I Refuse to Obey the Law

What's good for the goose...

In yet another demonstration of contempt for the rule of law and the separation of powers, the Obama administration has announced that it will no longer enforce our immigration laws.  Secretary of Homeland Insecurity Janet Napolitano proclaimed in a letter to the Senate that she will suspend deportation proceedings and grant amnesty to those who ostensibly fit the criteria of the Dream Act – a bill that was defeated with overwhelming bipartisan support of Congress.  Hence, Obama is publicly declaring that he will ensure our laws are not executed faithfully.

This unprecedented abdication on the part of the president begs the question – what sort of message does this convey to our youth regarding the inviolability of the rule of law?

What other laws will this president refuse to execute faithfully?  Will he direct the EPA to enforce cap and trade, or instruct the DOI to block the issuance of drilling permits?  Oh, he is already doing that.

And, most importantly, if the president is above the law, then why should any of us be compelled to adhere to laws that we regard as undesirable or unfair?  If Obama can refuse to enforce his core constitutional duties, why can’t we disregard his individual insurance mandate – a law that is an anathema to the constitution?

Ironically, the very illegals that remain in the country as a result of Obama’s shirking of his constitutional duties, will receive healthcare benefits from the unconstitutional Obamacare.  Remember when Obama claimed that illegals would be barred from those benefits?  Well, as Congressman Joe Wilson so presciently and succinctly declared, “YOU LIE.”  I guess the real question is this: does an illegal have the authority to opt out of the individual mandate?  Or can they play both sides of this lawlessness?

Not only has this president refused to uphold our immigration laws; he has thwarted the states and law enforcement agencies from doing so.  He has taken the unprecedented step of siding with foreign nations and suing two of our states for upholding the laws that he refuses to recognize.  This is the most profound and dangerous form of extremism in our government today, as it undermines the very core of our political system.

What if citizens would stop paying taxes, or refuse to participate in Social Security?  If the executive branch can countermand a law of Congress, why can’t the voters – those who grant Congress its authority – do the same?

This administration is setting a dangerous precedent.

Congress must reassert its constitutional authority over immigration law.  They should hold public hearings and shed some light on the darkest corners of this administrative power grab.  Additionally, as part of any budget negotiations for the FY 2012 continuing resolution, Republicans should ensure that no funds are allocated for the joint DOJ-DHS task force charged with granting these administrative amnesties.

This extreme president is beneath contempt.  He must be stopped.

Or what else does he have to do.

I really wish the GOP had even a hint of a spine. This fraud needs to go. He really thinks he is above the law

      • snowshooze

Now if we impeach, we roll the dice. There is absolutely no way it could get better for us as it is.
We can keep Obama hamstrung and high centered… we can block him on anything we choose… if our boys hold the line.
But if a new kid hits town, well… that is awfully hard for the establishment to make odds on.
        That is what I see.
Make Obama stay in office, and make him hate it.

        • larueladue

You are saying that we need to selectively enforce the law (impeachment), so that we don’t get someone/something worse. That should not factor in at all, if you really believe in equal enforcement of the law. Subsequent consequences don’t factor in: if he has violated the law, he needs to be impeached.

And I don’t believe that we would get something worse if he is impeached. The simple example of doing so will serve as a deterrent for further shenanigans. If not, it can be done again…

          • snowshooze

He actually needs to be imprisoned.

          • larueladue

Rinse and repeat… it will be like washing a dog after he gets sprayed by a skunk.

          • renl57

because the Dems control the Senate. They will refuse to conduct a trial of Obama.

All impeachment does is damage the GOP’s momentum by having them work hard for what will in the end be a flop. Nothing succeeds like success, remember that. Not failures in a good cause. Only successes.

The U.S. will survive the next 17 months. Let’s keep the momentum going and use this issue against Obama and any Dems who dare to support him.

One way is to simply point out to the voters that without a flood of votes from Hispanic families of illegal aliens, Obama’s re-election chances are nearly nil, based on the latest polls. And hence Obama is flouting the law, not on principle, but just to get more votes in 2012.

That could be the end of his re-election bid.

          • Tbone

as opposed to a nation of laws?

          • larueladue

Laws are supposed to be there for a reason, and need to be equally applied to all; not selectively applied based on who it is, on political expediency, or on whims and convenience. We pride ourselves on being a nation of law.

