The measure, aimed at an increasingly popular tactic used by 2nd Amendment activists, would make California the first state since 1987 to outlaw the controversial practice of publicly displaying a weapon.
The governor — a gun owner — has not taken an official position on the bill, passed by the Legislature last week. He has argued both sides of gun control issues in the past.
…because he’s going to have to make a choice now. California law currently permits the open wearing of unloaded firearms; this bill would eliminate such practices, despite the fact that an unloaded gun is pretty much by definition not a threat to anybody. But it does serve notice that there is someone out there who is prepared to respond to a threat, if necessary… and if people are worried that carrying guns might lead to gun violence: oddly enough, violent crime has gone down as firearms carry generally has gone up. Which should surprise nobody, but apparently still does. That’d be mostly people for whom guns are some sort of scary evil magical item, mind you.
Anyway, the liberty-hating fascists over at the Brady Center (hi, guys!) have made it abundantly clear that this bill is part of their national anti-civil rights campaign, and they certainly want Governor Brown to sign this bill. Will he? Well, Brown’s a liberal Democrat… so probably yes, as soon as he thinks up a good-enough reason to endorse making it illegal to carry an unloaded gun openly. Whether the US Supreme Court lets him get away with it is, of course, a completely different question…

If you are carrying you best be carrying loaded I would think. Not so bad in an auto or if you have a speed loader I guess, but it seems silly to me.
Why would you want to carry an unloaded weapon when you can apply for a permit and carry concealed?

For instance, my wife almost got hit by a truck running a stop sign recently, and I got cut off on the expressway by a Cadillac Escalade. The common denominator? Both had a “No SB 5″ bumper sticker (this is Ohio, after all). Liberals are afraid that a conservative will treat them as they would treat someone else and draw the gun and shoot them for their bad behavior.
Can you imagine how it would reduce union violence if one of the persons crossing a picket line, patrolling the area, etc, might do violence to them in return with a gun?

The key difference appears to be that personal property is allowed under fascism, but controlled by the government government, whereas under communism, the government owns everything. Gun grabbers may have misfired

California is a “may issue” state for CCWs, which means that if a person has “good cause” for being armed (what amounts to “good cause” is undefined and whether you have one is entirely at the unbound discretion of the local chief of police or sheriff), then the chief of police or sheriff MAY issue a CCW. Needless to say, the only way one has a “good cause” for being armed is if they are connected, contribute to the sheriff’s campaign or famous.
Most states are “shall issue” – which means that if you pass a background check then the local authorities must issue a CCW.
I’m an attorney and had a client who had a contract out on his life by the largest gang in southern CA because he was a potential witness against their local enforcer. The head of the local DA’s office suggested that I get a CCW and said that if I didn’t have “good cause” then no one in the world had good cause. My good cause was self-evident. Any thug with two brain cells to rub together might get the idea that if they can’t find their intended target, then the target’s attorney might know where he was, thereby making me a target.
I applied for a CCW with the local police. It took them three months of sitting on their hands to tell me “no”, you don’t have good cause. They reasoned that if I had good cause then every lawyer defending a criminal had good cause and they couldn’t abide by that. I carried open and unloaded because the thugs might not know differently and if I needed it I could load in a few seconds – of course the assinine nature of the open carry law would leave me completely undefended in those few seconds, but it was better than being unarmed entirely. Now they want to take away all possible means of self-defense.
However, the gun grabbers may have misfired and shot themselves in the foot. Two cases have recently been decided in district court cases and are now on appeal. In both cases the courts stated that the reason why the law permitting local authorities unbridled discretion to deny CCWs is that the State’s unloaded open carry law suffices to fulfill their rights under the second amendment to bear arms. The right to open carry unloaded will be abolished if Brown signs the new law and therefore there’s a good chance that the appellate courts will find that “may issue” for CCWs is no longer constitutional since there will be no other way to bear arms outside the home in California except for a CCW license.

Bay Area Open Carry has been vocal about this issue, and there are several news stories about them. Also, they and others carry flip-cams to record their interactions with the police. You’ll find several examples with a youtube search.
I live in Livermore and have seen these guys around, but don’t know them personally. For all intents and purposes its impossible in our county to get a concealed carry permit. To address the question some have posed about the usefulness of carrying an unloaded weapon, notice in the video that they are carrying loaded clips on the opposite hip.
Of course they’d rather have a CCW and carry a loaded sidearm, but the chances of that happening in Alameda County are about as likely as Democrats writing sensible legislation.
The more obvious thing about this issue is many of the gang bangers in Livermore are carrying concealed weapons. As they say, when you outlaw guns, only outlaws will have guns.

I guess they are a tad camera-shy.
I used to carry concealed, and here in Alaska, no permit is necessary. I still do, but usually just because of weather concerns for the firearm, such as snow and cold… and only incidentally do I carry in town as I don’t feel I need the heat, or the weight. I am not fond of carrying a lump of steel about without some reason.
California would do well to allow all of it’s Adult Citizenery to carry any way they wanted to with their crime rate.
Let the good guys have some defense.

I thought the current law explicitly prohibited carrying loaded firearms and the failure to mention unloaded firearms created the loophole.
I would assume Brown is going to sign the bill but I hope the reciprocity bill currently in the house passes Congress and gives Californians an alternative method for obtaining a CHL.
