false documentation). D is one that I and most people would fully support (emergency services being an obvious exception, ditto to a lesser extent K-12 education), though to be honest, it’s not exactly a relief to know that the deadbeat stealing my money has a US passport instead of a Mexican one.

While we’re on the topic, we could do with scrapping INS and virtually all current agencies and policies that deal with immigration, most of which are directly beholden to the Department of Labor (and indirectly, to unions) and corporate types, particularly in the case of highly-skilled foreign labor, and unskilled immigrants. Having been involved in the system, and knowing many actual victims (not “victims”) of the system, I can say with certainty that our immigration system is the most dysfunctional part of our federal government. Given that immigration is something that the federal government is reasonably permitted to control, conservatives should be more concerned with how inefficient and Orwellian it has become. Personally, I wouldn’t mind starting from the Ellis Island model and working from there.

          • Flagstaff

“We sort of have E, but it?s a really crappy fence that?s broken in parts.”

A crappy, broken fence isn’t a fence at all. It’s a speed bump at best.

A physical fence in every passable terrain is the first order of business. That will generate confidence that the gummint won’t change its mind next year. Once that is in place and other security measures are too, then the question of what to do with the “guests who have overstayed their welcome” can be addressed appropriately and calmly.

Why is it people have lost their sensitivity to issues that matter? I could walk down the street right now and talk to dozens of people about this subject?.scratch that?.I could show them this video point blank and they would shrug it off. If this video were to surface 30, 40, 50 years ago they would have started a war against the current administration. People have become numb to failed leadership, the type of failed leadership that is intentionally killing our country?.and I just don?t understand why! The common guy used to be the guy that mattered, and it seems even he has given up trying to fight back.

    • avgjo

you’re mad, aren’t you? I am, a lot of people are.

The problem is, the consequences of standing up against trash like this are big. When bad people run the institutions, like they do now, they can give the appearance that their ideas are the majority opinion, even though they are really the minority. This makes each patriot feel isolated; and isolation is the best way to weaken people. Very few people can see thru this and act accordingly. Even fewer can feel isolated and still take a stand for what is right. That’s why Nazi Germany had so few willing to stand up against Hitler. Remember, he only got about a third of the votes in Germany.

This is an aspect of human nature, and it explains what you say.
But there is another aspect of human nature, and it gives hope. The Founders were part of about a 10% minority when they started out. But by leadership, and by that, I mean leading by EXAMPLE, they won the day.

It is often said that most people are sheep. I don’t quite agree with this, but most people need a leader, they need an example so that they can find out that they too can stand on their own two feet. If you have a George Washington, if you have a Tom Paine, if you have a John Hancock, people watch them. They see that the sky stays up when ‘forbidden’ things are done; things like saying the truth, like standing up on principle to tyrants, like not tolerating evil. They see that others believe the same thing they do; the difference between the ‘sheep’ and the ‘shepherd’ is that the shepherd had the guts to say aloud, in public, what the sheep are thinking. So when people hear their opinions being boldy, confidently and unwaveringly thrown into the public arena, when they see that the consequences of doing so aren’t so bad as they imagined, they are heartened and it is amazing to see how some people rise to the occasion.

You wanna know why Sarah Palin is so wildly popular and why people are so fanatically adoring of her? Read the above paragraph again.

I respect Mrs. Palin greatly. I can’t tell you she’s necessarily ready at the moment for the Presidency (although I think one day, she’d make a great one), but she will always have my respect and appreciation. She has my respect because she has shown great courage in saying what needs to be said, in spite of horrendous treatment at the hands of the media. She has my appreciation because she has demonstrated that there are still MILLIONS upon MILLIONS of Americans who are thinking what she has the guts to say and she has energized and heartened those people. Despite what certain recent polls say, I believe the Tea Party folks are doing the same.

      In summation, Handprop, remember:

      1. People are thinking what you have the guts to say. They’ll get the guts to say it if you and me and others say it loudly enough, boldly enough and consistently enough.

      2. The difference between a leader and a follower is that the leader has the guts to do what must be done and say what must be said, whatever the odds and whatever the consequences.

      3. Leadership is by example, not merely by rhetoric or holding an office.

      p.s.

