“Are you, sir, investigating the fact that the FBI used the dossier to get a wiretap against Trump associates and they did not tell the FISA court that the Democrats and Hillary Clinton paid for the dossier?” Maria Bartiromo, the host of Fox’s Sunday Morning Futures, asked Sessions.
“Let me tell you, every FISA warrant based on facts submitted to that court have to be accurate,” he replied.
“That will be investigated and looked at, and we are not going to participate as a Department of Justice in providing anything less than a proper disclosure to the court before they issue a FISA warrant. Other than that, I’m not going to talk about the details of it, but I tell you, we’re not going to let that happen.”
This is a major break for what everyone else opposing the Nunes memo has said. There argument has been that none of the facts in the Trump dossier has to bear any relationship to the truth and the FBI’s only obligation is to certify that they believed Steele had accurately reported what other people reported had been told to them. Session seems to say, that if facts in the dossier were used in support of warrant then the facts have to be accurate.
If Sessions does have the Justice Department looking at this, I’m confident we’ll get some answers. I’m equally confident that when the smoke clears that Trey Gowdy’s interpretation of the nature of the FISA warrant that ended up comprising the so-called Nunes memo will be proven to be very, very accurate.
Then Sessions will have to decide what to do about the people who used it and the mess that has proceeded from it.
