Another Nugget From the DOJ's Latest Filing in Hunter's Case: That Laptop? Oh, Yeah, It's Real

It may have been tacitly acknowledged by everyone aside from diehard leftists and Biden defenders — including those highly-respected 51 current and former members of the Intelligence Community who famously signed off on the October 2020 letter assuring us that it bore "all the classic earmarks of a Russian information operation " — but in case you hadn't heard: Hunter Biden's laptop is real. (Whether or not one might consider it spectacular is an entirely separate matter.)

Of course it's real. Most rational people with an ounce of intellectual integrity have known it was real since the fall of 2020. But now we have definitive confirmation of that. From whom? Why, from Joe Biden's own Department of Justice. Indeed, that acknowledgment is right out there for all to see in the latest DOJ filing in the Delaware criminal case involving the First Scion's alleged firearms violations. 

As RedState's Managing Editor Jennifer Van Laar reported on Tuesday, the DOJ's response to Hunter's Motion to Dismiss the case was highly revelatory.

It turns out that while preparing for Hunter's July court appearance FBI investigators decided to take photographs of the handgun Hunter's then-girlfriend ditched in a dumpster in Delaware back in 2018, and which was seized by Delaware State Police at that time and placed into evidence. Meaning, the firearm and its storage pouch have been in a sealed evidence bag, in a Delaware State Police vault, since October 2018. When FBI investigators opened the evidence, they found a "white powdery substance," had it tested, and, surprise, surprise, it was cocaine.

The rest of the response is good reading, as the prosecution responds to Hunter's illogical and nonsensical contentions with the sarcasm they deserve. The prosecution points out that Hunter's team hasn't even attempted to identify a similarly situated person who was not prosecuted for the same crimes, and fails to show any evidence of a discriminatory purpose, saying: 

Further, he did not establish discriminatory purpose because none of the politicians he reads on “Truth Social” approved the indictment, and tweets by political opponents of the President did not cause current Executive Branch officials to seek an indictment against the President’s son.

But coke on the holster isn't the only detail of note in the 52-page court filing (which may be viewed in its entirety below). In laying out the factual background undergirding the weapons charges against Hunter, the government points to the multiple pieces of corroborating evidence — including the laptop. From the DOJ's response: 

C. While Investigating the Defendant for Tax Violations, Investigators Obtained Evidence Showing His Prior Gun Purchase Was Illegal Because He Was Addicted to Controlled Substances

In August 2019, IRS and FBI investigators obtained a search warrant for tax violations for the defendant’s Apple iCloud account. In response to that warrant, in September 2019, Apple produced backups of data from various of the defendant’s electronic devices that he had backed up to his iCloud account. Investigators also later came into possession of the defendant’s Apple MacBook Pro, which he had left at a computer store. A search warrant was also obtained for his laptop and the results of the search were largely duplicative of information investigators had already obtained from Apple. Law enforcement also later obtained a search warrant to search the defendant’s electronic evidence for evidence of federal firearms violations and to seize such data. [emphasis added]

The fact that the government had the laptop was already fairly well documented. We've known for years that the repair shop owner where Hunter left the laptop turned the laptop over to the FBI in December of 2019. Further, when IRS whistleblowers testified before Congress in July of 2023, Gary Shapley noted that while he and other IRS investigators were denied access to the laptop, Assistant U.S. Attorney Lesley Wolf confirmed they (DOJ) had the laptop in their possession.

Further, Shapley had previously confirmed that evidence, such as the infamous WhatsApp messages, had been independently produced by Apple pursuant to a warrant (consistent with the DOJ filing) rather than deriving solely from the laptop since the IRS investigators were not given direct access to it.

In any event, while the validity of the laptop has long been accepted by many, to see the DOJ itself running with it as such is further affirmation. We were right.