I think we are all going to be pleasantly surprised at the results in November. I know after that beautiful day in January, I’ll get the best sleep I’ve had in two years. But we’ve run so hard for so long, that we’re getting a little frayed in the nerves, and that’s biting into our enthusiasm and hope. I know it’s cliched, but it’s cliched for a reason: the night is always darkest just before the sun comes up. It’s very dark right now, but I believe it is going to be a beautiful sunrise.

That’s why we band together, to support one another and to gain confidence by seeing that we are many.

There is nothing more dangerous to tyranny than a group of INDIVIDUALS who come together of their own accord, and are of one mind about freedom and liberty. At the time of the Founding, those who knew they loved freedom more than life were few and those who thought they loved life more than freedom were many. That changed by the end of the Revolution.

Now, those who know they love freedom more than security are many, but not the majority. Those who think they love security more than freedom are the majority. By the end of the great Stand against Statism, that will change.

          Hold fast.

            states- The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion;

Has he even read the constitution? We know he doesn’t care about it but to admit to intentionally ignoring it carries this into another realm.

Then there’s Article III, section 3: Treason against the United States, shall consist only in levying war against them, or IN ADHERING TO THEIR ENEMIES, GIVING THEM AID AND COMFORT.

Is Obama guilty of treason? Standing side by side with the Pres. of Mexico against the State of Arizona? As invaders take our jobs, taxes and even some of our land? Is it treason or merely shameful?

I don’t expect this congress to do anything about it. But if he’s guilty we have to elect a congress that will.

      • Flagstaff

        Very nice.

I keep saying that our leaders need to fight for some lost causes, just to get practice at fighting. Maybe “do what must be done and say what must be said, whatever the odds and whatever the consequences” says it better.

I am shocked when I should not be, yet I can’t help but think of the countless times those charged with enforcing our laws are threatened with neglect charges with the penalties at times resulting in the charging of a crime or dismissal from the profession forever. If true, and the truth must always be assumed until disproved, I believe this is akin to “aiding and abetting” a violation of law.

Coupled with the reported intention of the Federal government filing suit against Arizona, maybe Arizona might want to charge the Department of Justice with Obstruction. Statements such as those now attributed to a sitting President require the proper scrutiny by the people for now through their reportedly representative government.

Barry and his leftists know that those illegal alien voters are the only thing that will save their hides. They NEED those 20 million votes or they are the next Whig Party and they know it. So I say….fight on , and NO quarter.!

  • rsjt

the democrats don’t care that their unwillingness to secure the border makes life harder for the jobless in America. They don’t care about people. They care about votes.

This is also reflected in their reaction to the still gushing oil and the complete lack of response to the floods in Nashville. (I thought the government run TVA was created to stop flooding).

The dems are against working folks. No doubt.

  • m_quick

Obama is not only ruthless in doing this but he’s also an idiot for admitting it.

People are dying on the border, parts of America are off limits because of this situation, this is not something any President of the United States should want for their country.

  • wolfster38

The lives and safety of Americans mean nothing to Obama. The deaths of American citizens are a tool for Obama to force his radical agenda forward. The more people die or get hurt the more power he can grab. Obama wants us to have no choice but to get help from him and his way.
Now we know why he is doing nothing on the border and in the gulf. If he hurts the people long enough the republican will be forced to go along with him just to stop the bloodshed and heartache in America.
Way to love your country Obama!
Never let a good crisis go to waist, Thats the nutjob (Obama) in a nutshell !

  • throwback59

ago that estimated 12 Americans die daily at the hands of illegal aliens, due to murder & drunk driving. That’s over 4000 a year, 50% more than died on 911.

This is the Chicago Way. You bribe, clear the field, marginalize, force, or corner the opposition. You don’t win arguments on policy issues. That’s for wimps. You must coerce and trick people into following your agenda. This isn’t surprising. It comes on the heels of inaction over the Gulf oil spill because you cannot make political hay out of clean beaches. They will let every single problem in this country grow sour to force their collectivist agenda. When the people reject it, label them racist or worse.
I truly think there are those in the Democratic Party who are getting fed up with this extremism. They are seeing this administration as making a suicide pact with the far left. The middle of the Party is doomed as the brand becomes mired in more of this filth.

