Is David Dewhurst a Conservative? Of Course Not.

But don’t tell that to DC’s chattering class who would have you believe there isn’t any difference between Dewhurst and Ted Cruz. They claim this campaign is just about which kind of “conservative” we will get in Washington — a “veteran conservative legislator” (read: guy who make nice with leadership), or a new member of the “doesn’t-play-well-with-others” caucus.

It is “nonsense,” according to George Will for example, that anyone claim Dewhurst to be moderate.

This kind of pabulum is what is nonsense – and a classic Washington two-step around Will’s own (proper) gushing over Cruz a few months ago in which he praised Cruz for being “as good as it gets” and being (hopefully) a part of a cadre of new Senators who “take their bearings from constitutional law” before the New Deal. Sounds like someone has been taken behind the woodshed by Mitch McConnell or some other DC establishment hack and told to “get in line.”

David Dewhurst’s conservative bona-fides are based entirely on Rick Perry’s record. It is so absurd that Dewhurst cannot even vote without taking Rick Perry to the polls with him. This is not difficult. Liberal newspapers endorse him precisely because of his supposed moderation. And his other endorsements are a who’s who of Austin insiders over whom Dewhurst has immeasurable control currently and in the future should he lose. Meanwhile, Ted is endorsed by a veritable who’s who of conservative rock stars – from national movement conservatives like Sarah Palin and Jim DeMint to long time Texas activists like Kelly Shackleford and Cathie Adams.

Let’s take a look at what people who actually follow this stuff are saying or doing:

By our lights, Dewhurst’s service, particularly his leadership of the Texas Senate, has been a model of respectful efficiency. His is a record of fairness and willingness to reach across party lines to do what is best for Texas.

Along with House Speaker Joe Straus, Dewhurst has been a welcome stabilizing influence in an often stormy and polarized legislative process. Isn’t that what’s called for in a divided Washington? We think it is.

Dewhurst has shown in his decade as lieutenant governor that he can build coalitions and work in partnership with others… Cruz came away looking like a guy who knows what he believes, while Dewhurst looked painfully contorted. This leads me back to what I’ve written about in previous posts, and that is I wish center-right Republicans like Dewhurst would just defend their ground, and not try to out-conservative hard-righters like Cruz.

From Rice University Political Science Professor’s Independent Analysis:

The figure reveals a Dewhurst-run Senate where the senators who enjoyed the most success were in the moderate and center wings of the Republican Party.

I also conclude that Dewhurst frequently used his powers of agenda control to help pass legislation opposed by the most conservative members of the Republican delegation. In addition, the best estimate of Dewhurst’s location along the liberal-conservative continuum which dominates voting in the Texas Senate suggests he is significantly less conservative than approximately one-third of the Republican delegation

Finally – simply take a look at the list of endorsements. It is truly laughable the distinction between the two. Dewhurst is supported by the Austin power circle. Ted is supported by anyone with a clue how badly we need a conservative U.S. Senator from Texas in Washington to protect freedom.

    Dewhurst hasn’t run a recent campaign add in Texas that capitalizes on his successes (if they exist) as Lt. gov. All are geared toward tearing down Cruz. His latest is a whinny add about Cruz receiving help from outsiders like Palin, who come from smaller (guess he hasn’t realized Alaska is twice as big as Texas) states than Texas and therefore aren’t familiar with the issues facing a big state.

    Seeing similar types of adds from long term state office holders afraid of losing their power to someone who might be for the citizens of the state.

    What a disaster! Same 4 soft questions about Obamacare over – and over – and over again. And Dew-crist managed to tell the audience 4 (or was it 5?) times that his father was killed when he was 3. Plus he wasn’t a professional talker like some, and he used to stutter! Imagine that!

    To his credit, Ted Cruz brought with him the Dew-crist mailer that accused Cruz of defending a Chinese business, and asked why he was telling these lies and was Dew-crist impugning Cruz’s patriotism. Dew-crist, of course, back-pedaled and denied such a mailer existed; but if it did, it didn’t say what Cruz said it did. But if it did, he, condescendingly, wasn’t bringing Cruz’s patriotism into question. But if he did, he would talk to him later about it, just show him.

