What the Mainstream Media Isn’t Reporting About Solyndra

After just a short time in Congress, I find myself more keenly aware of the research and reporting failures of the modern mainstream media.  If a story gets more depth and attention than the typical 10 second sound bite, I admit, I’m surprised.  Solyndra is no different.

There are a number of facts surrounding the Solyndra story that don’t seem to be getting any attention.  A significant part of the public outrage regarding the bankrupt company isn’t centered on their failed business model or external factors; it’s the millions of taxpayer dollars that the Obama Administration lost on Solyndra after the business was doomed.

After Solyndra defaulted and they knew Solyndra was in real financial trouble, Secretary Steven Chu’s Department of Energy (DOE) staff made a decision by December 10, 2010, to subordinate $75 million of taxpayer money so more private capital could be injected into Solyndra.  Subordination means that outside private investors are given superiority over taxpayers in the event of bankruptcy.  At that point, $440 million of the $535 million loan guarantee already had been pumped into the company.

By law Secretary Chu wasn’t allowed to subordinate the taxpayers’ money.  The Energy Policy Act of 2005 specifically states that the loan guarantee “shall be subject to the condition that the obligation is not subordinate to other financing.”  It was the clear intention of Congress that taxpayers should be reimbursed first.

For a company that had already been declared in default and had a collapsed business model because the Chinese were selling their solar panels for less, one might question the sanity of private investors who gambled on Solyndra in December of 2010.  Were they after Solyndra’s intellectual property (IP) rights?  As a private investor and the dominant financier, could Argonaut’s support of President Obama have helped them secure Solyndra’s IP assets?

By December of 2010, these private investors were placed in first position to get the choice parts of the business – intellectual property, including proprietary information, processes, and patents – when Solyndra went under.  To be fair, I’d guess that these assets likely aren’t worth billions, but one could certainly speculate they’re at least worth $75 million, which legally belonged to the taxpayers.

Without question, $170 million – at the very least – was wasted.  If DOE had simply let Solyndra fail in December 2010, taxpayers wouldn’t be on the hook for $95 million of the loan guarantee that had yet to be dispersed in addition to the $75 million that was subordinated.

Why isn’t the mainstream media asking questions like these?  What other questions aren’t being asked?  To me, the Solyndra scandal is worthy of some good, old-fashioned investigative reporting.  Where are Bernstein and Woodward?  Is there no budding Mike Wallace?  I will continue to try to get to the bottom of this scandal.  Will the media join me?

    Thank you, Representative Griffith for bringing this to light.

    Violation of Federal law would appear to be grounds for action by DOJ, but that isn’t likely in this climate of “laws are for the little people.”

    If the Energy Secretary broke the law, why hasn’t the Congress either composed a resolution of contempt (as in the case of the Attorney General) or more simply reduced the DOE budget by half a billion dollars so that they suffer for their error?

      You mentioned MSM and media. It’s time we all publicly started calling them by name. It isn’t the “media” who haven’t reports it, it is:

      George Stephanopoulos
      Matt Lauer
      Brian Williams
      Leslie Stahl
      Charlie Rose
      Chuck Todd

      and on and on and on. If we just continue nameless, faceless MSM and media they won’t/don’t care.
      Send a letter to George or Brian and ask them personally why they haven’t covered it and point out a baseless, pointless pro-Obama story and start getting specific.

      Otherwise, we lose. Start an ad campaign pointing out their non-stories. Embarrass them.

        If the House doesn’t act NOW while they have the power, these lawbreakers will walk after the election, provided Romney is elected. I’m worried that Obama willl write some executive order on his way out that seals all of these records for no eyes to see for decades and there will be no justice for Brian Terry and the taxpayers.

        On a relevant side note, per Breitbart.com today, “The Energy Department official who oversaw the agency that funded the now-bankrupt Solyndra with taxpayer dollars announced that he would resign on the same day Obama announced his support of federalism on the issue of same-sex marriage.