I am a “RINO”. A “Republican In Name Only”. Unlike, however, the establishment’s RINO’s riding the Elephant into the dirt and obscurity, I am a Republican so I may have a voice in the Constitutionalist make up of the candidates running for elective office. I am an American first, a Conservative second and a Republican a dim, distant third. I’ve attended anti-illegal rallies across the river in Sacramento a few years ago, and I shall again in the near future. I write, I call and I e-mail. Not only to incumbents, but I send Letters to the Editor, as well as to sites and forums like this one. The “Silent Majority” is silent no longer. We’re now known as participants in the “Tea Party Movement”. If I found (however unlikely) a Democrat who was pro-second amendment, pro-states rights, pro-small government and pro-original intent who was running against a squishy RINO, I’d vote for him or her. I was just as against and outspoken about the big spending, overreaching, outsourcing of critical security materials and information in the last three administrations as I am of this regimes. The one fear I didn’t have with the last that I have with this one is this; I didn’t believe that G. W. hated this country and all it stands for, unlike the mentors of our current ROTUS (Radical Of The United States). This current government gives me no such confidence in their intentions. “This far and no further” is not just some quaint phrase – it’s a way of life when our freedoms are threatened. Our Constitution is under attack and I, for one, will stand up and defend it. The oath I took when I joined the service: “To Preserve, Protect and Defend the Constitution of the United States of America Against All Enemies, Foreign and Domestic”, placed no limit nor timeframe on my obligations in this matter and I recognize none.

This is no big surprise to anyone, is it? Our government turned it’s back on us regarding securing our border years ago. We’ve had SEVEN amnesties and all that they’ve ever accomplished is bringing us more illegal aliens waiting for another amnesty! (Not to mention all of the new citizens sponsoring their family members to come over too.) Our government doesn’t want to stop this invasion. They don’t want to protect us or stop our loved ones from being hurt or killed by illegals who should have never been in our country. Our government has abandoned us so it is up to us to save ourselves and our country.

To back up its claim that President Obama has already moved forward on securing the southern border, the White House provided background on President Obama’s “Strategic and Integrated Southwest Border Strategy,” stating that in the past year the US government has doubled the personnel assigned to Border Enforcement Security Task Forces, tripled the number of Immigration and Customs Enforcement intelligence analysts; and required the Department of Homeland Security to — for the first time — screen all southbound rail shipments for illegal weapons, drugs, and cash; among other steps.

Note to one and all: It’s “Illegal Alien”. In law and in fact. (To paraphrase the most famous line from the movie “Treasure of the Sierra Madre”: “?Passporta’s? ?We don’ need no stinking passporta’s!”) Anyway: “Don’t Worry, Bob’s here!” That was the punch line from a rather memorable commercial for a temp agency from a few years ago. I took that line, applied it to illegal immigration and came up with the following tongue in cheek essay: “Don’t worry, B.O.B.’s here!” “B.O.B.” stands for “Bag limit? Or Bounty?” (If Bounty, “Dead or Alive?”) It went on from there. Unfortunately, it’s lost somewhere in the old, real old computer it was created on. You, however, I believe, get the idea. I have also suggested that we fire up the nation’s “Mothball Fleets”, work out a suitable deal with say, Argentina’s Terra del Fuego, or Singapore, or maybe Somalia, to serve as debarkation point(s) and have Mexico (or whatever country of origin applies) pay us a barrel of oil a day (or week, or month) for each and every day an illegal is here. These ships would be convoyed all the way with US Navy protection on training exercises in the area(s) involved. Another suggestion I’ve made over the years was to clear a ten to twenty five mile wide swath along our southern border – salt water to salt water – and turn this strip of land into a live fire, combat training range subject to continuous, unannounced live fire exercises. From small arms to howitzers, aerial bombardment to shore batteries, booby traps to bouncing betty’s. 24 hours a day, everyday of the year, there will be continual and unpredictable live fire exercises and armed patrols, aided by UAV’s (unmanned aerial vehicles) equipped with electro-optical/infrared sensors, with standing orders to interdict all attempts to go through, under, around or over this combat training ground and intercept all trespassers. Then, when convenient, remove them to a staging area to be subjected to a biometrical scan and entered into a national database, then unceremoniously taken to the nearest border crossing and sent packing immediately. Oh, yes. It should be called the General “Black Jack” Pershing Military Reservation. Why? “In 1916 Pancho Villa and his bandidos raided the town of Columbus, New Mexico, and in response President Woodraw Wilson sent General John ?Black Jack? Pershing into Mexico after him. Back then, American authorities at least did something when the border was violated.”