    - just a few of the laws passed in our State since the Lt. Governor was elected.
    It’s wrong to say that Dewhurst is running on the Governor’s record. As I’m sure you know, Texas has a quirky system, where our Lieutenant Governor is more powerful than our Governor in many respects. At the very least, they’ve formed a great partnership in the service of Texas If you want to know what Lt. Governor Dewhurst will do in the US Senate, look at just some of the laws he’s helped pass over the last 10 yrs:

    Women’s Right to Know Act, an informed Consent law for abortion with 24 hour waiting period, 2003;
    Prenatal Protection Act which declared the unborn an “individual” – a person in Texas law – “from fertilization until natural death,” 2003,
    Defense of Marriage Act, 2003, with a Second law passed to amend our State Constitution, 2005;
    Parental consent for abortion, 2005;
    Tort reform, 2005;
    Decreased school property tax by 1/3, 2007;
    Jessica’s Law, 2009,
    Loser Pays, 2011;
    De-funded abortionists, including Planned Parenthood, 2011;
    Prohibited illegal aliens from getting driver’s licenses, 2011;
    Photo Voter ID, 2011;
    Blocked the law written specifically to force Texas to follow the Democrat’s call to raise school spending at 2009 stimulus levels, 2011;
    Sonogram Bill, requiring the abortionist to offer the mother a chance to see her child and hear the heartbeat;
    Castle Law 2009 that allows Texans to use deadly force to defend themselves against threats, without having to prove they tried to “retreat”to safety;
    Stronger protection for Concealed Carry Permit holders every session since 2003:
    Balanced our budget every two years, even when there were projected shortfalls in 2003, 2009, 2011;
    Every year since 2005, Texas has spent at least $100Million of our tax dollars to augment border security and that number was doubled in 2011.

    Governor Perry, with the help of Lt. Gov. Dewhurst and the Texas Senate, refused to accept those “Stimulus funds” for education and unemployment insurance that would have forced us to change our laws in 2011. Yes, we used some stimulus funds that didn’t require us to change our laws, but, as our former Senator, Phil Gramm said,

    “(I)f the Congress had a vote on whether to build a cheese factory on the Moon, I would oppose it based on what I know now, and I cannot imagine the circumstance under which I would support it. But on the other hand, if Congress in its lack of wisdom decided to start a cheese factory on the Moon, I would want a Texas firm to do the engineering, I would want a Texas construction firm to do the construction, I would want the milk to come from Texas cows, and I would want the celestial distribution center to be in Dallas, Texas, or College Station, Texas, or somewhere else in my State.”

    These are just the highlights of a career that began the same year that 11 Democrat Senators left Austin on a supporter’s plane in order to hide out in Albuquerque New Mexico for a full month in order to deny the Senate a Quorum and avoid losing the votes on Congressional redistricting.

    You might have read that Dewhurst increased taxes, with the misleading statistic that our revenues went up over the last 10 years. Increased revenues do not necessarily mean increased taxes! They also go up with the growth of the economy. Texas’ population went up over 20% and our State added more jobs than all the other States combined in the same time period. These were good jobs, and they went to legal residents who come into our State at the rate of 1000 people a WEEK! The fact is that even the Club for Growth, who is now backing Mr. Cruz, stated last year that Texas’ spending has actually gone down over the last 10 years, when adjusted for population and inflation.

    How did we spend that money? Mr Cruz knows exactly how: he was the lawyer who worked out a deal in Federal Court when he was Solicitor General that bound the State to increase spending on Medicaid. He uses this spending from his agreement against the Lt. governor.

    You might also read that Dewhurst supported a “payroll tax,” or even an “income tax.” These accusations are based on words in a press release and an editorial against the Lt Governor, from 2006. These weren’t the words used in the Bill that is bandied about, and that Bill never became law. In the law that was eventually passed, there are three ways to calculate our State business franchise tax. One of those is a tax based on employee pay, minus benefits. But there are two other ways, and the business chooses the best way for them. More telling is that our Attorney General won the case proving that the tax is not an income tax, last November. Cruz knew that his claim was wrong as from the beginning of his ads and web campaign against Dewhurst.

    To the comments about ads, there have been many showing Dewhurst’s accomplishments and endorsements. The negatives get the “press.”

    Claiming that Dewhurst is “big spending” and raises taxes? The Club for Growth, when it was backing Perry last year, praised Texas spending and taxing history as “excellent,” and noted that our spending is *down* compared to inflation and population.

