Pride, the Fall, and Barack Obama

The Houston Chronicle is reporting the Netherlands, a experienced oil producing nation, offered the United States help in dealing with the British Petroleum spill very quickly after it started, but the Obama Administration turned them down, opting instead to coordinate with BP to stop the spill and contain the damage.

Made worse, with the Obama administration threatening criminal and civil prosecution of British Petroleum as well as Obama refusing to keep open communication with British Petroleum’s CEO, the coordinated efforts of the company and government could go nowhere with no one talking to each other.

Compounding all of this is a U.S. law “that requires all goods be carried in U.S. waters by U.S.-flagged ships, … prevent[ing[ Dutch ships with spill-fighting equipment from entering U.S. coastal areas.”

Barack Obama wanted so hard to run from this disaster lest he be forced to accept responsibility for it has led to untold ecological and economic destruction.

Not questioning Erick, but, are we to believe that every container ship bringing goods into all of our ports (and, obviously our coastal waters) are US flagged ships?

That’s kind of ringing in my ears………

Its not like there’s ever been any restraint from breaking/not enforcing these.

That struck me as odd too

DerKrieger (Diary) Wednesday, June 9th at 10:47PM EDT (link)

There are almost no US flagged ships any longer due to the high taxes and fees for registry. There is simply too much inbound freight, and empty outbound ships, for them to all be US flagged.

“Between US Ports”. If a ship docks at a foreign port then a US port that’s OK. Only when going from 1 US port to another US port with no intervening foreign port is a US flagged ship required. Cruise ships generally return to the same port, therefore don’t go “between” US ports.

OK, Jones Act 101 and its analogs in other places:

Achance (Diary) Thursday, June 10th at 1:28AM EDT (link)

Any ship engaged in trade BETWEEN two US ports must be an American bottom with an American crew, usually that means a union crew. Now does it all make sense?

That's where I was going, Achance.

blooch Thursday, June 10th at 2:20PM EDT (link)

It must have something to do with Chertoff’s waivers after Katrina, and why Obama is dragging his feet on waivers now. I guess if Dutch ships had showed up to work, they would have had to dock here at some point, and returning from open sea to a possibly different US port, or even the same US port they originally docked in, would have been problematic for the unions.

US Cargo

eheassler Thursday, June 10th at 11:05AM EDT (link)

I believe that the law requires cargo that originates within the US and is delivered within the US to be carried on US flagged vessels. In the trucking industry, US licensed trucks can pick up in the US and deliver in Canada or pickup in Canada and deliver to the US. Trucks licensed in the US cannot pickup in Canada and deliver in Canada. The converse applies to trucks licensed in Canada. I believe the maritime version of this law to be similar.

“Not questioning Erick, but, are we to believe that every container ship bringing goods into all of our ports (and, obviously our coastal waters) are US flagged ships?”

If the US government is financing it or buying it, it must travel on US Flagged Vessels. That is the Law – every US Eximbank financed good must travel on a US Carrier. The exception is if no US carriers service the destination port. That is the law. Apparently, the US Maritime Union is stronger than the Teamsters.

Pride or Arrogance?

wolfster38 (Diary) Wednesday, June 9th at 11:54PM EDT (link)

Obama believes that he and he academics have all the answers and need no one else to tell him how to fix any problem, In Obama’s eyes he himself is perfect. In his arrogance he will let a problem mushroom out of control and point the finger at others and when and if the problem is solved he will take all the credit for the fix. We have all worked with people who when a problem arises will say “They don’t know what happened it’s not my fault” When they created the problem themself, never willing to say honestly that they made a mistake but are more than willing to take the credit for the fix even when it’s not their idea. Understand this, Obama knows he’s the weakest president in American history and will never admit to making a mistake because he justifies mistakes in his own head as the right thing to do even if he knows deep inside that it was a mistake. His arrogance is a flaw he will never understand, but the poll numbers prove that more people are seeing Obama as he really is. Obama’s main flaw is he believes his own hype, He believes he was chosen by a higher power that he is a superman. Only kryptonite could hurt Superman and Obama’s kryptonite is himself and his arrogance.

Those Experts Are Talking

edintexas Thursday, June 10th at 7:47AM EDT (link)

Fox News Channel is reporting this morning that the experts are loudly pointing out that they did not recommend any “freeze” on deepwater drilling. They say the report draft which they signed had no mention of a 6 month freeze, which Salazar apparently claimed was their recommendation. What they did recommend was a short suspension of issuing NEW permits. They say they did not recommend, nor want, any suspension of activities associated with permits already issued, much less activity already underway.

Somebody’s telling “stories”. I took it from the reporting that the Administration may be claiming that they “misunderstood” the recommendation.