    From cubachi’s blog:

Senators McCain and Kyl of Arizona gave an over 20-minute presentation on the senate floor decrying the lack of response from the president and their colleagues from their obligation to protect the people from the border states, especially Arizona where over 50% of illegal immigrants come across the border and over half the drug seizure in the US are from. Phoenix is second to Arizona for the most kidnappings in the world!

Interestingly, at the 12:50 mark of this video, Senator McCain said, when republican senators met with Obama recently for a lunch, Obama essentially said the same thing to these senators of wanting to pass ?comprehensive immigration reform? before securing the border.

?It was made very clear to me, in the conversation we had?that the president, basically, conditioned his support for border security to overall comprehensive immigration reform.?

    Roll the C-SPAN tape:

    Major kudos to cubachi!

And, major kudos to Senators McCain and Kyl — it looks like maybe, just maybe, they ARE going to come up with strategies to FIGHT for our individual liberties, as I have been imploring them to do so every chance I get.

See the video clip above in which Sen. McCain said, “It was made very clear to me, in the conversation we had?that the president, basically, conditioned his support for border security to overall comprehensive immigration reform.”

The president. His support. Not “the president’s base.”

McCain will be debating J.D. Hayworth and Jim Deakin at 7:00 pm on July 16 and at 7:00 pm on July 17. I am crossing my fingers J.D. will run circles around “the Maverick.”

that Obama stated he would not secure the border given the language Kyl said was used and the context of the negotiations on a specific bill. I think that distinction is important, and we can still make Mccain’s point and point out that Obama stopped building the fence and sues AZ to stop them from securing their portion of the border.

      • Flagstaff

I just re-viewed the video. It’s unambiguous that Kyl was referring to the President and what the President said to him, and Obama’s term was “we.” Sounds like a royal “we” to me. Quoting Kyl quoting the President:

        “‘If we secure the border….’”

Kyl: “In other words, they’re holding it hostage. They don’t want to secure the border unless and until it is combined with comprehensive immigration reform.”

Kyl: “We have an obligation to secure the border…. We’re supposed to secure the border…. But that’s why it isn’t being done, they frankly don’t want to do it, they want to get something in return for doing their duty.”

Contrary to his later statement, it is abundantly clear that he was talking about Obama and his administration, not his base, and so was Obama. It is the President who has a duty to enforce the laws, not his base. It is he who decides, not his base.

Put all the lipstick on it you want, the President admitted that he wasn’t enforcing the law, and he’d stopped building the fence, for political gain. Whether it is because his left base was pressuring him is irrelevant. Take off your blinders. This is an abrogation of the President’s oath of office. Maybe not provably impeachable, but it shouldn’t be swept under the rug. At the very least, add it to the list of Obama’s transgressions.

        • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

and not a threat not to enforce existing law, so its not impeachable. But what Kyl says is still devastating but in many ways, already known, except the fact that Obama would not consider new laws unless comp reform.. But we already have the issue of Obama not securing the border, in fact, by his action and so don’t need more from Kyl on that issue. I don’t think we should sweep the issue under the rug and the quote still says that Obama holds laws he knows would increase border security hostage to comp reform.

But we shouldn’t press Kyl to have this escalated to a liar match over this. Obama’s admitted truths convict him.

        • http://erickbrockway.wordpress.com/ Erick Brockway

“…in other words, they’re holding it hostage.”

          I don’t know where it’s very “ambiguous” at all;

I went back and re-watched the clip (skip ahead to 3:20 or so) and, yeah, it?s a bit more ambiguous on second view ? but only a bit.

          • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

makes clear that what Obama is doing is bargaining for NEW laws, not threatening to refuse to enforce existing law, which is what was ambiguous in some of the reporting early on, at least in my mind. And that is all I am saying.

