    Lochner stands for the ridiculous proposition that judges can use the Due Process Clause to fashion any “substantive due process” rights imaginable — even rights that have nothing to do with anything enumerated in the Constitution, and rights that have never been endorsed by Congress, and rights that conflict with other people’s rights — and compel every legislator and state and citizen in the United States to comply with that judicial fiat.

    Let’s not regabilitate Lochner, and instead pray that Lochner will be joined by Roe v. Wade (which was based on the exact same ridiculous legal theory).
