Barack Obama Will Recess Appoint Donald Berwick

While Congress is on recess, Barack Obama will appoint Donald Berwick to head the Centers for Medicare and Medicaid Services or “CMS”.

Presidents tend to appoint controversial nominees with recess appointments because they otherwise can’t get the votes. Barack Obama has appointed a number of extremely controversial people via recess appointment when he otherwise hasn’t had the opportunity to name them czars — positions that don’t need congressional approval.

For example, Barack Obama named Kevin Jennings the “safe schools czar” bypassing congressional action. Jennings, who openly bragged about encouraging an underage boy to engage in a sexual relationship with a man who solicited the boy in a bus station bathroom, could never have been confirmed.

But for all the disgusting sordid stuff in Kevin Jennings’ past, Donald Berwick is far worse.

Donald Berwick openly wants to destroy the American medical system.

This quote from Berwick sums up exactly why Barack Obama is bypassing Congress to put Berwick at CMS:

“Any health care funding plan that is just equitable civilized and humane must, must redistribute wealth from the richer among us to the poorer and the less fortunate. Excellent health care is by definition redistributional.

Berwick has condemned the free market’s involvement in medical practice and declared the United States should be more like Britain, where some people die waiting in line for medical treatment.

Berwick also lambasted consumers in the United States for being able to get the care they want as opposed to need in the United States. He wants to fix this “problem” declaring, “That is for leaders to do.”

Barack Obama has foisted on the American public radical after radical. Donald Berwick might just be the most dangerous of them all.

  • Richard Mullins

He doesn’t get his way in Congress so he’ll recess appoint pieces of Crap to positions. He complained when Bush did but he loves to use this tactic for his sordid gain. More reasons to vote against every chance you get.

    A step closer to totalitarianism.

Because, if the answer is no, that’s a serious flaw in our system of government, and will have to be rectified by a Constitutional Amendment.

I am almost 110% positive that Berwick will screw things up so badly at Medicare that not even Satan will want him back.

a Republican please make some noise about all this?????

  • E Pluribus Unum

There’s nothing that can be done to stop the appointment of this despicable butt munch.

However, since it is practically certain that he will commit crimes from his new position of power, the chances are very high that he can get himself a perp walk, after the Republican House begins investigations.

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

The more things Change™ … the more they stay the same.

Obama is not interested in receiving advice – and has demonstrated on multiple occasions now that he will override the consent of the Senate if they don’t approve of his appointments. That is the mentality of a tyrant – as well as a rapist – which we see so clearly in people like Hugo Chavez.

Since Obama will not defer to the Senate (even with 59/100 from his party), why should our Republican senators defer to him on Supreme Court nominees – especially people like Kagan who do not submit to the authority of a written Constitution but only to the authority of themselves.

And you can’t vote out Justices in the next election. Why should we passively allow the establishment today of a permanent 4 votes for overthrowing the constitutional rule of law? That’s dangling over the edge of the abyss.

So, Sen. McConnell – how about standing up to the President and holding him accountable for his disregard for the rule of law and the separation of powers – staring with Kagan? Or do want to want until it’s too late – when all the governmental agencies are under control of anti-constitutional forces.

If we lose the Supreme Court, then it’s only a short path before we see Obama ordering the arrest of opposition leaders who follow his dictates, as we see in Kenya with the efforts of their govenment to steamroller in a new Constitution – aided an abetted by the U.S. leadership.

We see the evidence of the Administrations intentions most clearly as they’ve been repeated expressed in our foreign policy as well as in the attacks on dissenting views domestically,

“There are none so blind as who will not see…”

  • Joliphant

And offers not much opportunity for creative government. As far as I know there is damn little he can do about how medicare funds are dispersed and if he were to try he would have some of the most hypersensitive and politically mobilized groups in the country charging down his throat.

What CMS does have is an enormous amount of fraud, on varieties of levels and by the politically connected and the merely too clever for their own good. So what do you have ? A recess appointment of a communist to an agency that has titanic fraud problems ? This is an opportunity, let him stay in there a year and he can be tarred and feathered with problems he wasn’t even really responsible for.

  • izoneguy

    I don’t have enough money!!!

    Give me more money!!!!

People are dying because Congress won’t help me!!!!!

    Berwick needs to drop dead……

  • conservativecrusade

but he is not the first to do it this way. In fact, democrats are not the only ones who use this method of getting their choices to the place they want them.

My opinion is let him have this. Not going to stop it with a vote considering the democrat majority and the many spineless republicans we currently have in congress. Once this jackass is sat, it is just one more thing that will help us remove the cancer come 2012.

  • azred

The useful idiots will parade him around like a trophy from the new world. If they haven’t figured out what a complete pile he is for a president yet, they never will. The guy will be on the hit parade – likely lobbying to be the UN chief within a few years of his illegal removal from office in 2012.

We have the best healthcare system bar none in the world. that is about to change if we don’t defund, repeal, and replace the abomination that is Obamacare. This is all about social justice and redistribution. I intimately know the problems of the healthcare system, and there are no solutions, only huge problems headed our way.

I’m an Emergency Physician and and have been horrified to watch the assault on our healthcare system. Most of my collegues are just bystanders, burying their heads in the sand and hoping things won’t change too much. I have opened my eyes to the threat to my profession and all our liberties, and I will not stand by and just watch and whine.

I am actively supporting candidates who will fight for liberty and American Exceptionalism. I am telling all who will listen and trying to wake up my collegues into action/activism. I sent out an alarm last July when HR3200 was being rammed through, right around the time of whitehouseflag.gov–the site Obama gave encouraging people to turn in “fishy” emails…. Lo and behold I was audited by the IRS last Fall. It turns out a 1099 form was not recieved–although my lender had electronic confirmation that it was recieved.