The fact of Obama refusing to be willing to pass NEW border security laws unless there is an agreement on amnesty is bad in and of itself. Worse have been his public actions in halting fence construction and suing AZ.

Given all that, I don’t think it was critical for Kyl to continue to escalate the what now seem minor details on language in that meeting.

I can’t help but love the guy. He is right on the issues. He is enthusiastic and bold. And I like his rough edges. I think his kind of authenticity is a good seller just now.

        • mbecker908

JD most certainly is not right on “the issues”. He’s every bit as “authentic” as the guy at the “buy here pay here” car lot. And today, the number one issue is government spending, fiscal responsibility and the continued over-reach of government. JD is on that train with a condescending smile on his face, he never met a spending bill he wouldn’t support or a government program that wasn’t worthy of his support. Oh, and in the last Ras poll JD dropped to 36% and that was before his latest boffo about “free money from government grants”. As bad as McCain is, JD is 1,000 times worse.

As far as Brewer is concerned – and it looks like she’ll get elected – she’s nothing more than Charlie Crist in drag. She’s reading her lines well on the immigration thing, and her new commercial is fantastic. But when it comes to actually running the State of Arizona, she’s not quite as conservative as Arnie. Her most recent budget is a total farce and she is borrowing her way into a “balanced” budget, ie kicking the can down the road, making the problem worse and the solution more difficult.

You can have both of these jerks.

          • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

policies on the main votes on the main bills over the last decade. I have almost always agreed with JD and too often not with McCain. Now, as to the spending bills when he served, given the exponential increase under ObamaDems, I see those old votes as quite puny as compared to the big issues where JD would be more reliable than McCain.

And despite Brewer’s shortcomings on “running the state”, her stand on immigration is so vital and timely that its significance outweighs other issues.

And yes, making choices between politicians is usually, having jerks of some sort.

          • mbecker908

JD is not and will never be “more reliable” than McCain and McCain is not at all reliable. The best part about McCain is that he should be retiring in six years and even if he doesn’t we have six years to queue up a solid conservative to replace him. (And two years to find one to replace Kyl). Elect JD (which won’t happen any in case) and we’re stuck with brain dead sob for God knows how long.

On Brewer, she didn’t support 1070, in fact she had NOTHING to do with it and nobody knew whether she’d sign it until she did. It was nothing more than an act of political desperation because she was sinking like a rock in the primary. Any Republican running for Governor who had a real shot all supported 1070 way before she did and would fight the good fight to win in court. In the mean time, she’s busy ignoring the fiscal condition of our state, which is second only to CA in the “disaster” column. The fiscal issues are way more important than the immigration fight because it’s a given that whoever gets elected in November (and it won’t be Goddard) will carry that on with a vengeance.

Go find a replacement for Lindsey Graham.

          • Aaron Gardner

I have this concern because you have had years of betrayals by McCain to use as a catalyst to find a replacement and have yet to actually do so.

Prior performance being a predictor of future performance leaves me questioning the will power of those of you still in AZ to do what must be done.

          • mbecker908

          • Aaron Gardner

I am over it. I am talking about your proposed solution in 6 years. But whatever, you don’t want to have that discussion.

In six years when you still don’t have a candidate I guess we can talk about all of this again.

remind of McCain’s reckless taped speech to Cally Repubs opposing the overturning of Roe that was released the week before the 2000 SC GOP primary.

Anything can happen and isn’t it better to have McCain challenged and pushed to the right?

Seriously, I taught business law for two years at Wofford College, my undergrad alma mater in Spartanburg.

I am not hopeful that Graham will get a strong challenger given his friends in SC that would otherwise be the logical choices.

Maybe Alvin Greene’s cousin is a Republican.

          • Scope

edumocation Cockadoodledoo. I wasn’t aware of that speech, but, it makes alot more sense than the 2000 loss being pinned on the southern smear that his black adopted daughter was really his. For years and years McCain has been on the wrong side, yet, the only people that keep sending him back to DC, in any capacity, are the people in AZ. Note, I didn’t say the voters.

