The Magical Word “Women”

If we’ve come to the point where Republicans believe that dealing with domestic violence is within the purview of the federal government, we should just stick a fork in the party.  Yet, not only do Republicans in the House plan to reauthorize the wasteful and politically-motivated Violence Against Women Act, they plan to pass the Senate version (S.47), which contains egregious anomalies.

The Senate bill expands “coverage” to men, homosexuals, transgendered individuals and prisoners.  It expands the definition of domestic violence to include causing “emotional distress” or using “unpleasant speech.”  It ostensibly nullifies the legal presumption of innocence until proven guilty.  The bill also expands the law’s reach to give tribal Indian authorities jurisdiction over non-Indians accused of abusing Indian women.   Finally, what good is a social engineering bill without tossing in bones to the most sacrosanct constituency, illegal immigrants?  It would grant more visas to illegal immigrants who are victims of domestic abuse.

Last year, the House passed a version that was, more or less, a clean reauthorization.  That was the best we could expect from them.  But now, in the hopes of not being outbid in gender warfare, they plan to bring the bill to the floor in a way that will ensure the Senate bill passes.

Yesterday, we spoke about the lack of leadership in the Senate to block bad legislation from coming to a final vote.  This is a classic example of how the Republican minority in the Senate empowers Harry Reid to jam the House and pressure an already flaccid House leadership to acquiesce to abhorrent pieces of legislation.  Several weeks ago, half the GOP conference voted for the juiced up version of VAWA.  Now the House has decided to throw in the towel.

Folks, we live in dark times.  The Democrats are more radical (and successful) than they’ve ever been, yet there is virtually no opposition to anything they do.  All they have to do is insert the word “women” into the title of a bill, and they win the battle without firing a shot.  The sad irony is that this comes at a time when the radicals are promoting women to serve in direct ground combat, an absurdity that has already and will continue to promote real violence against women – both at war and at home.

Later this afternoon, the House will take up the rule for this bill (H Res 83).  If the House fails to pass the regular version of VAWA, the rule automatically triggers consideration of the Senate bill.  Once brought to the floor, the Senate version will pass because all the Democrats will support it.  Some conservatives might feel inclined to support the “clean” extension, lest it be voted down in favor for the Senate bill.  However, the reality is that GOP losership is hell bent on getting this thing passed instead of engaging in a real philosophical debate.  Even if they pass the clean bill, they will just appoint conferees to a conference committee that will insert all the onerous provisions from the Senate bill into the final version.  That’s why the default position is to stand on principle and vote the entire bill down.

In fact, as Erick pointed out yesterday, this is one of those examples where conservatives need to take down the rule.  Yes, they should vote against this ridiculous rule, which is politically motivated.  There is no reason they should be considering this bill anyway.  Why is a GOP-controlled House taking up leftist legislation instead of bills to block grant Medicaid, repeal ethanol mandates, or reform the Fed?  Even if they choose to bring up bad legislation, they should do so under an open amendment process.

Call your member of Congress and ask him/her to vote down the rule on this unconstitutional federal power grab.

    The GOP has never found a message to counter the idjit Dem. “war on women” and still thinks, as Bush did, that if it passes halfcracked leg. somehow th NYTimes will view Reps. kindly. We have seen how that worked when Bush wanted to be the “ed. pres.” and promoted Kennedy’s krappy No Child Left Behind, that just increased the DOEd budget, gave more power to bureaucrats, and has done nothing for students. And the prof. ed. establishment hated the whole deal because Bush wasn’t a Dem.
    Reps. should emphasize that in free markets and capitalism, women have more freedom and protection, run rights, and self worth, than anything the left offers which is right now dog whistles and call boxes to prevent rape.

      “The GOP has never found a message…” says it all. The more I think about it, the more I’m convinced Codevilla is right that the majority of Republican voters have been abandoned.

        I agree with one small caveat. The GOP had found a message and it was NO, without any opening to dialogue and compromise, and now we are paying a terrible price. The American people want compromise, not one party rule. We’re a republic and not a dictatorship. I think some of our friends here would like to have absolute dominant control without anything from the left.

        To me that’s immature politics. And don’t get me wrong, I’m as conservative as the next person, but, perhaps because I’m older, am highly disappointed with the strategy the GOP has executed since Rove took over the helm. Identifying wedge issues and using them may win you elections in the short term, but in the long term you become not a party of vision for all of America and you are rejected.           Principle Must Trump Compromise!

          If we have no better representation than Boehner who can STAND UP, clearly, succinctly articulate the reason “NO” is necessary, then we are dead anyway! I pray another “Cruz” will rise in the House with an intelligent, clear voice!

          Please, don’t post “BOEHNER FRIENDLY” compromise nonsense on RS.

          It is simply roll-over-play-dead defeatism!

    This is now a stable pattern – Dems want something, we oppose it, we delay it, Dems stick to their guns, public opinion turns against us (or at least is perceived to do so), we cave, Dems win. VAWA, Hagel, Debt Ceiling, whatever…

    What’s the point of taking a position if we consistently give up on it. Might as well have capitulated right at the beginning and saved everybody some time. We need to break the pattern – that much I know – how I have no idea.

      I believe we must concede, up front, that Dems have power because we lost both the White House and the Senate. We must engage in a dialogue and work to get the best legislation we can. The only reason the Dems are winning so strongly is because we are doing ‘our way or the highway’ and we have no real power beyond blind obstruction which then gets judged by the American people, flips polls and then scares leadership into complete surrender. Talking with the Dems is not a crime since they are in control. That is not surrender or being a Rino, it’s common sense and politics 101.

        Are you John Boehner? Starting by saying we lost this or that so we have to compromise is a slap in the face to every American who took the time to vote. You’re nullifying scores of elections. Compromise? That’s what the Bush crowd did for 8 years which resulted in the destruction of this country, the destruction of the GOP, the destruction of lifetimes of work and sacrifice, and the permanent threat of violence by radical leftists in every aspect of our lives. We lost but not in the way you’re implying. Angelo Codevilla has explained it perfectly. I don’t take orders from people who destroyed this country and haven’t had the decency to retire from public life in shame. We must use every bit of power we have to save this country.

    Be sure to thank the 9 in any way possible (phone, e-mail, tweet, post on their facebook) for making this courageous vote. Female extremists are going to be hitting at them, so we should let them know that they (the 9) have our support.

    Daniel, you hit a cord with Mark Levin who gave you major kudos on his show tonight- congrats! This bill is beyond Constitutional and and the rule vote bypassed normal order of the committees. We must stop this bill from passing.

    I was so outraged by the bill after hearing Levin and before reading your excellent post, I wrote to my Congressman, who happens to be the Chairman of the Rules Committee and hope others light up the switchboards before this is voted on tomorrow.

    “URGENT: Please vote against the VAWA Bill that is unconstitutional and violates the 10th Amendment. The states are responsible for these types of laws and enforcement. And since when does the federal give “rights” to illegal aliens?

    Since you are the Chairman of the House Rules Committee, I’m appalled that you would allow this vote to occur since many House conservatives objected to the leadership’s decision to bypass committee consideration and bring the bill to a vote on the House floor. Being that the rule passed with 100% the House Democrats is enough to tell me this is a very bad bill. We need regular order including allowing bills to go through the various committees.

    It now appears that the House will pass the Senate VAWA Bill and that is a disaster. This is NOT leadership and the House is severly lacking in upholding conservative values and the Constitution.
