Obama’s Imaginary Senate Recess

Yesterday, Barack Obama engaged in one of the most unprecedented assaults on the Constitution.  He appointed Richard Cordray as the first chief of the Consumer Financial Protection Bureau and named three new members to the National Labor Relations Board, even though the Senate did not approve them and is not in recess.  Obama employed absurd casuistry to suggest that the Senate has in fact been in recess for weeks:

Here are the facts:  The Constitution gives the President the authority to make temporary recess appointments to fill vacant positions when the Senate is in recess, a power all recent Presidents have exercised.  The Senate has effectively been in recess for weeks, and is expected to remain in recess for weeks.  In an overt attempt to prevent the President from exercising his authority during this period, Republican Senators insisted on using a gimmick called “pro forma” sessions, which are sessions during which no Senate business is conducted and instead one or two Senators simply gavel in and out of session in a matter of seconds.  But gimmicks do not override the President’s constitutional authority to make appointments to keep the government running.  Legal experts agree.  In fact, the lawyers who advised President Bush on recess appointments wrote that the Senate cannot use sham “pro forma” sessions to prevent the President from exercising a constitutional power.

You might have been at the golf course on December 23, Mr. President, but here are the real facts.  On that day, during a “gimmicky” pro forma session, the House and Senate passed a sweeping tax extenders bill, which granted tax cuts to almost every worker, unemployment benefits to millions of the jobless, and reimbursement payments to hundreds of thousands of healthcare providers.  That is much more consequential than a few agency appointments.  If Congress can do all that during a “recess,” they certainly have the ability to advise and consent on a handful of executive branch nominations.

And if a pro forma session is indeed considered a recess, can we now vitiate the ridiculous two-month extenders package?  What if Congress would send you another stimulus bill to sign during a “gimmick” pro-forma session; would you reject it?  As you know, Mr. President, many consequential things can occur during those few “seconds.”

Update: House Democrats seem to disagree with Obama.  They held a press conference calling on Republicans to come back to Washington and join them in working on the conference committee for the extenders package.  That’s some recess going on there.

    This is a complete and utter joke. The sad thing is, we can do little about it, other than using it as a political tool. The courts are not going to dive into this in any sufficient manner, so basically the Obama imperial presidency will stand, until we do something at the voter box.

      Cordray HAS to be confirmed by the Senate as it is in the law that was passed and signed by the President. So anything that clown does is illegal period!

      As for the NLRB picks once those labor goons pass something that hurts someone then they have grounds to sue and the courts will then have to address this “recess” appointment. I am sorry I have seen some arguments that look OK but the issue is the President doesn’t get to decide when another co-equal branch of Govt is in recess! Just like he can’t go over and tell the Supreme Court what cases they have to take!

      Sadly since Prince Harry cares not for the Consitituion the only useful tool the Congress has to reign in this President (Impeachment) will not be used. Besides the process of Impeachment might actually help get Dear Leader Obama re-elected.

      Now with this being said it is TIME for the Republicans to QUIT playing by rules and being all gentleman about things and START using these TACTICS against the Ds to teach them WHY these games are bad. I would use every procedure/flim flam method ect to strip the Feds of so much Gov’t that the Congress would impeach me within the first 6 months if I was President. Kind of a Andrew Jackson assult on the Congress. Fire all the hacks in the Federal Govt and say see you in court to work out the details on whether I can do it or not. Move those Justice Department flunkies (Holder’s gang of thugs) out of their offices and into some tents on the National Mall until they QUIT! Whatever it takes to return the power to the States and the people. Every bill the Congress passed that I disagreed with better come with VETO override majorities, if just one stinkin word is out of place I would want to slap the Veto stamp on it before the Speaker can slam the Gaval down.Oh and just to make it perfectly clear on where I stand I would make sure EVERYONE knows I can care less about a 2nd Term. If I should win a 2nd term it will be because I am successful at demolishing the Stateist Agenda.

      Then again I wouldn’t be President and reality is you have to work with the Congress to actually get things done but one can dream.

    Obama’s is now gun-shy. I predicted he would make the appointments before he landed in Hawaii for vacation. Yet, he waited days to do so. He’s getting soft.

      He picked yesterday on purpose. He can keep his hacks if he wins this battle until 2013 and by insuring the Senate wasn’t between sessions he ignited this fire so he can show us he is fighting against the evil people protecting us. Just wait we shall see a new Speilberg flick starting Obama standing on a hills with blood and sweat rolling down his forehead with the people standing behind him while he leads us to the promise land. Hang on let me check something, nope this is 1930′s Germany or Russia but sure feels like it with this clown at times. Just wait until he decides I need to go for “re-education” because of “thought-crimes” and thanks to our glourious Congress they just gave him the power to do it, nevermind that some provision within the new law MIGHT prohibit it as if you haven’t Learned yet Barack can’t read and isn’t bothered to read all the little details anyways he rather just go fight with the Robert’s court which is even better as they are part of the Evil Wall Street thugs he is saving us from anyways.

    If they had the b-lls to do it, couldn’t Congress just de-fund these Anointed positions? If they have not working capital, how much damage could they really do?

    If it was illegal then what the hell are the Republicans going to do about it besides complain on TV ?
    I was under then impression that there was some sort of “checks and balances” thing worked into the Constitution but I have yet to see this new Congress roll back anything the President has done.

    It doesn’t matter what Obama or anyone in the executive branch thinks. The only people who can decide whether the Senate is in recess or not is the Senate.

    And on top of that recess appointments are an anachronism that should have been abolished long ago.

    This statement:

    I thought the Dems controlled the Senate. How are the GOPers able to set the Senate schedule? Was there an election that I missed? Or do I just not understand how the Senate works (which is very possible)?

    I’m just unsure why these pro forma sessions are the Republicans fault.