Probably one of the best comments you’ve made, that I have read, was when you disagreed with newbies and the old grizzleds name calling, and all of the implications that go along with that. I’ve disagreed with you on some things, as you well know, but, it never comes to total and complete disrespectful denigration of each others opinions. There are many people that don’t live in particular states, but have been following state activities, and candidate for years. Even if they don’t live in those states, their ideas/knowledge/opinions are not less valid because they are not living among the locals. In fact, we have more than one state residents that offer their opinions/ideas, and at times, they are in complete dissagrement on some things. I hate when anyone attempts to control the conversation. And, that is what it is, first amendment rights and all that. Everyone has a right to his opinion/words, and the proverbial firing squad needs to back off.

After this, I probably need a good lawyer, are you available? Then again I take those name tags and disqualification of any of my comments as yet another Gold Star on my calendar. Everyone should take it the same way. That is, unless you are for the O and his goons, then bring out the big guns.

grass roots conservatives in AZ, will be reminded of these kinds of things:

            John McCain’s friend Juan Hernandez:

            http://therealjohnmccainforsenate.weebly.com/

McCain gets his chance on July 16 and 17 to “put away” the campaign of J.D. Hayworth — he gets to meet him for two televised debates.

Latest Rasmussen poll has McCain down to 47 per cent, Hayworth at 36 per cent and Deakin at 7 per cent. What if Deakin drops out after the debates and throws his support to J.D.?

Then, it’s a 47/43 race with 5 weeks to go.

Maybe these debates will completely change the dynamic. Maybe, J.D. will turn the tide.

I know mbecker thinks J.D. doesn’t have a snowball’s chance in hell to beat McCain in the primary. Time will tell.

If I recall correctly, mbecker, you said long ago that J.D.’s poll numbers would be at a peak the day after his announcement to run and the continuously recede. Has that played out?

I’ll be voting for J.D. and urging all AZ Republicans to do the same — and those outside the state to donate to J.D.’s campaign. I think he has a shot — I’m in the trenches inside the Party and, while I know there’s lots of RINOs, I think the motivated Republicans in the primary election are the conservatives, not the RINOs, and the conservatives may turn out in sufficient numbers to retire McCain, just as happened in Utah to Bennett and just as happened to the RINO candidates in Nevada who lost to Sharron Angle.

Arizonans support SB 1070 by 70 per cent margins. ALL conservatives do. And when ALL conservative Republicans are reminded of McCain’s support for amnesty, even some of the moderates may decide it’s time to retire the Maverick and give J.D. six years.

We’re talking about a primary election here and Arizona Republicans are notoriously lazy about going to the polls in mid-term primary elections. I’m putting my money that the GOTV efforts we conservative PCs are working on here in AZ will result in an upset victory for J.D.

            I hope I’m right.

I’m not saying this is the be-all-end-all, but it’s certainly, directionally, a rock on the pebble pile. PDF of the June 24th poll is here.

            McCain 52; Hayworth 29; Other 14. McCain +23.

The more interesting number to me is the “image ratings”.

            McCain 60/37 Fav/Unf.
            Hayworth 38/50 Fav/Unf
In Maricopa County, the home of CD05 that JD got tossed from four years ago it’s 39/52. Maricopa County is also home to about 70% of the GOP voters.

And that was before he got caught giving away gummet money grants.

The prediction is working out quite well thanks.

Right now I’m guessing that McCain will win the primary in the high 40s ONLY because Jim Deaken is doing a lot better than I though he would.

Thankfully when this is over we’ll never hear from JD again. He won’t get his basement rated talk show back and with any luck he’ll move to the Carolinas. Maybe he could run against Graham.

          • aesthete

compared to how he’s actually polling. SB 1070 completely changed the dynamics of every single race in AZ to favor Republicans; specifically, pro-enforcement Republicans. This is the one issue that JD has some credibility in, and the fact that he’s not even in the 40s actually surprises me (ditto Deakin’s high numbers). I expected his vote % to drop couple of weeks prior to the primaries. Problem is, he’s universally reviled in AZ by conservatives, moderates, progressives, and the hard-to-classify oddballs that might vote for him (libertarians and the like), with each group having its own reasons.

          • mbecker908

that I can’t top with something I like less. That particular episode isn’t even anything I personally care about, I’ve got a long, long laundry list of issues with McCain that bother me a whole lot more. And I still wouldn’t vote for JD.

