14 more states file anti-Obamacare amicus brief.

(I decided to crosspost this after all)

This one will be for Seven-Sky v. Holder, which is scheduled for oral argument in September. The amicus brief will be on the individual mandate; more specifically, that the individual mandate is unconstitutional.

I mostly draw this to people’s attention because of the following list:

Alabama, Florida, Indiana, Kansas, Maine*, Michigan, Nebraska, North Dakota, Ohio, Pennsylvania, South Dakota, Texas, Washington, and Wisconsin.

Bolded states had elections for Attorney General in 2010: underlined states are where the job flipped from from Democratic to Republican.

Elections matter.

    but if you believe a law is unconstitutional and have a manner to not be held to it, wouldn’t you?
    iirc the waiver process started before the election too but may be wrong.

    I don’t know the politics involved, but apparently AGs aren’t appointed on a partisan basis in NJ.

    …the individual mandate is I find the definition of a minimum benefit package more offensive. I have a high deductible, low premium plan with an HSA and I love it. Under Obamacare I would lose the freedom to choose an HSA and have to purchase a government defined plan. To me that is just as, if not more, coercive than the individual mandate because I’m not going to go without insurance. I don’t need to be forced to buy it. I have the good sense to do so on my own.

    I just heard this on Judge Napolitanto’s (sp?) show.
    He said 4 states have a waiver – including his home state of NJ.

    I wasn’t a fan of OH Attorney General Mike DeWine and held my nose and voted for him, but he’s wasted no time in going after Obamacare (under Gov. Kasich’s direction). If he can keep his hands off our 2nd amendment rights he might turn out to be a decent AG.

    as it undernines and underlines the main premise of obummercare, that is that a comprehensive centralized management of healthcare for 320 million disparate citizens is doable. If the SC senses and concludes, as they stare at their ceiling at night, that this monstrosity of a law is not excecutable (doable), then they are likley to conclude it is not legal.

    so bring on those waivers!

    Just look at Nancy Pillosi’s district. Everything is on the up and up, sure it is? Don’t you just love the forthright honesty of this administration. Taxpayer money is going toward bribery again, to re-elect Obama. This mandate is so wrong and I hope the Court will get rid of Obamacare.

    Throw Obama out and the entire US will get a waiver from ObamaCare.

    Even more important that we get ObamaCare repealed…..
    First we have to kick out Obama and the democratic (RINO) Senate.

    Democratic lawmakers are trying to pressure Justice Clarence Thomas to sit out any health care case that may come before the Supreme Court.