I am guessing, sketch the problem using and gathering the knowns, identify the possible solutions based on knowledge and experience, test pro/con based on chance of success and make a decision.

The Dutch skimmers

clintonformccain Thursday, June 10th at 3:33AM EDT (link)

They also ran afoul of EPA regulations. The way the things work is that they skim a layer of oil and water. Then, aboard the ship, there is a mechanism for separating the two. The oil is pumpped to storage tanks and the water is pumped back overboard. There is still some petroleum in the water, but so what when the goal is to capture an oil spill?

EPA regulations prohibit dumping any petroleum products into the Gulf, so the Dutch skimmers were barred. The EPA finally worked out a waver, but only if they dumped the water back in front of the skimmers. Idiots.

There’s another issue. These skimmer collect a lot of oil. With a concentrated oil slick, a feet of four ships can collect up to 100,000 barrels of oil per day. They work in rough seas and have been very successful with recent major tanker leaks off the coast of Europe and in the Gulf after the Iraq war. You don’t want to use dispersant. You want the oil to concentrate on the surface, the thicker the better. BP is facing a $4000 per barrel fine and would prefer that nobody ever be able to measure the oil.

If in fact the fine is $4000 per barrel, then the law...

MacAoidh (Diary) Thursday, June 10th at 12:38PM EDT (link)

…imposing the fine might be the dumbest ever written.

Why would you want to impose fines which discourage the company from reclaiming the oil? Why would you encourage the use of dispersants to waste the oil rather than collecting it and putting it to productive use?

Who’s responsible for such an asinine state of affairs?

Check out MacAoidh’s commentary on Louisiana and national politics at TheHayride.com

Fines

bytewench Monday, June 14th at 10:33AM EDT (link)

Fines for oil spillage were added to the existing Clean Water act in 1990 in response to the Exxon Valdez spill. The fines were increased in 1994 in order to keep up with inflation. This last was when the Republican Party controlled both the legislative and executive branches of the government (although control of the Senate was due to the VP having the tie-breaker vote).

That said, I think it’s no critically important to ask who’s responsible since this seems to be a case of the law of unintended consequences: the reasonable intent was to ensure oil companies were were held responsible for their actions. Something most people would agree with. The unintended consequence is it is in the oil companies’ best interest to minimize spillage estimates, and to remediate via dispersant vs. actually clean the stuff up.

Can't let a crisis go to waste

astrojohn8 Thursday, June 10th at 8:54AM EDT (link)

You can’t foment a crisis if you solve the problem too soon…

There are no accidents

rwehouston Thursday, June 10th at 10:49AM EDT (link)

“Never let a good crisis go to waste” is the progressive mantra. If you can’t find one, make one up.

While the explosion on the oil rig was most likely an accident, the destruction of the southern CONUS coast line is not. The enviroquislings will sacrifice the entire region to prove their point in order to crush any further attempts to drill off-shore. The DC quislings won’t issue the permits to allow the dredging of barrier sand bars and diverters, and with all their rhetoric, no significant action toward actually mitigating the spill and capping it off has been allowed. Much of the Army Corps of Engineers heavy equipment has been standing by for orders, and a lot of help both local and international has been turned away. Why? Because this is being done on purpose. That’s right, on purpose.

The complete destruction of the southern coastal economy to create more government dependent subjects is just an added bonus.

It is the anti-American enviroquislings own absurd policies that forced drilling in the much more dangerous deep waters, instead of shallower water where this would be much easier capped and contained. Culpability is plentiful to go around, but think about this: “what-if” the progressive infested federal agency that is supposed to be enforcing rules and regulations to prevent such a disaster is actually giving the oil companies “enough rope to hang themselves” so that the enviroquislings agenda can be proven? Statistically, it would just be a matter of time until a disaster occurred, and in this case the timing could not have been more perfect for them to prove their point.

Mark my words folks; even though the obama regime response has the appearance of incompetence, this is ALL by design. Ask yourself how sending a team of lawyers to contain an oil spill makes much more sense than taking a bowling ball to a fox hunt? Hear what they say, but watch what they do. You will be amazed at the difference.

Obama's competence

rwehouston Thursday, June 10th at 1:52PM EDT (link)

I have no illusions about Obama’s competence – he has none. He is just the useful idiot on point right now carrying out the will of Soros and the other leftist America haters who financed his ride to the Whitehouse. The unaccountable 4th leg of the gov’t, the Agencies, are the engine driving the leftist agenda and have been for some time. The EPA is the authority denying permits for burning, dredging barriers and diverters and approving the other resources needed to contain the damage as much as possible before it came ashore. The idiocy of denying the use of the skimmers before the oil reached shore is not only treacherous, its treasonous. If the states want to keep from being totally destroyed, they are going to have to take matters in their own hands and deal with the consequences in the court of public opinion. Results speak FAR louder than rhetoric. As far as I am concerned, the Federal government has proven itself completely broken and is continually working against the will of the people and the best interests of this sovereign nation.