JD would quickly replace Babs as the dumbest senator ever. Again, it doesn’t matter. JD will not and cannot win. He couldn’t get elected dog catcher anywhere in AZ. No, it’s not better to have McCain challenged by the likes of JD, it’s made no difference in anything he’s done, other than spend money on his campaign while JD pisses money (albeit not much) down the sewer on his. We’ve got three House races that people should be focusing on instead of this, all this crap about JD is nothing but mental masturbation.

And, again with reference to Brewer, we need somebody like Christie not somebody like Arnie.

          • mbecker908

I’ve given Brewer credit for reading her lines well since she signed 1070.

In point of fact, immigration has become – in part because of the attention driven by 1070 – a non-issue this year. Dems in the House are admitting that there is no way in hell they’ll get immigration legislation through the House this year. In the Senate, I’m pretty sure even McCain is on the enforcement side – probably with caveats I wouldn’t like – and nothing will move in the Senate either. The Administration will make lots of noise about taking it to court – it’s filed in Federal Court in Phoenix, everything before one judge who’s a Clinton appointee, and will likely be blocked on July 29. Then the fight is on. The Feds will win in Phoenix. They may win in the Ninth Circus. They’ll likely lose at SCOTUS, but in any event that will maybe be in time to have an impact on the ’12 election.

THE problem in Arizona is our budget. It is NOT blathering about immigration. I would agree immigration could be a huge issue if we able to actually do something about it, but we can’t. It’s a long term problem that we’re not even close to solving. The FACT that state spending under Janet was out of control (with two Republican controlled houses in the legislature) and it’s absolutely no better under Brewer who owns the current state budget and balanced it with borrowed money, “temporary” sales taxes and TARP money. We can survive four years of the problems driven by immigration because we do have some ability to enact some local remedies (hiring, housing) that will at least drive illegals out of AZ to the friendlier climes of CA, but we cannot survive four more years of economic and budgetary incompetence.

          • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

warrant a lecture on AZ’s budget? All I have stated is that the US is better off for Brewer having signed that law thus exposing Obama’s extreme leftism for all in America to see, over 65% of them seeing Obama thusly.

That is all I care about Brewer. I have no clue if she is up for re-election and your preference against her.

The whoosh actually resides above your head and did deem it rational to take an Advil for the headache I got upon learning that you are now working for McCain’s campaign due to jealously of Hayworth’s hair! See, I read all of your post!

Now, back to the College World Series where South Carolina leads Clemson in semifinal game 2-1 in the 4th.

    • http://www.examiner.com/x-1597-Charlotte-Law--Politics-Examiner Mike gamecock DeVine

my focus was on the suggestion that Obama said he would not enforce existing law. That would be impeachable. Obama already stopped building the fence and simply tells Kyl et al that he won’t sign a separate border security bill. That is completely different to me as Obama can simply state that he is enforcing laws existing today that were good enough for Bush, Clinton, etc.

So I’m glad Kyl backed down from a character attack on a rather minor matter when we have so much more to focus on with his lawsuit against AZ, halting fence construction, refusal to let NOLA etc defend their coasts.

The President could be impeached for anything that 2/3 of Congress would vote for, and i could envision a scenario where Obama could be abandoned by Democrats in a situation of very low poll numbers coupled with executive overreach/hubris like an executive order granting amnesty.

Impeachment is an extreme step and certainly should not be used especially in situations that can be remedied with legislation. But if Obama were to grant a massive amnesty to 20 million illegals that Congress couldn’t remedy…

        • Achance

Some speculate about the Ds dumping Comrade Obama but it would be a repudiation of everything they are to dump him; the Left just has too much invested in this coup attempt with him at the head of the junta. Ain’t happening. It is going to be a long hard grind won seat at the time and Congressional vote at the time.

I’m not even optimistic about replacing him in ’12 unless there is some externality that we can’t foresee just yet. The goal has to be get at least one body this year so we can stymie them, get the other body in ’12 so we can play budget games with Democrats and make them behave – something we never did under GWB; we should have been appropriating money to tear up roads and tear down buildings in Democrat districts, instead we let them pork too. That worked real well for us.