        Arun Majumdar ran the Advanced Research Projects Agency — Energy (ARPA-E), which was responsible for authorizing loans to Solyndra. Majumdar will step down from his post on June 9, Energy Secretary Steven Chu announced on Wednesday.”

          Thank you, Rep. Griffith, for a focus on salient issues. I think we know why the Obama Media does not follow up in depth. All the more reason that RedState is essential daily reading.

        You, sir, have the capacity to address the Congress and demand further investigation into this. You have a taxpayer funded staff who can certainly do research if you direct them to. I respectfully submit that you should not be clamoring for an outside savior, a Woodward and Bernstein. YOU should conduct the investigation, and YOU should report the results. We, the people, will be grateful. Thank you in advance.

          First of all, I think you know the answer to your own question. The Main Stream Media is in the tank and has been for decades now. Your article raised other questions in my mind since you are in Congress.

          Why is Eric Holder still sitting as the AG of this nation? Why is Chu still the Secretary of Energy if the law has been broken? Why haven’t people been impeached, like Elena Kagan, for lying under oath during confirmation proceedings? Why hasn’t Obama been impeached since he treats the US Constitution as if it isn’t an obstacle to him?

          I think the complicity in all of this extends well past the Main Stream Media myself. Where are the statesmen in Congress? Are there any?

          If anybody thinks that taxpayer money went to waste in Solyndra, think again. That money will make it’s way into the democrat machine campaign coffers to be used to fraudulently control the elections in November.

        The media does care that this information will hurt their Messiah. So their first line-of defense is to not report it. Unless someone like representative Griffith or Erick come along and upset the cart. Even then they claim it is not news and continue to bury it as long as they can. We need more people riding the media and reporting the truth util they are forced to also report what is happening and even then they continue to try to spin it.

        This is such a strange world we live in where the media is trying to help a Marxist, Socialist, communist liberal take over the government. Don’t they realize the first thing to go is freedom of communications? This president is following the Hugo Chavez model of controlling the government. one of the first things Chavez did was sloe all but one TV and Radio stations and controlled what they were allowed to broadcast. These people are cutting their own throats with a big rusty blade.

    Thank you rep Griffith. The question you ask about where is the media on this falls on deaf ears. The media is now socialist, remember the Times cover. Socialism means the government calls the shots in it most benign form. The rule of law is gone when government micro manages business under Obama. The Obama administration has adopted the Clyburn rule if you remember when Clyburn said ” the government can do what ever it wants to do:” when asked about Constitutionality. Your article here points to the Solyndra issue however I ask that you combine Clyburns remarks, Solyndra, fast and furious, auto bailouts where 200 years of bankruptcy law were tossed out the window to expose a federal government administration who is an OUTLAW. They are an outlaw not just on one issue but an outlaw in practice. The story is far far bigger than just one Solyndra deal but systemic in the administration.

      Or is he too busy covering his butt in the Gun Runner scandal and suing Maricopa County, AZ Sheriff Joe Arpaio?

        Where have all the investigative reporters gone? Eighty-five percent of them have sold their souls to the company store, AKA the Obama Administration. Objectivity and, integrity in the democrat-media-complex is dead. This story is a perfect example of its demise.

        As for democrats in Congress, they’re as bad as the main stream media, while the Republican are too cowardly or inarticulate to assert a logical or believable objection to what is now recognized as a complete collapse of the watch guard media.

        If the press won’t keep a watchful eye on the politicians who are selling us down the river, we as free people are in a world of deep do-do.

