Here we go.

For the first time in 25 years Associate Justice to the Supreme Court, Ruth Bader Ginsburg will miss oral arguments in a case to SCOTUS.

Chief Justice John Roberts made the announcement from the bench before cases were heard on Monday according to Yahoo News.

Chief Justice John Roberts said in the courtroom Monday that Ginsburg would participate in deciding the argued cases “on the basis of the briefs and transcripts of oral arguments.”

Ginsburg had two earlier cancer surgeries in 1999 and 2009 that did not cause her to miss court sessions. She also has broken ribs on at least two occasions.

The court said doctors found the growths on Ginsburg’s lung when she was being treated for fractured ribs she suffered in a fall at her office on Nov. 7.

After past health scares, Ginsburg has come back to work relatively quickly. In 2009, she was at the court for arguments on Feb. 23, 18 days after surgery for pancreatic cancer.

Justice Ginsburg has bounced back so many times from many health problems and I hope she also recovers from this. If you are not hoping for that, then might I ask you to read this clip from CNN where Eugene Scalia, the son of Antonin Scalia, recalled his Dad’s friendship with Ginsberg.

“Their ability to engage on ideas and yet respect one another’s abilities and maintain a friendship is an instructive lesson,” Scalia added. “And I think they would both heartily agree that we want to have people on two sides of an issue to explain what the right answer is.”
The younger Scalia, a prominent Washington lawyer who served in President George W. Bush’s administration, noted that the Supreme Court is known for its collegiality, as compared to other branches of government where partisan bickering has become the standard.

Justice Scalia would be praying and pulling for her to get through this and you should also.

Save the speculation of IF President Trump gets a third bite at the apple for picking a Supreme Court Justice for now and let’s just hope she gets better.