Then maybe we’ll have both a rebuilt Party and some decent National level candidates by ’16.

I had hopes for Kyl, and then I find that all those good things being said about him come from Mitch McConnell.

I’m glad I directed this at him as well as McCain and McConnell.

a separate border security bill, shouldn’t the most logical next step to maximize the utility of the kerfuffle, be that we ask that Obama submit his border security only bill, rather than go down the he said/he said pissing match?

        I think so.

And given my five years of seniority…

        • Flagstaff

I agree with you. It should be maximized, and that’s a great way to put it t him. He obviously won’t respond, but the ‘Pub talking point would be, “We’ve told the President we’re with him 100% on a straight border security plan, one that cuts off the steady stream of drug and human and who-knows-what-else smuggling into the US, but he refuses to put one forward. All he does is throw lawyers at Arizona. Mr. President, Arizona is suffering enough already.”

6/22, B. York, Wash. Examiner, “Kyl is not backing down. “What I said occurred, did occur,” he told an Arizona radio station. “Some spokesman down at the White House said no, that isn’t what happened at all, and then proceeded to say we need comprehensive immigration reform to secure the border. That is their position, and all I was doing was explaining why, from a conversation with the president, why it appears that that’s their position.”"

I still can’t get over that large sections of Arizona have already been removed/closed from America due to uncontrollable illegal alien violence. Encouraging more of this is suicidal at best. I read the White House has been meeting with so-called religious leaders recently working out details on amnesty…

    Outstanding.
Can someone…anyone explain why we have not pursued the impeachment of Obama? Why has Everything been dismissed, gone under the rug and forgotten? I mean it is like EVERY day..something else…
This guy makes Clinton look like an armature. He ain’t just stealing a car, he is taking Detroit!!!!
    Teflon + Astroglide on steroids..

there’s a Democrat majority in Congress, or haven’t you noticed. If we were to take Congress back in November, maybe. But not before.

a blanket amnesty by exec order. But agree with you re the liklihood.

We all want him gone, but we do not waste our time on useless rhetoric. Ignorance, incompetence, being a POS are not grounds for impeachment. In fact, I think that those who keep up the cry for impeachment are doing as much damage to our cause as birthers and thruthers and need to be removed from our ranks. We have plenty of legitimate things about Obama and even more concerning his mass of failures that we can keep in the minds of voters that will get him out of office in 2012 without resorting to bogus calls for impeachment.

        comes to mind.

When you can come back with list of 67 names of sitting US Senators who will vote for impeachment of TheBoyPresident™ write a diary. Until then drop it. It’s not happening. Welcome to the real world.

We can beat him on the issues. If we do that, there’s a good chance the Left will lose enough credibility that we won’t have to fight this battle again – at least like this – for a decade or two. We had the opportunity to drive a stake thru their smarmy hearts with Clinton but Oh-Too-Righteous jumped on the opportunity to impeach him. All they did was make a folk hero of him.

We need to beat the agenda as well as the man.

Treason is a serious charge: I hope you’re prepared to back it up with proof.

And like Mike said, there’s no way it’ll happen in the real world.

      • Flagstaff

Impeachment is something that is reserved in real life for offenses that are clearly provable, not necessarily illegal but that violate the oath of office, and which seriously violate the public sense of allowable Presidential behavior.

When Obama reaches that point, even the MSM will be calling for his removal. But until then, fuggedaboudit.

Clinton’s impeachment failed because his behavior didn’t violate his oath and wasn’t considered by enough of the public to be a serious behavioral transgression.

how about even prosecution at a lessor level…cite him. electioneering bribery….. aw heck we can’t even give him a parking ticket.

Here’s Arizona’s Gov. Jan Brewer, on June 28, 2010, explaining the pathetic response of the Opuppet Administration to Arizona’s request that the federal government actually secure the Arizona – Mexico border:

    For Liberty,

Conservatives, UNITE! CHANGE the Republican Party and save the world by UNITING INSIDE the Party as precinct committeemen. NOW! (127 days until Nov. 2 — what are YOU DOING to help get out the vote in your precinct?)

Obama will be holding himself hostage when the border blows……

Here are some hints for the governor….

Trip wires, snakes, scorpions, trap doors….just a few ideas to work on.