          Tell Boehner We the People demand answers. There is so much corruption in this Obama democrat machine administration that the necessary and lawful investigations of wrongdoing SHOULD have kept the House of Representatives busy doing nothing BUT investigative hearings for the last 3 years. There would be 2 benefits to that.
          1) criminals would have been brought to justice.
          2) no legislation would have been passed, saving We the People (B)illions of dollars.

            this is one reason why we need to take over the Senate and take Harry the Obstructionist out of office. Harry Reid will not even allow an honest debate or vote on anything that has not been approved by George Soros, Union Bosses and other Liberal Thieves!!!
            I normallly am completely against one party holding all three of the “supposed” balance of powers positions. The President, The House and the Senate!!! but I believe we have to give the conservatives an opportunity to end this path of destruction! I respected George W Bush but I did not always agree with everything he did, but our major problems started when the liberal democrats took both house and the senate. Nancy Pelosi took us from 440 billion dollar deficit to the trillions we now face. The house by itself cannot overcome without agreement from the senate and Harry Reid is preventing justice from taking place!!! In my opinion Barack Obama, Nancy Pelosi, Harry Reid and Eric Holder have all been guilty of treason. It seems we have the laws of the United States and then we have those that think they are above the law!!!

            This is the kind of thing that makes the average Joe not want to go to the polls to vote. Where is the Republican House on This???? How long has Issa and Company languished in SLOTH concerning Fast and Furious before they decided to bring contempt charges…AND ARE THEY ACTING ON IT NOW.

            We call…we get “lip service”. Result…We either vote them out or we just don’t vote. That is how Americans feel about this. We have no concept of trillions of dollars…what’s a couple of billion here and there…Congress does what it wants anyway. The will of the people be darned. TPM…..you tried…but you…as with the Congress did not have the guts to get behind a CONSERVATIVE candidate. Will much change…I doubt it. Nobody wants it to.

            Solyndra is but a drop in the bucket. What about Light Squared…what about all the $$$ the Fed ‘SECRETLY’ sent to bail of Europe? What do “we the people” have to say about anything.

            We come to our party’s meetings, we hear the dog and pony show…and then…nothing. If we do hear “something”….that person is a radical or a terrorist…meaning the representative that brought up the objection.

            My candidate did not make it…but say what you will about Gingrich…at least he held Clinton’s feet to the fire…and that Congress (irregardless of what Gingrich was doing privately) brought impeachment against Slick Willy….and that was for lying under oath. Obama LIED WHEN HE SWORE TO UPHOLD THE CONSTITUTION. Anything done about that…NOTHING.

            I applaud you for bringing up the topic and asking the questions…but when it comes to this Congress doing anything for the “people”….we lose. Boehner knows he can bring up bills and get them passed through the House…AND HE USES THE SENATE for cover because he knows they won’t pass. Any press conferences by Boehner…Nope. Any by Issa….Nope.

            So…we are at a tipping point emotionally…it comes down to “who gives a darn…nothing is going to happen anyway. All they do is play musical chairs and the debt goes up, inflation is alive and kicking and WE’RE BROKE”.

            There has to be others like you in the House. Find them and band together. Keep asking questions. Contact all of the news outlet and don’t give up till the story becomes alive again. You have the ears of the readers here at Red State. We will support you.

    Really. Taxpayers paid like $45/share for a stock now trading in the low 20s. It really is no different than Solyndra. They are both bailouts and are both an outrage and yet the Administration runs around blathering about GM like it is some kind of success story.

    I think it is okay to blame the media but why isn’t our side(you guys) doing a better job of explaining to the American people how wrong all of this is? I, for one, am frustrated.

    I agree why is it that Barack Hussein Obama and Eric Himpton Holder Jr commit out right embezzlement such as Solyndra? Why aren’t both Obama and Holder being investigated for Fast and Furious with more rigor, murder was caused by their need for Gun Rights to be squeezed out of the American Citizen..

    Why is Barack Hussein Obama being investigated for his contempt of court by U.S. District Judge, Martin Feldman of New Orleans because he would not lift the moritorium for offshore drilling, yet Obama flies down to Brazil with $2 billion of taxpayer dollars to invest in a company called PetroBra, which so happens George Soros has a lot of his money tied into this company as well.

    Why did Eric Himpton Holder Jr and Barack Hussein Obama Jr tell the DOJ to stop the litigation of Civil Rights Violation in the 2008 election of the New Black Panther group in Philadelphia?