It doesn’t matter if a conviction is achieved: if you think that a law was broken, take it to trial and find out. That is the purpose of a trial. All this talk of not wanting to impeach based on “we cannot win a conviction” is wrong-headed thinking. If it appears that a law or laws were broken, bring charges, and find out. That is the system.

You either believe that all are equal to the face of the law or not. There is no middle ground.

If the law is bad and should not be enforced, get rid of it; don’t skirt around it.

          • larueladue

A line needs to be drawn in the sand to show the limits on what the people will put up with, regardless of the consequences.

(However, realistically, I fear that it is now too late to be of much lasting consequence… we are way far down the wrong road.)

  • gekster

then why am I forced to.
Traffic laws, don’t care, they don’t apply to me.
    Stealing, don’t care. I take what I want and I don’t care.
I could go on, but I do have my eyes on that Mercedes at the local dealer down the street.

      gets defiled.

It will take us months to cleanse the land from all of the defilement after we throw him out in November 2012.

He certainly is the “highest”. Not in stature, but from hitting the pipe.

Seriously, what is the recourse for law abiding citizens for this treason???

Looking forward to hearing Perry go on the attack about this issue. His Bernanke comment should pale in comparison.

    And where is the MSM?

Oh yeah, chillaxing on Martha’s Vineyard with Owebama.

    He is a monster.

  • Menlo

You think he has until this followed the Constitution and every statute on the books? He and many of his appointees and supporters have been just as defiant.

It should not come as any shock.

  • snowshooze

Sure… it’s hopeless, He could fall on his sword, for a cause approved by the Progessive Liberals.. yeah, goin’ down fighting the good fight…
Then either impeached, or gracefully step down..
And then enter Hillary, or some other Democrat with a chance.
Carville? I don’t know who they got.
You think someone might slip him a few million to take a walk?
But this stunt might be the long game.

and the Dem Party can’t alienate its most loyal group of voters (blacks) by cashiering The First Black President ™.

If the Dem Party did that, it would cause a party split along racial lines that would wreck their party as badly as Vietnam did in 1968. The GOP could even nominate Ron Paul and win.

  • tritonspolartiger

Given that allowing illegals to accumulate within our borders only increases the strain on society as a whole, I’m beginning to conclude that this is just another in a whole galaxy of straws being stacked on the back of the American camel.

What I fail to see how this sort of thing increases his chances of re-election.

Is this man simply a rigid Marxist first, last and foremost, and hence incapable of operating counter to his belief system? I suppose that’s as much of a possibility as anything else…

Much harder to believe, much less comprehend, is the possibility that his intention is to impoverish the vast majority of the middle class in order to force an overt push-back from a significant percentage of the citizenry at a time when our personal wealth and strength (i.e. our ability to aggressively resist) is nearly depleted.

Does he have the nerve to institute martial law, etc, in “response”, i.e. no election in 2012?

Is that man that evil ?

And if he is, what can we do between now and 2012 to thwart any such action?

    God help us all.

    • renl57

New Mexico, Colorado, even Texas are states with huge Hispanic cohorts.

Look at it this way: Hispanics make up 9% of the voters. Blacks make up another 13%. Obama cannot win in 2012 without most of the votes from these groups. Blacks he’s got because he’s black. Mexicans he won’t get without doing more on immigration.

“The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.”

Our rule of law will only fall apart if we let it. Obama could fire these people himself, it is the only responsible thing for the President to do, but I wouldn’t count on him doing anything for the good of the country that isn’t in his own personal interest. We don’t have to go after him though, because it wouldn’t do much of anything to change the situation; Biden likely would not do the necessary firing. The key here is in “…and all civil Officers of the United States…” We don’t have to have Janet Napolitano. Even if the point of her extralegal activities would become moot late next year before we get anywhere with it, it is worth making lots of hay given the sorry state of financial affairs and the reasons behind this kind of behavior. They deserve to have this backfire on them in a huge way, and we can set an example for what happens to civil officers of the United States who disregard Congress.