Part of the “fix”, should the American public wake up in time, must also be to eliminate the leftist infestation in the agencies, and in fact get rid of some of the agencies altogether.

americancentinel Thursday, June 10th at 10:55AM EDT (link)

I agree with astrojohn8.

I don’t think Obama ran away from the crisis, rather I believe it was a strategic pause. I think they wanted the oil to reach the shoreline to incite public outrage against the oil companies. This crisis is folds perfectly into his agenda to pass Cap & Trade legislation.

Already we see the drill here drill now poll numbers severely reversed from only 8 weeks ago when 66% were in favor of increased drilling to today when only 25% want increased drilling.

I blogged about this days after the explosion and so far everything I expected is coming to pass.

suzanneatsuperior Thursday, June 10th at 12:56PM EDT (link)

of getting Obama out. Obama used the oil spill as his oyster, never letting smart people in to take care of this would have been counter productive to his agenda, cap and trade. As we can all see he let it go on far to long for now the damage is so bad it will never be ok. And take this idea alittel further does he even really care about what has happened to the Gulf or the people it has and will affect for a hundred years. NO he has proven that to US over and over. Obama will blame everyone else for this but the end game is his and his alone for letting it go on so long.

Comrade Obama, the Destroyer of Pensions

1689 Thursday, June 10th at 1:47PM EDT (link)

From the Telegraph UK: “BP’s position at the top of the London Stock Exchange and its previous reliability have made it a bedrock of almost every pension fund in the country, meaning its value is crucial to millions of workers.”

If Comrade Obama continues with his incendiary smears and reckless criminal investigation, and he ends up bankrupting BP and destroys the pensions of millions of people in Great Britain (throw that on top of 13 trillion in debt and smearing the law & order immigration coaltion as racists), he will prove to the whole world what we conservatives already know — that he is a reckless and dangerous man.

Never let a good crisis go to waste

The Obama Administration needed a crisis with pollution to push their agenda. Having someone mitigate the problem was not in their playbook.

A haughty spirit goes before a fall....

uhangtight (Diary) Thursday, June 10th at 2:57PM EDT (link)

and, Pride goes before Destruction.. that is the actual scripture; and, i think is more apt in describing Obama.

Haughty = scornfully arrogant
Pride = a high or inordinate opinion of one’s own dignity, importance, merit, or superiority, whether as cherished in the mind or as displayed in bearing, conduct, etc.

basically, pride as spoken of in this scripture speaks to placing yourself above God… I think that aptly describes Obama and his administration… I expect that Obama has moved from haughty to pride right about now…..

Gleefully, waiting for destruction at the polls in 2010 and 2012….

Regulations and Crewing Costs

movwater Thursday, June 10th at 3:48PM EDT (link)

“There are almost no US flagged ships any longer due to the high taxes and fees for registry.”

Actually it is government regulations and excessive labor costs. The crew size by law to man a US Flag is much larger than that required to man a similar sized vessel fagging most other flags. This is known as “feather bedding” like when US Diesel Locomotives use to require a “fireman” whose job it was to stoke the coal in the steam boiler. Additionally, US Flagged Vessels must use US Merchant Seamen at higher wages than seamen in other countries. I guess the US Maritime Union is more powerful than the Railway Workers Union as most Railroad “featherbedding” has ended.

For some reason, sentence #2 reminds me of an old Cheech and Chong skit:

Good guys / bad guys

livefreenh Thursday, June 10th at 4:05PM EDT (link)

I seem to remember one of those email re-forwarded things that told us that BP was one of the few companies who refused to buy their crude from terrorist countries. It told us that we should buy our gas from them. So if that is true, and if BP is one of the good guys, shouldn’t we do everything we can do to help them stop their losses? Actually, shouldn’t that be the case anyway? Obama and his administration are not trying to fix the problem. They are taking a law professor’s approach. That would be OK if the goal is to teach some 20-year-olds how to do something, but that is not the case here. To use legal terms, “Obama makes no claim as to suitability of purpose.”

INCOMPETENT

peter9810 Friday, June 11th at 12:59AM EDT (link)

Why are we debating maritime law? Exceptions can always be made.
Debate why, instead, would an inept individual with no leadership, business or military experience, turn away help from a friend of Our Country to help clean up an oil spill? That’s called the help the people of Louisiana really need right now. They offered!
Is he smarter? I don’t think so.
Arrogant? Elitist? Or just plain stupid.
What would you have done?