    These are all reasons for Impeachment and yet Congress just continues with their Dog and Pony shows and nothing is being done. In other words “all bark and no bite”…

    Isn’t this just a little too like the Obama take over of General Motors and Chrysler where he robbed honest investors in order to give the money and power to the union bosses so that they would continue campaign contributions. You know the whole obama stimulus fiasco seemed to reek of this. Obama stole a trilion dollars of taxpayer money in order to refund his rich liberal democratic donors!!! They were diabolical in their ponzi scheme… they gave half a billion dollars to NPR (National liberal media), half a billion dollars to Hollywood and the same to “The Arts”,over 20 billion dollars to College Profs and over 300 billion dollars to Green Interests!!! Have you noticed the pattern that all of these are some sort of media outlets and then of course there is the scheme to enslave over half the population onto the government plantation. When you are completely dependent on the government for your livlihood you tend to not be an independent thinker! Liberals don’t like independent working middle class people because they tend to be free thinkers and soon realize that we cannot continue on the path to destruction. They also soon tend to realize that “their” tax dollars are the ones being stolen by the liberal machine. I tend to agree with Starr Parker “have you ever noticed that when the Republicans offer bills that will help poor people get jobs and become self sufficient they meet a brick wall from the liberal left, NAACP, Al Sharpton, Jessie Jackson and other ultra liberals…” Starr Parker hit the nail on the head with this one it is because these same people make millions of dollars for themselves and their groups by over-seeing these programs and also fighting to keep them around. It is not for the poor, but for their own greed and power!!! Capitalism has not failed our nation, it has given every person the opportunity to raise to levels that will never have the opportunity to see under socialism or communism!!! What has failed our nation is our politicians and the ultra liberal rich that buy them!!! It is time to throw all of the money changers out of office and instate some people that love America and want to see it prosper once more. When the working base is large, people feel good about themselves and their families and the tax base is larger and the government doesn’t have to raise taxes on everything under the sun! Don’t be fooled for one instant, these new taxes are aimed at the middle class working person… and if they should collapse the middle class then they have accomplished communism much easier than they thought!!! It is theft for Obama and the liberals to use taxpayer money to fund the DNC and the Obama election campaign!!! Obama was looking for someone to sue, well the American people should sue him and his administration for the theft of tax dollars to fund liberal only issues!!!

    MSM will run with any made up story about Bush, Romney, Palin without ever fact checking. MSM will not pursue any story, no matter how factual, that is critical of obama. obama’s lies are reported as truth and enlightenment, his trampling of the Constitution goes untouched as news, and his obvious fraudulent documentation i.e., birth certificate, SSID, and draft card are studiously ignored.     Why should we, the citizens of these United States, continue to support a government so totally out of control? If the 50% of us who pay our taxes quit paying, they couldn’t put us all in jail, could they? I am sure this can’t happen, but I sure would love to see it. I’m sick of scrimping and saving and scratching to get by and watching this idiots in D.C. squander millions and our President “forgets we have a recession!” Outraged does not begin to scratch the surface of my feelings and everyone I know. Of course they are ALL out of touch becausde we ALLOW it! More people like Rep. Griffith will help, but frankly, after a while, they seem to all drink the “power” KoolAid. Hope I’m wrong here.

    I have been explaining this issue to people since I heard about it. The fact that an unelected individual within our government took it upon himself to illegally subordinate the interests of the taxpayer in this case, without being called on it and prosecuted for his actions, is an egregious abdication of the responsibility of Congress to look out for our interests. This is also what happened in the automobile bailouts. When laws so basic as the superiority of lien position can be abrogated by an individual playing favorites, what is to become of free market capitalism and private investors? If I could not be guaranteed first lien position on my investment, I would no longer play…

    That the Solyndra and other failed “Green energy” companies got extensive tax payer funds to stimulate their industries yet Like the major figures in Solyndra, all past loaners to Obama’s election funds, they got paid first the tax payers left holding the bag so to say. Just how much of these funds are now being funneled into Obama’s reelection funds? That is the real question that needs to be asked
