DENIED AGAIN: Michigan Appeals Court Rejects Gun Ban at Polls Tuesday

Even though baseball season is now over with the Los Angeles Dodgers winning the World Series, I still think that the ole adage of three strikes and yer out is valid. So that means that Michigan Secretary of State Jocelyn Benson and Attorney General Dana Nessel have just one more strike and next up is the Michigan State Supreme Court.

They should get ready to be called out.

As you might recall earlier last week, Benson had banned the open carry of guns at Michigan polling places due to voter intimidation with no authority to do so. Her basis for this was that people were afraid after the failed attempt by some whackjobs to try and kidnap the Governor and take her to Wisconsin to be tried for being a bad Governor. So logically in Benson’s mind, that meant that guns needed to be banned to keep fear at a minimum.

According to the Washington Post

The Michigan appeals court on Thursday rejected an appeal from a Democratic state official who wants to ban the open carry of guns outside polling places.

The court, in a 3-0 order, declined to hear the case but noted that it’s already illegal to intimidate voters or aggressively wave a gun in public.

“Anyone who intimidates a voter in Michigan by brandishing a firearm or, for that matter, by threatening with a knife, baseball bat, fist, or otherwise menacing behavior, is committing a felony under existing law,” the court said.

The order came two days after a judge said Secretary of State Jocelyn Benson had exceeded her authority in prohibiting the open carry of guns within 100 feet of a polling place.

Quite simply, the matters involving where guns can or cannot be are done by the Michigan Legislature and signed by the Governor. How on Earth Jocelyn came up with the notion that she could just come up with a law out of nowhere is baffling but it is running rampant in the state currently. They both need to stop.

However, it looks like they won’t take the previous hints from the court being the Attorney General has already announced that they will be asking the Michigan State Supreme Court to take the case up ASAP as the election is just 4 days away now. My best guess is that the top court in the state will render the same decision as the Court of Appeals did and throw Benson’s overreach to the curb.

Which, in the lingo of the greatest sport ever means, STRIKE THREE!!