    All we have for Ted Cruz’ record is his law cases since he became head of the Appellate division of his law firm. As a man contemplating or running for Texas Senate, he should have shown better judgment than to have gone near the two cases that are the subjects of the ads. He shouldn’t have argued that US patent law doesn’t apply in the Fishman case and that the only victims in the Mericle case was the IRS.

    I was there the day the prenatal protection act was passed, and watched him work the room to make sure all knew that the letter from Lacey Connor’s mother had arrived and that everyone in the State would read it before the day was over.

    It’s very instructive. It is making the case that Dewhurst is willing to reach across the aisle, which is code for selling out conservatives. We already have a John McCain and Lindsay Graham, why should a red State like Texas add one more?

    We need a conservative Senator who will reach across the aisle with a fist, not compromise on core party values.

    Lt. Governor Dewhurst’s Super PAC backers are now running a shameful TV ad trying to tie Ted Cruz to a juvenile prison scandal in Pennsylvania. It’s disgusting.

    Cruz had nothing to do with any criminal proceedings involving the juvenile prison case. He simply worked on a civil breach of contract case between construction company owner Robert Mericle and a private insurance company, not the matters David Dewhurst claims.

    by analogy Dewhurst sees himself as one of the generals behind the lines in a chateau, giving orders and moving pins on the map. Cruz is a trench fighter at the front line, As Solicitor General he argued the case for TX before SCOTUS that allowed the ten commandments monumentto stay on the Capitol grounds. Thats about as epic a culure war win as we conservatives have had in the last 5 years.In another time, maybe a Dewhurst. Now, we need a fighter – thats Cruz.

    I’ll just say that I’m sure many state’s would be envious to have two conservative, one more than the other, choices for Senate, both better then Kay BH if you ask me. We don’t have a battle between a squish Rep and a far Leftie.

    BTW, there is a Dem and a Green Party candidate running too…and here in TX, they haven’t a snowballs chance in summer.

    Considering the way Texas generally sets an example of American patriotism and values for the rest of the country, it?s a shame to admit Texas too, has had its dead tree media run by by the socialists.     That captures it very well.

    Many Republicans do not think of the Lobbyists as a Wing of the party, but the endorsement list for Dewhurst captures precisely the crowd. Not a bad crowd, we shouldnt assume lobbyist=satanic influence necessarily, they all have to represent interests, from farmers to prolifers to policemen to unions to … well, the lobbyists themselves.

    Its helpful to think of the Lobby Party as another wing of the party because its a part of the power equation that politicians cater to, and the problem is how these special interest caterers end up throwing us under the bus. While conservatives are animated by conservative change, the lobby party is for the status quo and cultivating their special interests. TAB for example, wants their cheap labor supporters onbaord so push back against conservative immigration bills, stopped them cold in the Texas lege, working with liberal groups. Medical lobby will fight for more govt spending on healthcare but against regulatory relief that might lower costs of doctors/healthcare. And too many lobbies are simply rent-seeking entities trying to get more money – public sector unions are an example but not the most egreegious (remember the ones that bribed a congressman?).

    The Lobby Party is an impediment to conservative reforms, and their candidates will curiousy disappoint us at the most critical points, which is why the above article is necessary, and Ted Cruz needs to win this primary.

    The Dallas Morning News (TDMN) got kicked off the Obama campaign plane in 2008 after the paper failed to endorse Obama. Hardly a liberal bastion of editorial blither.

    Regardless of how “pure” TDMN is, that paper’s editorial department is not run by rabid Tea Party neo-constitutionalists and Deb Medina campaign refuges. So, I guess they’re all liberals. (Disclaimer: I worked at TDMN briefly, and found that the publisher to be level-headed.)

    Dewhurst (and briefly prior to him, Perry) had a governing model that worked very well for Texas in Lt Gov. Bob Bullock. Before the world got turned upside down, That is, while there were conservative Democrats left in the Democratic party in Texas, the 1990s saw an era of solid bipartisan leadership under the democrat Lt Gov. Bullock, which is among the reasons then-Gov. George W. Bush had a successful enough resume as governor to win the presidency.