    Coincidece?????—Yeah, Right.
I will not be silenced or shut down. That just fired me up and fuels my drive to fight to bring the true principles that made America exceptional back to being our political steering principles.

Once you join the union and your hospital becomes a single payer public utility just think of all the great pension benefits you will get.
They will be almost as good as what the janitors get.

  • txgho1911

Was this by or allowed for the majority only? One senator showing up in the chamber and sit as acting chair.

After November the Republicans can stop all recess appointments.

  • atillathehun

It is amusing to hear those voters who allege that they had no idea what OBama was regarding his Marxist ideology. With every appointment he re affirms his most radical of agenda’s since Woodrow Wilson.
This man getting elected is reason and evidence that a voter test should be given prior to issuing a ballot.

  • edinnola

The Constitution grants the President authority to make appointments during Senate recess ONLY; when the position was vacated during the recess. In othjer words, if someone in an important position dies, quits or otherwise vacates his position during a recess, the President has authority to refill it. There is NO authority to fill a previously unfilled position. I am aware that it has been done in thje past, but that fact does not CHANGE the law. It still is unconstitutional. But then this president makes a habit of violating the law, flagrantly. If one gets away with a murder, is it forever after then acceptable to commit murder?

  • earlgrey

this kind of bullying and disregard for tradition and opinion of others can only last so long, before he gets figuratively smacked upside the head. I guess I’d rather he keep rolling over people like a steamroller than give any pretense of caring about public opinion. Hopefully that will hasten the backlash.

LIke a rubber band that keeps getting stretched, it will come back and snap him (figuratively) hard.

If I am wrong than we lost the battle a long time ago.

  • edinnola

Basically I agree with you, however the election (and campaign before that) were held under an established set of rules for political parties. The Democrat Party has represented itself and indeed has been a party slightly to the left of center in the world of American Politics. After the fact, we find out that the Democrat Party has been taken over by Progressives / Communists who play by an entirely different set of rules. One of those rules is that lies are fine if they accomplish the goal of the Party. That’s why most of what comes from the president are distortions of truth. MANY of the Progressive rules of combat are contrary to the American ethic, and to decent behavior, but their goal is to assume continuing control of your lives. The Constitution is an impediment to be ignored. We have been betrayed by the Democrat Party. Democrats have been BETRAYED by the Democrat Party. It’s not the Democrat Party any more, it’s the Progressive Party, or the Communist Party, however you like it. And you thought there wern’t any Communists any more. I suspect there are more Communists and would be Communists in this country now, than there ever have been in the past

He was the famous logician of the early 20th century. There is a story that when Einstein brought him to a judge for his U.S. Citizenship hearing, he told Einstein on the way that he had found a flaw in the US Constitution which would allow a wannabe dictator to take the country over completely legally. Einstein told him to shut up and not to mention it to the judge. Anyway, when the hearing was pretty much over, the judge, wanting to hear from this very famous and very brilliant man, asked him his opinion of our Constitution. Goedel started to tell the judge what he’d told Einstein. Einstein, Judge and others politely shut Goedel up and got him out of the courtroom as a newly minted U.S. citizen. Since the story came out, people have asked what this ‘flaw’ was, and at least one commentator said he thought it was this issue of recess appointments.

  • cooter

As mentioned by “edinnola” previously, if this appointment is totally off the legal charts, how do you begin to petition to get it overturned? This president has all his cronies and sympathizers stashed in all the right places–who do you go to?

  • Achance

Give me six months, unlimited authority, a helpful press, and no need to keep the job or worry about getting another one, I could raise some serious Hell with a government agency.

  • uselogic

spilling out these arrogant, scumbag, Marxist, tyrant wannabe’s? Obama, Berwick, Genachowski, Perelli, Jennings and the like. Must be something in the water up in Cambridge. And unfortunately, it’s polluting all of America.

We’ll have to wait until they let go of their ankles and pull up their pants. Seriously, if they don’t holler about his they won’t holler about anything.

at least in its liberal arts programs, law, and business school. It is so heavily endowed by guilty rich alumni that it doesn’t have any social, political, or economic pressure on its agenda. Some posit that its endowment trust managers were complicit in whatever happened to crash the US economy in Sept. ’08. No Republican business owner/manager or Republican elected or appointed official should allow anybody from that snake pit, really from any of the Ivies, near them, or at minimum, you should waterboard them as a part of the interview to find out what they’re really about.

A menace in her own right…but with these three recess appointments just in, sane Republicans and any other sane Senators still working for us in Congress, should have no trouble blocking the Kagan nomination. Checks and balances, remember?? Call your senators and demand to be heard!

Our President is blinded by anger, hatred and contempt, is in a mad dash to get all the Progressive ideologues he can in place, and needs to be slowed down to spare even more grievous damage to the fabric of our great nation and society.

You can feel the anger in the first paragraph of the attached WH press release:

Obama has bypassed Congress and usurped its power by recess & Tsar appointments. Congress must get creative in finding a way to claw-back this usurped power, and apply advice & consent to ALL appointees, including Berwick.

Back in the “olden days” when we had regular Democrats & Republicans, recess appointments were annoying, but tolerable. But now that we have a Marxist President, it is a totally different matter. We cannot stand idly by and let Obama destroy our country. Kagan must be filibustered, and we must find a way to remove Berwick.

On the other hand, if we are unable to stop Berwick, he will put in place “death panels”, rationing care, & getting between the patient & the physician in the government making healthcare decisions for the patients. When Berwick puts into action, that which Obama promised would not occur, the whole world will know the truth of Obamacare & opposition will grow exponentially.
