BREAKING: Trump To Appeal 9th Circuit Court Ruling On Travel Ban Executive Order

President Trump incorrectly claimed in a television interview that two people were shot and killed in Chicago during then-President Barack Obama's farewell speech. Chicago police records show no one was fatally shot in the city on Jan. 10, the day of Obama's speech. There were five shootings, but none occurred while Obama was speaking. At first, it was reported the administration wouldn’t appeal the ruling but that has changed.

From The Daily Beast:

The Trump administration has reportedly filed to appeal the Ninth Circuit Court ruling that effectively continued the block on the president’s anti-refugee executive order. The administration is not yet taking the case to the Supreme Court, however, and will seek cases against the ban in Washington and Minnesota until the Ninth Circuit’s ruling can be appealed. “Further proceedings in the Ninth Circuit will likely inform what additional proceedings on a preliminary injunction motion are necessary in district court,” lawyers from the Department of Justice wrote in a Monday motion. The Trump administration will likely seek an appeal before a larger panel.

More here from Buzzfeed:

The Justice Department announced the plans in a filing before US District Judge James Robart, the federal judge in Seattle who issued a nationwide order halting enforcement of Trump’s refugee and travel bans on Feb. 3.

Justice Department lawyers go on to tell Robart that they “respectfully request that they be permitted to file a status report with the Court no later than two business days after the Ninth Circuit decides whether to hear defendants’ stay motion en banc.”

They’ll be follow up as more information comes in.