    As redistricting took its toll on bipartisanship (as bnukols notes, when the whining democrats fled to NM and later, again, to Ardmore, OK to avoid voting on redistricting boundaries), Dewhurst adapted his leadership to seize opportunities and one that did not alienate those on the other side of the aisle. The “in-your-face-take-no-prisoners” techniques of today’s conservative movement didn’t take hold until 2009 when Obama declared that elections have consequences, and passed Obamacare without a single Republican vote.

    It was fractious in the Texas Legislature, but not as toxic as it is in Washington.

    Reaching across the aisle with a fist is not the way to govern, but after the Pelosi years, I understand the sentiment.

    With that in mind, it would be nice to understand fully from where Mr Cruz comes from. He says all of the right things, but he has no record to prove he’ll do what he says he’ll do. He also has a similar record of deceit, as all of you blame Dewhurst.

    You may think you’re voting for a fist-flinging senator in Cruz, but considering some of his backers, I’m not too sure that’s what we’ll really get. Cruz’s big donor named Thiel is a source for concern (details). Will we get a fist or a limp wrist?

    Finally, before criticizing TDMN for whatever sins, you may want to examine the actions of the publisher of RedState. Erick Erickson has been shilling for Ted Cruz while Club for Growth is running very prominent display advertising on this site, and has been for weeks (I’m in Texas, so if the ads are geo-targeted here you may not see them). I wonder. If Dewhurst bought the exclusive ad buy first from RedState would Erickson be a Dewhurst shill? This kind of audacity would get you fired at TDMN. Just sayin’.

    I told the story about the Prenatal Protection Act, above. The House author received the letter from Lacey Connor’s mother on the morning of the vote. The LG made sure that copies of the letter were placed on the Senator’s desks at.the last minute and that each Senator knew the consequences of voting against.

    This year, he helped secure 2 Dem votes for our Sonogram Bill, when one of the True RINO’s wouldn’t. (Wentworth will be replaced by Donna Campbell in Tuesday’s runoff because he opposes all prolife bills and even Tort reform.)

    You refer to the days when there were conservatives among Democrats, and use that to justify the old style of running things where the Lt Gov would appoint people from both parties to head various committees.

    Well nowadays there are hardly any conservative Democrats left, and Republicans control 2/3 of the House and 3/5 of the Senate. If you’ve got a large majority of seats and the minority is so distant ideologically, why worry about bending over backwards to keep them happy?

    My feeling is they’re going to hate you anyway so screw ‘em. It seems like establishment Republicans are more interested in sticking it to tea party types than they are in sticking it to far-left Democrats. Sorry, but we don’t need another McCain in DC.

    I sent my absentee application in early last month. followed up the first week of July. The person in the County Tax Office replied she was on vacation and catching up. Vote for Cruz went out shortly after. Called possible waivering folks to encourage Cruz votes.

As a matter of fact, the last publicized disagreement between Governor Perry and Dewhurst was over that same business tax that Cruz claims Dewhurst supported. Back in ’05/06, Dewhurst was on the side of business and less franchise tax increase.

    If you follow ad buys on RedState you’ll notice little correlation and zero causation between what we write about and what we support and the ads. Right now a pro-union group is running ads bitching about Commie steel being used to build American bridges. Democrats have bought ads on the site.

    More to the point, ad buying is done by Eagle Publishing not by us. The decision to support Cruz, like the decision to support Marco Rubio and the decision to support Mike Lee and the decision to support Richard Mourdock was an editorial one discussed among the contributors.

    When you decide you can actually wear big boy pants and play nice with others, hit the contact button, apologize for being a noxious douchebag, and ask for reinstatement. If that is too high a price to pay, fine.

    The TSA anti-groping bill in last session of the state legislature, which had support of the people and enough votes in both senate and house to pass easily , and should have passed, was quietly strangled to death in the back halls of the capitol by straus (RINO speaker) , dewhurst (lt gov) and the visiting federal officials who came with threats about shutting down DFW and Bush.(Let em try!) We were all watching and knew what had happened, Faux position statements of the leadership notwithstanding. It’s not only what a guy does, it what he doesnt do, behind the scenes – that matters

    Cruz is also good on taxes and spending .. but being a Fiscal Conservative isn’t enough.