Go ahead, do the bus tour. Show us what you got.
But you can see as good as us, you have done everything you can.
Oh, well of course, we still love you, but you can’t do any more, heck, we couldn’t even ask for more. Kid, you are all aces.
We’re gonna put you in the history books, a hero. Nobody else could have pulled the job the way you did.
But now, we gotta look at the party. It’s froze up. We spent every drop of leverage you had, and our boys we lost in the house, well, they wouldn’t want to see it lost.
So here’s what we are gonna do. If that tour goes about the way we think, and that old magic just won’t come, well..
We have a little nest egg for you. Really, it’s nothing. And we have this cause, the most honorable cause, the poor trodden illegal immigrants.
We won’t ask you for another thing, kid..
You go out there and fall on your sword. It’s for the cause.
We got Hillary all up to speed. And a couple other fine boys.
You know, it’s for the party.
Yeah, we know…they will try to impeach you… but don’t worry, we can fix that too. You just pull a Sarah Palin, and step down for the good of the party. It’ll show the people just how much you love the country… really, it’ll be better this way.
Oh, yeah, well while you are on vacation, with the family… think about it some.
Yeah, well… 20 million, it ain’t what it used to be, but we will make sure you get some side work and perks.
We just don’t see how you could possibly refuse this modest offer…ok?
Now remember, we are going to need some endorsements, and a few minor things…. oh no…nothing of consequence… just the usual stuff..
Oh, well, that’s great. We knew you would understand.
    Have a nice vacation..

I live in rural Georgia. The only reason you need to know that is to make you understand that i’m very familiar with that ‘deer in the head lights’ look. I have seen that look a LOT on people everytime he pulls something like this, and my question is WHY SO SURPRISED? The only thing obama has ‘faithfully’ done since he took the oath of office is to dismantle, by any means possible, our constitution. And everytime he tugs on another thread, unraveling the very thing that has made this country great, we are once again amazed at his audacity. He is guilty of SO MANY impeachable acts, the only question that remains unanswered (to me) is why the deer in the headlights look. Lets impeach this traitor and get on with the business of putting the America we all love back together!

    • snowshooze

      Don’t play into their hand.
They WANT us to try it.
They want it so bad they are throwing it in our faces.
      Begging us.
Hell, if I was in their shoes I would do it too.
They have milked everything out of Obama they can get.
But if they hit the refresh button… NEW GAME!!!
      Watch out for land-mines.

this period will be the most shameful in our history.

I don’t care if, in 20 years, we are as free as we were in 1799, if we are as prosperous as we were in the 60s and if we are as strong and feared militarily as we were in the late 80s and early 90s – this period will go down as the most shameful in our history.

    Why?

Because of the cravenness of our leadership and much of our population.

When Obama screwed the Chrysler bondholders, virtually nobody – lawyers, judges, politicians – stood up for them.

When Obama was ramming thru Obamacare, Mitch McConnell went home for Christmas. Old McConnell also bent over during the ’10 lame duck.

When Joe Wilson yelled ‘you lie’, he backtracked and apologized.

John Boehner, Eric Cantor and the rest of the ‘leadership’ in the GOP House have been shameful on the CR, the debt ceiling and light bulb ban.

Our own conservative media can’t even effectively hold our elected officials accountable or invoke enough fear in them to cause them to heed our desires. They’re scared of something…

I remember that Socrates thought that a political society was just a reflection of the typical citizen in it – the man writ large. So the leadership reflects the people.

Are we a nation of cowards as Eric Holder suggested? Time will tell. If we are, we will get more of the same and we will lose all our freedom. If not, we will regain what was lost.

If we do regain what was lost, we had better let the shame burn so that we never forget and so that we prepare future generations with the means, motivation and fighting spirit to resist this type of trash in the future.

You will find the story, “Rule change may shake up immigration,” which is written with the usual slant and “blinders on” perspective. Of course the writer doesn’t discuss the Constitutionality the administration’s maneuver because CNN is not interested in the law or the facts; just social justice, which is pure ignorance.

    • Ausonius

That is the lament from the John Adams character in “1776.”

“Jeff Cooper” shows us the essence of the problem: people are not being informed. Certainly the MSM will not do it.

Who is informing the American people of what is happening AND WHAT IT MEANS?!

Where are the Republicans? Where are all the Republican governors, and every Republican Senator and Representative, Federal and State?

Why are they not banding together and shaking the rafters about this?

