President Obama to flip-flop on recess appointment?

CNN is just now reporting that the President plans to recess appoint Richard Cordray to head the Consumer Financial Protection Bureau.  Such a recess appointment was previously assumed to be impossible, given that: the assumed minimum length of time is three days; and the Senate is deliberately meeting every two days in order to prevent recess appointments during that time period.  The Hill helpfully notes (via @RBPundit) that the three-day limit is actually from the Clinton era: they also note that Obama’s then Solicitor General noted the three-day rule during Supreme Court arguments (Politico gives the case as being New Process Steel, L.P. v National Labor Relations Board).  That his administration is now going to reverse themselves on this should come as a surprise to nobody; neither should it be a surprise that this administration apparently has absolutely no awareness whatsoever that their actions will have consequences that will make Democrats curse this White House for the next thirty years.

That’s pretty much it, except for one final note: ever hear of “unanimous consent,” Mr. President?  No?  Well, you will.

    Mr. Obama is trying to make a “partisan” Congress the target of his reelection campaign?

    Really?

    This President has broken more precedents along with his Democrat Congress than any other person that occupied the Executive Office. He has willfully and gleefully installed an agenda antithetical to the American people which includes forced health care and profligate spending that will bankrupt this country.

    This election will be about;
    - Forced ObamaCare
    - The Stimulus
    - Historic increases in our spending and debt
    - Record unemployment
    - Record numbers of people leaving the job market
    - Historic foreclosures
    - Downgrading of American financial instruments
    - Political patronage on an epic scale
    - An out of control Attorney General
    - A loss of democracy in the Middle East
    - A failure to protect one of our biggest allies, Israel
    - Bailouts of unworthy corporations
    - Egregious assaults on the taxpayer
    - Divisive Marxist attacks which attempt to divide our populace along financial and racial lines
    - Record installation of “czars” who are unaccountable to anyone
    - Loading of our SCOTUS with liberal ideologues
    - A record number of campaign contributions from unknown sources

    And the list goes on…

    Defund the Consumer Financial Protection Bureau. It’s new spending after all. Plus it would be nice to discover that the Congressional Republicans are not as witless, as clueless, or as gutless as I suspect that they are.

    ?Senate Majority Leader Harry Reid has a little trick up his sleeve that could spell an end to President Bush?s devilish recess appointments of controversial figures like former United Nations Ambassador John Bolton.? U.S. News reports:

    We hear that over the long August vacation, when those types of summer hires are made, Reid will call the Senate into session just long enough to force the prez to send his nominees who need confirmation to the chamber. The talk is he will hold a quickie ?pro forma? session every 10 days, tapping a local senator to run the hall. Senate workers and Republicans are miffed, but Reid is proving that he?s the new sheriff in town.

    In his speech at Shaker Hts. High School, Obama said, “When Congress refuses to act, I have an obligation to do what I can without them.”

    Really, all you need to know about the man, isn’t it?

    Not that anyone on Team Obama cares about this, but Cordray is in the pocket of trial lawyers and securities lawyers. I know I feel much safer knowing this guy is going to be looking out for me!

    I would think that some Senator would sue in the Supreme court over this.

    Does anyone have the guts to Unanimous Consent the Senate to death when Obama is looking for a “do nothing” congress to run against.

    If it gets upheld than this is “the new normal” with a GOP president.
    Plus, there should not be a single vote on a judge for the rest of the session.
    Not one.