    Texas is a very Red State indeed, and can elect a much more solid conservative than, say, Illinois – Mark Kirk (R-IL) is a decently fiscal conservative and pro-armed-services senator, after all…. but he shouldn’t be the ideal for Texas.

    Is Dewhurst better than Cruz on national defense issues? His “amnesty” past seems to argue that he’s not… where does Dewhurst stand on border security? Did Dewhurst agree with Perry’s proposal to beef up the Texas Rangers?

    Is Dewhurst better on social issues? Where do Cruz and Dewhurst differ on gay marriage, abortion, end-of-life care?

    Where do Cruz and Dewhurst come down on issues of individual liberty? 2nd Amendment? Do they differ on the VRA?

    So far, you’ve spewed a lot of venom about Cruz .. but you haven’t effectively drawn the differences between the two candidates on a broad front, nor shown why Dewhurst is the superior overall conservative.

    I simply pointed out what others have probably seen, but been reluctant to point out. The volume (so to speak) of the Cruz ads on this site seems to increase with every morning email with editorial from you enunciating what appear to be the Cruz campaign talking points.

    It’s your site. Do what you wish… even if it smells like fish.

    If you were supporting Cruz in 2009, 2010, or 2011, the site’s archives don’t prove it. This is the last page with posts tagged with “Ted Cruz.” The oldest post from you tagged with “Ted Cruz” was from March 21st of this year. Further, I’d be supporting Cruz in 2009 too. He’s a conservative politician who wasn’t running against the conservative Texas Legislature back then. Instead, as we all just found out, he was over-billing the Republican senators to the tune of $40,000 for lawyer work on voter ID.

    But really, Erick, I don’t want to get into a lawyering thread on whether or not you’re engaged in pay-for-play with Club for Growth. My point is that it looks suspicious and as a conservative movement thought leader I think you ought to address it.

My own opinion with Lamar Alexander; the work across the aisle slot is filled for the next couple of years – no reason to send Dewhurst to Washington.     In 2009, Ted Cruz was a keynote speaker at the first RedState Gathering.

    He also spoke in 2010 and 2011 and will be at the 2012 one.

    We have written about Ted Cruz, however as your account is not so old, you probably are not aware of the number of changes we have made at RedState in the past few years and that we do not have a comprehensive archive.

    Likewise, the fact that you would conclude that a conservative activist site would be pay-for-play, you can’t understand my “no” from the post above, and the idea that you would even leap to that conclusion is a red flag for me and I suggest there are other sites on the internet where you can go. I don’t actually consider you welcome here any more.

    Oh, and if you know where to look, you can find RedState supporting Ted Cruz going back to 2006 when we were asking George Bush to put him on the federal bench.

    I had the privilege of attending the FreePAC event in Dallas last night. There was a special rally for Ted immediately before the main program since, of course, there were a lot of Texas voters there. Ted was one of the first speakers for the actual program at 6 and almost every one after that mentioned how thrilled they were to support him.

    One of the most surprising things to me was the support from across the country. Lots of conservatives have finally figured out that other states’s Senators DO matter in the big picture. (After all, the entire country would have benefitted from a Harry Reid defeat.) The people sitting next to me were from Tallahassee and the ones in front from Chicago. I saw buses out front when I was leaving from Georgia and Mississippi. I only had to drive 4 hours to get there – almost had to apologize fir actually being a Texan! They said at one point that there were more than 10,000 tickets sold. Not sure what the actual attendance was, but it was inspiring to see so many like-minded people from all over the country in one place. The speakers were all amazing. Absolutely great event!! Gives me at least a little hope for the future.

    The seven adults in my family all voted for Ted this week. I am a little concerned about rumors I’ve heard of Democrat cross-over voting for Dewhurst. They aren’t allowed to vote in this run-off if they voted in the Dem primary in May, but a lot of them didn’t bother so they CAN vote Rep ballot this time. Dems are so few and far between in TX – many of them see Dewhurst as more of a moderate “compromiser” and would rather see him in the Senate to join with all of those other squishes AND the Dems. That alone should be an indication of who is the MOST conservative in this race.

    (PS – I DO see ads for Cruz on this site. I wondered if everyone was seeing them or if they have a way to do them regionally? Sure seems like to me that Redstate certainly has the right to be selective in their advertising – IF they want to – no different than ChicFilA or any other private business choosing what they want to support…)