This contemptible violation of the Constitution by the MAObama Administration should cause a clarion call to action and outrage: but the Republicans’ silence is cotton in the ears and chains around the neck and feet.

Which is why I had to laugh ruefully at this line from above:

“This unprecedented abdication on the part of the president begs the question ? what sort of message does this convey to our youth regarding the inviolability of the rule of law?”

The problem is: HOW will “our youth” or anybody else even know what has happened? Or understand why it is important?

  • runner12

Even coming from this administration. These people have no respect for the rule of law or the Constitution. If I were a GOP Presidential candidate I would use this to destroy Obama as another example of the gross and unprecedented overreach of power by the Executive Branch.

If only we had people in Congress with guts enough to go after Napolitano.

  • http://www.firstchevalier.com Mark Malcolm

I’d like to suggest the radical idea this has been ‘The Plan’ all along.

Let Obama get as much of the Liberal/Socialist agenda implemented and in place.

‘Go as FAR as you can son, because until the American People get outraged at you, you’ll get as much as we want done, done.’

If we don’t impeach him, he keeps building the socialist machine. When we do, Biden or Hillary steps in and says something like, ‘Wow, I had no idea he was so anti-America, but I’m not like that’. Then they keep on building.

    • renl57

From The American Prospect, an online left-wing rag:

“To learn how to apply the 50-state strategy to building not just a larger but a more progressive Democratic Party, [Ari] Berman turns to Texas, where a burgeoning Hispanic population in the Dallas area is changing the state?s political landscape, electing an openly lesbian Hispanic, Lupe Valdez, as sheriff and sending the promising young Rafael Anchia, known as the ?Hispanic Obama,? to the state Legislature. Berman?s reporting suggests that immigration reform?including a path to citizenship for the undocumented population in the United States?should be considered one of the most urgent political priorities of national Democrats. The Hispanic population is progressive not only on immigration issues but also on labor rights, economic justice, and health care.”

  • radicalrighty

Drug-dealing past rumors notwithstanding, I think Obama has taught “our youth” plenty about lawbreaking with his beloved ACORN.

  • paulplantowin

If someone breaks the law, do we then analyze the possible pros and cons of enforcement? The whole idea of doing an assessment of the possible political up or downside of enforcing our laws says to me that we are simply morally insane.
If the head of homeland security wrote this letter, she needs to be held accountable for it. Start there, and Obama can fire her or seek to defend her. Whatever the legal fine points are, this needs action.
If this slides by the guilt will belong equally to both sides.

  • Locked and Loaded

Young people are great learners, far better than the older set. They learned a lot from Bill Clinton, and they are learning from Barack Obama (hedonism and narcissism certainly have their temporal rewards). They have also learned a lot from the squishy, spineless, lukewarm among us. It is this latter group that I think most anybody, more than ANY other group, would not want to emulate.
So young people are left very much in need of another example.

What the young and impressionable do with the lessons they see played out before them is yet to be seen, but it is very clear to me why righteous leaders are much to be desired.

  • Common_Cents

This is not a leadership decision. It is a campaign decision.

  • victrola

What has happened to our country?

I honestly couldn’t believe this news when it first came across. How on Earth does this man average a 40%+ approval rating? Why isn’t the GOP running all over this, it will outrage the overwhelming majority of Americans. With a 9% plus unemployment rate he’s halting deportations with a back door amnesty?

I will say though the talk of impeachment though is non-starter and will only strengthen Obama, and it’s not like Biden in the White House will be any better. The American people need to toss them out through an election.

My big fear though is the GOP will stay silent on this because for some crazy reason they think being lax on the border translates into Hispanic votes (from illegal aliens that can’t vote anyway?)

Nothing could be further from the truth, if you want to win elections, try appealing to Reagan Democrats in the Rust Belt. Let’s see how many votes this translates to in places like Pennsylvania, Ohio, Michigan, etc.

  • snowshooze

Soon as I heard about it.. I figured the entire Congress would head back to town with torches and pitchforks. And MSM would be everywhere.
I guess everyone is on vacation.
I know, it broke just before the weekend, but if I were a reporter, I would be chasing down every Congress-critter I could find and dragging statements out of them.
It looks like a cut and dried case of refusing to uphold the law.
Could a private citizen stand a chance in a court room against the President?
What else do you know about this now?
Thanks for putting this one up.
